RULES FOR THE PROVISION OF THE POSTAL SERVICE
I. GENERAL PROVISIONS
1. The Rules for the Provision of the Postal Service (hereinafter referred to as the “Rules”) establish the
procedure and conditions of the submission of the notification of the planned commencement of provision of
the postal service, the cases of deletion of postal service providers from the List of Postal Service Providers,
the terms and conditions of the provision of the postal service, the procedure and conditions of the
submission of reports on the provided postal service to the Communications Regulatory Authority of the
Republic of Lithuania (hereinafter referred to as the “Service”), as well as the procedure and conditions of
the publishing of summarised information on the activities of postal service providers and information
announced by the Authority, which is necessary for the development of an open and competitive market.
2. The provisions of the Rules shall be applicable to persons who provide or intend to provide the postal
service.
3. The definitions used in the Rules are defined in the Postal Law of the Republic of Lithuania (Official
Gazette, 1999, No. 36-1070; 2012, No. 135-6867).
4. Documents shall be submitted to the Authority under the procedure laid down in the Rules, and the
submission thereof must comply with the requirements, procedure and conditions of the Rules for the
Submission of Documents to the Communications Regulatory Authority of the Republic of Lithuania
approved by Order No. 1V-292 of the Director of the Service of 16 September 2004 (Official Gazette, 2004,
No. 141-5171; 2005, No. 73-2675).
II. RIGHT TO PROVIDE THE POSTAL SERVICE
5. A person shall have the right to provide the postal service without a separate prior authorisation of state
institutions, in compliance with the provisions of the Postal Law of the Republic of Lithuania, the present
Rules and other legal acts, after a person has notified the Authority thereof.
6. Before the commencement of provision of the postal service, a person shall submit in writing, through
electronic means of communication, or by applying directly to the Authority:
6.1. a completed notification of the planned commencement of provision of the postal service, in the form
established in Annex No. 1 to the Rules (hereinafter referred to as the “Notification”);
6.2. copies of the documents confirming the legal establishment of a legal entity (except for legal entities
registered with the Register of Legal Entities of the Republic of Lithuania), if the Notification is submitted
by a legal entity; a copy of the document certifying a person’s identity, if the Notification is submitted by a
natural person.
7. The Authority shall, no later than within 5 working days after the date of receipt of all the documents
indicated in paragraph 6 of the Rules, include a person into the List of Postal Service Providers, which is
published on the website of the Authority, and notify the person who has submitted the Notification thereof.

The notice specified in this paragraph shall be sent no later than within 3 working days after the date of
entering a person into the List of Postal Service Providers.
8. Having determined that the Notification does not meet the requirements laid down in the Rules, the
Authority shall, no later than within 5 working days after the date of receipt of the Notification, notify the
person who has submitted the Notification thereof and set a deadline that is no shorter than 5 working days
for the elimination of the deficiencies detected by the Authority. In this case the deadline specified in
paragraph 7 of the Rules shall be calculated from the date of receipt of the revised Notification by the
Authority.
9. In the event that a person fails to eliminate the deficiencies in the Notification within the deadline set in
paragraph 8 of the Rules or submits inaccurate data, the Authority shall not include the person into the List
of Postal Service Providers and it shall notify the person thereof within 5 working days, specifying the
motives of the non-inclusion of the person into the List of Postal Service Providers.
10. A person included into the List of Postal Service Providers shall have the right to request the Authority to
issue a confirmation that the person has submitted the Notification and have the right to provide the postal
service (hereinafter referred to as the “Confirmation”). The Confirmation shall be issued no later than within
7 working days after the date of receipt of the person’s application to issue the Confirmation. Persons may
also submit to the Authority the application to issue the Confirmation together with the Notification. In this
case, the Confirmation shall be issued no later than within 3 working days after the date of entry of the
person into the List of Postal Service Providers. The application to issue the Confirmation shall be
considered to be eligible if the fee fixed by the Authority has been paid for the issuance of the Confirmation.
11. Upon a free-form request, the Authority shall provide information to persons on whether a particular
person has submitted the Notification to the Authority or has been included into the List of Postal Service
Providers.
12. The postal service provider shall be deleted from the List of Postal Service Providers if:
12.1. the postal service provider has submitted a notification of the termination of activities and/or the
provision of the postal service;
12.2. the Authority has established that the postal service provider has terminated activities and/or the
provision of the postal service;
12.3. the postal service provider dies or has been liquidated;
12.4. a court ruling to liquidate the postal service provider has entered into effect, where a person is a legal
entity or another organisation, due to the postal service provider’s bankruptcy;
12.5. the Authority has established that the postal service provider submitted inaccurate data, due to which
the person could not be included into the List of Postal Service Providers;
12.6. the postal service provider for one year has not submitted any reports to the Authority on the provided
postal service;
12.7. the postal service provider could not be reached at the address of the person’s headquarters indicated in
the Register of Legal Entities or of the person’s permanent place of residence for one year.
13. Before deleting the postal service provider from the List of Postal Service Providers under paragraphs
12.5 and 12.6 of the Rules, the Authority shall warn the postal service provider of the potential deletion from
the List of Postal Service Providers and grant the possibility to submit necessary revised data or reports on
the provided postal service within the deadline set by the Authority that is not shorter than 30 days.
14. The Authority shall notify the postal service provider of the deletion of the postal service provider from
the List of Postal Service Providers, specify the basis for the deletion from the List of Postal Service
Providers and inform that persons, who provide the postal service without having notified the Authority

