The aforementioned Contributors are jointly herein referred to as the
“Contributors”
The aforementioned parents/legal guardians are each referred to as a
“Parent” and jointly as the “Parents”
PARTICIPATION FORM – TERMS AND CONDITIONS
For valuable consideration, the receipt and sufficiency of which is hereby acknowledged:
The Contributors and Parents hereby warrant and represent that (i) they are fully entitled to sign this agreement and to make the following
agreements, warranties and undertakings and (ii) by entering the Programme, the Contributors are not subject to any agreement or arrangement
that would or might interfere with the Contributor’s entering the Programme. On behalf of the Contributors, each respective Parent agrees to
grant all the rights granted and be bound by all rules and regulations as set out in this agreement (the “Official Rules”).
Each Parent hereby warrants and represents that they are the parent or legal guardian of the corresponding Contributor as set out above.
With full title guarantee each Contributor and Parent hereby assigns to Disney (where relevant by way of present assignment of future copyright)
the entire copyright and all other rights in and to the Contribution throughout the universe whether vested, future and/or contingent (including,
without limitation, all rental and lending and other similar rights), to which the Parent or Contributors are now or may in the future be entitled
under the laws now or in the future in force in any part of the world to hold the same to Disney absolutely for the full period of such rights and any
and all renewals, revivals, reinstatements, extensions and reversions thereof and thereafter (insofar as may be possible) in perpetuity. Disney shall
be the sole legal and beneficial owner of all rights in the Contribution, and Disney shall be able at its discretion and without further payment to edit
and adapt the Contribution and exploit the Contribution or any part thereof in all media now known or invented hereafter, throughout the
universe for the full period of copyright including all renewals, extensions and reversions thereof.
Each Contributor and Parent hereby irrevocably and unconditionally (a) grants to Disney all consents necessary (pursuant to the Copyright Act
1968 (Cth) as amended from time to time (the “Act”) which may be required for the exploitation of the Contribution or any part thereof in any and
all media now existing or hereafter invented throughout the universe and hereby waive the benefit of any rights of attribution of authorship and
agree not to assert any such rights or any other rights to which each Contributor and/or Parent may be entitled to under the Act, and (b) sells to
Disney all physical materials acquired or purchased by or created by the Contributor and/or Parent in connection with the Contribution including
all physical sound and visual materials incorporating the Contribution. Disney shall be entitled to make use of the Contribution or any part thereof
in such manner as it shall in its sole discretion think fit, including (but not by way of limitation) the right to make changes, alterations, substitutions
and additions thereto deletions therefrom and adaptations and rearrangements thereof and translations into any and all languages, and, subject to
applicable law, each Contributor and Parent (on behalf of a child) also hereby waive (to the extent permissible by law) and consent to the
infringement of all so-called “moral” rights attaching to the Contribution. Without limiting the foregoing, each Parent and Contributor agrees not
to institute, support, maintain or authorise any action or lawsuit based, in whole or in part, on any purported violation of any similar law, including
without limitation any action or lawsuit brought on the ground that any television programme, motion picture, sound recording or other work
produced hereunder in any way constitutes a defamation or mutilation of the Contribution or any part thereof, or contains any unauthorised
variation, alteration, modification, change or translation of the Contribution.
Each Contributor and Parent hereby grants Disney the right to issue publicity concerning the Contribution and such television programme or
motion picture or other work or advertisement in which the Contribution may be used including, without limitation, the Programme, and for such
purpose to use and reproduce the Contributor’s name, image, likeness and recordings and/or copies of the Contribution and any description of the
Contribution. In addition each Contributor and Parent acknowledges that the Contributor’s name, age, image, likeness and town of residence may
be broadcast in connection with the Programme.
Each Contributor and Parent hereby warrant and undertake to Disney (a) that they are fully entitled to provide the Contribution to Disney, (b) that
nothing in the Contribution (whether by way of inflection or gesture or otherwise) will infringe the copyright or any other right of any person,
breach any contract or duty of confidence, constitute a contempt of court, be defamatory or be calculated to bring Disney into disrepute and (c)
that any facts expressed by the Contributor in the Contribution are to the best of their knowledge and belief true and insofar as the Contribution
contains any opinions, these opinions are the Contributor’s own and are genuinely and truly held by the Contributor. In addition, the Parent
warrants that this Agreement is clearly for the benefit of their child (i.e. the applicable Contributor).
Where Producer provides Contributor with a copy of the Programme (or any part thereof), Contributor may only use such copy for his or her
private, non-commercial use. Contributor shall not and Parent/Guardian shall procure that Contributor does not in any way or form publish, copy,
upload, publicly exhibit, on-sell, broadcast or distribute the Programme via any means including via online, print, television, any social media
service, or any other type of digital platform.
The release contained herein shall inure to the benefit of Disney and its successors, representatives, assigns or licensees and shall be binding upon
each Contributor and Parent. Disney’s rights hereunder may be freely assigned or licensed by Disney without prior consent from the Contributor
or Parent and that this Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia.
All capitalized terms used herein shall have the same meaning as provided in the Official Rules unless a contrary intention appears.
