List of Measuring Instruments Subject to Compulsory Metrological Inspection,
Important and Special Requirements for Measuring Instruments, Including Accuracy
Requirements, and Verification Validity Periods for Measuring Instruments1
This Regulation is established on the basis of Article 7(3) of the Metrology Act.
Article 1. Scope
(1) This Regulation stipulates the list of measuring instruments which are placed on the
market, brought into use and used and which, according to Article 7(1) of the Metrology Act,
are subject to compulsory metrological inspection. It also stipulates the verification validity
periods and important and specific requirements for such measuring instruments.
(2) The types of metrological inspection of measuring instruments include conformity
assessment, type approval, legal metrological inspection and verification.
Article 2. Definitions
(1) The terms used in connection with measuring and measuring instruments comply with the
definitions given in the Metrology Act.
(2) The term “trading” is used in the sense as defined in the Trading Act.
(3) The terms “water company” and “client” are used in the sense as defined in the Public
Water Supply and Sewerage Act.
Article 3. Measuring Instruments Subject to Compulsory Metrological Examination
(1) The lists of measuring instruments subject to compulsory metrological inspection and the
accuracy requirements depending on the purpose of the instruments are in the second column
of the tables in Annexes 1 and 2.
(2) Each measuring instrument which is placed on the market and/or brought into use must
undergo metrological inspection as specified in Article 7(2) of the Metrology Act and in

Article 10(1)(1) to (4) of the same Act. The metrological inspection procedures for specific
measuring instruments are in the third column of the table in Annex 1.
(3) A measuring instrument which is not subject to Article 49 of the Metrology Act may be
verified if the measuring instrument:
1) has passed a metrological inspection as specified in Article 7(2), Articles 71, 8, 9, or
Article 10(1) of the Metrology Act taking into account Article 491(1) and Article 50(3) of the
same Act; or
2) has been verified in Estonia before this Regulation takes effect – proof of this verification
shall be required.
Article 4. Requirements for Measuring Instruments
(1) Metrological inspection must be based on important and special requirements and the
criteria (hereafter “requirements”) which have been established for the respective type of
measuring instruments in EU Directives on measuring instruments and non-automatic
weighing instruments, in individual EU directives, in the documents of the International
Organisation of Legal Metrology (OIML) referred to in Annexes 1 and 2 or in the standards
of international or European standardisation organisations.
(2) The documents establishing the requirements for various types of measuring instruments
placed on the market and/or brought into use are in the fourth column of the table in Annex 1.
(3) National initial verification and subsequent verification of a measuring instrument in use
must be based on the requirements specified in Clause 1 and the documents mentioned in the
fourth column of the table in Annex 2 and the volumes of tests which were compulsory for
the measuring instrument at the time it was placed on the market and which have been
specified in the conformity declaration or national/EU-type approval certificate of the
measuring instrument. If the abovementioned documents contain no separate requirements
for subsequent verification, it must be based on the requirements for initial verification.
(4) The names of the documents listed in the fourth column of Annexes 1 and 2 refer to the
amended versions, except those with a year number.
Article 5. Verification validity period
(1) The verification validity periods for various types of measuring instruments are in the
third column of Annex 2.
(2) The verification validity period of a measuring instrument which has passed a
metrological inspection as specified in Article 10(1)(1) to (4) shall begin on the date on
which the national initial verification, the EU initial verification or conformity assessment
procedure of that type of measuring instruments as specified in the legal acts takes place. If
the conformity declaration, verification certificate, conformity mark or verification mark
contain no date and month, the verification validity period shall begin on 1 January of the
year the respective procedure took place.
Article 6. Administrative provisions

(1) The verification validity periods established in this Regulation shall be applicable to
measuring instruments which have been verified before this Regulation takes effect starting
from the time when the verification validity period of the specific measuring instrument has
ended as specified in Minister of Economic Affairs and Communications Regulation No 112
“The List of Measuring Instruments Subject to Metrological Inspection, the Verification
Validity Periods of and Accuracy and General Requirements for Measuring Instruments” of
21 April 2004.
(2) If the verification validity period of a specific measuring instrument in Annex 2 hereto is
longer than that specified in Minister of Economic Affairs and Communications Regulation
No 112 “The List of Measuring Instruments Subject to Metrological Inspection, the
Verification Validity Periods of and Accuracy and General Requirements for Measuring
Instruments” of 21 April 2004, the new verification validity period shall take effect on the
first day the previous conformity assessment or initial/subsequent verification took place.
(3) Minister of Economic Affairs and Communications Regulation No 112 “The List of
Measuring Instruments Subject to Metrological Inspection, the Verification Validity Periods
of and Accuracy and General Requirements for Measuring Instruments” of 21 April 2004
(RTL 2004, 18, 132; 112, 1760) is hereby repealed.

In the third column of the list of measuring instruments below, the following abbreviations
are used for referring to the required type of metrological inspection and the respective
procedures.
C1 – the conformity assessment procedures stipulated in Directive 2004/22/EC (Minister of
Economic Affairs and Communications Regulation No 46 “The Important and Special
Requirements for Measuring Instruments Subject to Directive 2004/22/EC, the Procedure for
Assessing the Compliance Thereof with the Requirements, the Certification Procedure and
Marking Requirements” of 15 May 2006) shall be compulsory;
C2 – the conformity assessment procedures stipulated in Directive 90/384/EEC (Minister of
Economic Affairs and Communications Regulation No 109 “The Metrological and Technical
Requirements for Non-automatic Weighing Instruments, Requirements for Design,
Construction, Marking, Conformity Assessment and Certification” of 21 April 2004) shall be
compulsory;
C3 – the conformity assessment procedures stipulated in Directive 93/42/EEC (Government
of the Republic Regulation No 354 “The Conformity Assessment Procedure for Medical
Equipment” of 13 December 2004) shall be compulsory;
EC – the EC initial verification of a measuring instrument which has an EC type-approval
certificate and has been produced in compliance with individual directives concerning
measuring instruments shall be compulsory during the verification validity period but not
later than 30 October 2016;
NT1 – initial verification of a measuring instrument which has a valid type-approval
certificate but which has received it before 30 October 2006 shall be compulsory during the
validity period of the certificate but not later than 30 October 2006;

NT2 – initial verification of a measuring instrument which has a national type-approval
certificate shall be compulsory;
NC – initial verification of a measuring instrument on the basis of its calibration results shall
be compulsory.

The fourth column of the list of measuring instruments below includes a list of documents
which allow the bringing into use of measuring instruments subject to metrological
inspection in Estonia since 1992. Verification pursuant to Article 10(1)(4) and (5) of
Metrology Act has to be based on the requirements specified in the document which was
valid at the time the instrument was brought into use.