thereof, shall be held liable under the procedure laid down in the legal acts. The notice specified in this
paragraph shall be sent no later than within 3 working days after the date of deletion of the postal service
provider from the List of Postal Service Providers.
15. Having terminated his activities and/or the provision of the postal service, the postal service provider
shall submit a notification to the Authority on the termination of activities and/or the provision of the postal
service in the form established in Annex No. 2 to the present Rules.
III. TERMS AND CONDITIONS OF THE POSTAL SERVICE PROVISION
16. Postal service providers shall comply with the requirements of the Postal Law of the Republic of
Lithuania, the present Rules and other legal acts regulating the provision of postal service.
17. The postal service provider shall:
17.1. have internally approved the description of the postal service provision procedure, which must specify
the types of the provided postal service, their tariffs, the postal items delivery time, the liability of the postal
service provider, the complaint handling and damage compensation procedure, as well as the postal item
collection, sorting, transportation and delivery procedure;
17.2. deliver postal items in person against signature or into boxes for incoming postal deliveries and, where
this is impossible, inform thereof the addressee;
17.3. deliver postal items, addressed to the place of employment or studies of a person, dormitory, place of
military service, hospital, sanatorium, camp or place of imprisonment, to the administration or persons
authorised by it;
17.4. deliver registered or insured postal items in person against signature to the addressee specified by the
sender or the person specified by the addressee in writing by indicating the first name and surname of this
person;
17.5. store a postal item which is impossible to deliver to the addressee or return to the sender, where the
sender (addressee) refuses to collect the postal item or where the addressee (sender) does not live at the
indicated address, for 2 months; if within the established time period the sender (addressee) fails to collect
the postal item, although a written notification has been sent to him, the postal service provider must notify
the State Tax Inspectorate under the Ministry of Finance of the Republic of Lithuania of such property and
hand it over into the ownership of the State; the notification shall be accompanied by the marking of the
postal service provider that the sender (addressee) has been invited to collect the postal item, but failed to
arrive or rejected the postal item;
17.6. return to the sender the postal items that have not been delivered or handed in to the addressee, if the
provision of the postal service has been terminated;
17.7. provide information about the postal service provider’s name or first name, surname, legal status, legal
form, address of the headquarters or permanent place of residence, register name, registration code or
equivalent identification data from the register, if it has been registered in the public register, the value added
tax payer’s code, if the postal service provider is a value added tax payer, contact details (correspondence
address, fax and telephone numbers, e-mail address), and working hours;
17.8. provide the possibility to users to reach a person at the address of the headquarters or permanent place
of residence;
17.9. publicly announce detailed and constantly updated information, declared in Article 6.719(1) of the
Civil Code of the Republic of Lithuania, as well as the description of the postal service provision procedure,
specified in paragraph 17.1 of these Rules, information on all types of the provided postal service, their terms

and conditions, the terms and conditions of the agreement for the postal service provision, including the
tariffs of the postal service, and other information that has an effect on the user’s decision to use the postal
service;
17.10. publicly announce information on the access points;
17.11. guarantee the confidentiality of correspondence to users;
17.12. have internally approved user complaints handling procedure; reply to user’s complaint related to
postal service provision within 30 days after the date of receipt of the complaint;
17.13. indicate on a postal item or enclose to a postal item data, which would help identify the postal service
provider, the place (address) of the postal service provision, where the user could apply, the date of
acceptance of a postal item for delivery and the date of delivery to the addressee;
17.14. periodically submit reports on the provided postal service to the Authority under the procedure and
conditions laid down in Chapter IV of the Rules.
18. Subject to the choice of the postal service provider, information specified in paragraphs 17.7 and 17.9 of
the Rules shall be:
18.1. provided on the initiative of the postal service provider himself/itself;
18.2. easily accessible to the user at the place, where the postal service provider provides the postal service
or the agreement on the postal service provision is concluded;
18.3. easily accessible to the user through electronic means of communication at the address, specified by the
postal service provider;
18.4. included into information documents, which describe the postal service provided by the postal service
provider in great detail, submitted by the postal service provider to the user.
19. Obligatory information, specified in paragraphs 17.7 and 17.9 of the Rules, shall be provided or
submitted clearly and unambiguously, and also a sufficient period of time shall be given to get familiarised
with this information before the conclusion of the agreement for the postal service provision, or if such
agreement is not concluded, before the postal service provision.
20. Together with the requirements established in paragraph 17 of the Rules, the postal service provider,
when delivering postal items in person against signature, shall:
20.1. deliver the postal item to the addressee in person against signature; if it is impossible to deliver the
postal item to the addressee in person (the addressee cannot be found at the address specified by the sender,
etc.), the postal service provider shall notify the addressee of the postal item by leaving a notice in the
addressee’s box for incoming deliveries or through electronic means of communication ensuring the receipt
of such notice;
20.2. for 6 months after the date of delivery of the postal item store the documents certifying the delivery of
the postal item to the addressee in person against signature, which would indicate the addressee’s name and
the first name, surname and signature of the person who accepted the postal item, or the addressee’s first
name, surname and signature, the delivery date of the postal item, the address, the sender’s name or first
name and surname; in case of a dispute between the postal service provider and users over the delivery of a
postal item, the postal service provider must store the documents, indicated in this paragraph, until the date
of resolution of the dispute;
20.3. return the postal item, which is impossible to deliver to the addressee (the addressee refuses to accept
it, does not reside at the address indicated by the sender, etc.), to the sender; the postal service provider may
agree with the sender on other actions than those indicated in this paragraph to be taken in respect of the
postal item, which is impossible to deliver to the addressee.

