The 163rd meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held on 29th to 31st

On scrutiny of the file it has been found
that the institution does not possess the land as
required under regulation, 09. Accordingly,
application submitted by the institution was
rejected

NRC/Acad./Misc/2009/17420 dt. 21.02.2010.
The institution has filed a Writ Petition no.
1449 of 2010 before the Hon'ble High Court
Himachal Pradesh. Hon'ble High Court vide order
dated 14.05.2010 has directed NRC to reconsider
the matter as follows:"The Hon'ble High Court after perusing the
writ petition as well as reply filed by NCTE, allow
the petition with direction to NCTE to grant
recognition to the petitioner - College. Hon'ble
court has specifically observed that petitioner college was initially granted recognition in the year
2007 as per norms existing at that relevant time
and at this stage recognition cannot be denied in
light of Clause 8.7 (i) of Regulations, 2009 Court
further observed that Regulations, 2009 are
prospective in nature and can not be given
retrospective effect.
Here it is submitted that on scrutiny of record
available at NRC office and also scrutiny of

application form dt. 29.10.2009 submitted by the
institution it is found that the institution has not
being running B.P.Ed. Course recognised by NCTE.
Whereas from the scrutiny of copy of writ
petition no. 1449 of 2010 it appears that the
institution is running B.P.E. course (three years
duration) recognised and affiliated by University.
On perusal of order dt. 14.05.2010 passed
by the Hon'ble High Court it appears that course
B.P.E course which is being run by institution
has been inadvertently mentioned as B.P.Ed.
course.

As per decision of 155th Meeting of NRC the
recognition of institution was withdrawn vide order
dated 08.02.2010 which inter-alia confirmed by
appeal committee vide order dated 05.05.2010.
The
institution
filed
a
writ
petition
no.
3707/3708/2010 and the High Court of Rajasthan
passed an order dated 26.05.2010 which is as
under:We may also note that the on issue of
ownership of land we have made certain
observations in WP (C) No. 1627/2010 titled
Shiksha Parshad Kanya Gurukul Julana Vs.
National Council for Teacher Education & Ann
decided on 16.03.2010. The peculiar facts of
the present case insofar as the ownership of
the land are concerned are liable to be
examined in view of the said judgment. One
of the material fact here is that the Trust
through a resolution has transferred land to
the petitioner Society. Learned counsel for
the petitioner further states that this
resolution is for all times to come.

We, thus, direct the Committee to once
again examine the matter in pursuance to the
original Show Cause Notice dated 09.07.2009
taking into consideration the responses dated
30.07.2009 and 09.09.2009 in WP (C) no.
3708/2010 and 3707/2010 along with the
relevant material produced as also the issue
of ownership of land as set out by the
petitioner read with order dated 16.03.2010
in WP (C) No. 1627/2010.”
Further a complaint has been received on
11.06.2010 regarding miss-leading the Hon’ble
High Court and taken relief there-of by producing
false evidence.

The primary relief sought by the petitioner is that
the respondents Nos. 1 and 2 be directed to accept
the application of the petitioner seeking permission
to grant of recognition of B.Ed. Course for the
petitioner institution.
At the outset, the learned counsel for the
petitioner has submitted that the controversy
involved herein was considered and decided by the
learned Division Bench of this Court in thee case of
RS Teacher Training college Vs. State of Rajasthan
& ors. [DB Civil Special Appeal (W) No. 892/2009,
decided on 23.02.2010] with the following orders:“Mr. Sanjay Pareek learned counsel appearing for
the respondent No. 1-NCTE submits that I he
aforesaid 17 consider the cases of the institution
as due to paucity of time the decision was not
taken by the Committee with regard to the
aforesaid institution

As per the order of Hon’ble
High Court of Jaipur, the
committee considered the
case and the following was
observed:


as processing fees.

Since there is a ban
for opening of B.Ed. Course
for the session 2010 – 2011
by NCTE, this case may be
considered, in view of court
order, for the session 2011 –
2012 only rather than from
the session 2008 -2009.

In view of statement made hereinabove, we deem
it proper to direct the respondent to convene the
meeting within a period of three weeks and
consider the appellants cases strictly in accordance
with the law and apprise the Court about the
decision taken by the respondent- NCTE on the
next date”
Hence
the
committee
directs the Institution to
submit the reply of above
points within 30 days.
Similarly, in the case of Progressive Children
school Samiti Vs. State & ors. [SB Civil Writ
Petition No. 4614/2009], a Coordinae Bench of this
Court has decided the similar issue on 07.01.2010
In view of the above, I deem it proper that the
petitioner should make representation to NCTE and
thereafter the respondents shall convene the
meeting within a period of three weeks and
consider the case of the present petitioner in
accordance with law.

Remarks.
After going though dispatch details by the

registered post.
As per decision of 161st Meeting of NRC the
recognition of institution was withdrawn vide order
dated 23.06.2010 the institution filed a writ
petition no. 4238/2010 and the High Court of
Rajasthan passed an order dated 18.06.2010

a statutory appeal under section 18 of NCTE
Act, 1993 before respondent No. 1 and the
same is pending.
In identical writ petitions being numbers
W.P (C) 10467/2009, W.P (C) 3855/2010,
W.P (C) 3854/2010 and W.P. (C) 4150/2010,
Single Judge of this Court has disposed of the
said writ petitions with the direction that the
order withdrawing the recognition shall
remain stayed pending disposal of the appeal
by the Appellate Authority.

to the respondent no. 3-NCTE to consider the
case afresh and after considering the
objections and the supporting documents
filed by the petitioners to pass reasoned

college again for its satisfaction and to verify
the averments made in the objections, after
giving information to the petitioners, if it
feels it necessary. Costs easy.”