21. At the sender’s request, the postal service provider may provide the postal service that has an added
value:
21.1. to deliver and collect postal items at the time and/or place preferred by the user;
21.2. to change the course of delivery of the postal item;
21.3. to acknowledge the delivery of the postal item;
21.4. to provide the possibility to receive information about the location of the postal item at any time;
21.5. to provide another postal service that has added value.
22. The postal service provider shall, under the procedure established by the Government of the Republic of
Lithuania or its authorised institution, submit to the Authority data on:
22.1. any branches and/or subsidiary companies established by the postal service provider in the Republic of
Lithuania, which intend or ceased to provide the postal service;
22.2. any changes in the conditions related to the activities of the branches and/or subsidiary companies
established by the postal service provider in the Republic of Lithuania, as well as any changes in the legal
form, legal status thereof or other changes, due to which the requirements established in the Postal Law of
the Republic of Lithuania, the present Rules and other legal acts regulating the provision of the postal service
are not met.
IV. PROCEDURE AND CONDITIONS OF THE SUBMISSION OF REPORTS AND PUBLISHING
OF INFORMATION ON THE PROVIDED POSTAL SERVICE
23. Postal service providers shall periodically, at the end of a quarter and a year, submit to the Authority
reports on the provided postal service, in the form established in Annexes No. 3 and 4 of the Rules:
23.1. the first-quarter reports (for the period from 1 January until 31 March) – by 30 April;
23.2. the second-quarter reports (for the period from 1 April until 30 June) – by 31 July;
23.3. the third-quarter reports (for the period from 1 July until 30 September) – by 31 October;
23.4. the fourth-quarter reports (for the period from 1 October until 31 December)– by 31 January of the
current year;
23.5. annual reports for the previous year (for the period from 1 January until 31 December) – by 1 March of
the current year.
24. Together with the annual report Postal service providers shall submit to the Authority the description of
the procedure for the postal service provision, specified in paragraph 17.1 of the Rules, the tariffs of the
postal service, and the samples of the means of identification of postal items (stamp, marker, waybill, etc.)
valid at the end of the reporting period, as well as the list of names and addresses of the access points
established within the served territory.
25. Annual and quarterly report forms shall be published on the website of the Authority. Postal service
providers shall submit to the Authority the completed report forms together with the documents specified in
paragraph 24 of the Rules without the prior warning of the Authority.
26. Upon the completion of an inspection or audit of the activities of the postal service provider, or after it
has become clear under other circumstances that the information provided in the annual or quarter report
submitted to the Authority is inaccurate and/or does not correspond with the reality, the postal service
provider shall submit a revised annual or quarter report to the Authority within 10 working days after the
date of detection of inaccuracies and/or inconsistencies, or within the deadline set by the Authority. The
submission of a revised annual or quarter report shall not exempt persons from liability for the provision of
incorrect information under the procedure laid down in the legal acts.

27. The Authority shall analyse, process and summarise data of the received quarterly and annual reports on
the provided postal service and publicly announce summarised information on the activities of postal service
providers in the Authority’s publications, on its website, in reports or other information documents.
28. The Authority shall publish information necessary for the development of an open and competitive
market:
28.1. the number of postal service providers operating in the postal services market and the shares of the
postal services market held by individual postal service providers;
28.2. revenue received from the provision of a specific postal service;
28.3. summarised quantities of items of correspondence and postal parcels;
28.4. other information necessary for the development of an open and competitive market.
29. Information from the received quarterly and annual reports on a particular postal service provider may be
announced publicly, if, when providing information to the Authority on the provided postal service, there is
no indication that it should not be publicly announced, or if this information is not deemed confidential under
the Postal Law of the Republic of Lithuania, the Rules and other legal acts.
V. FINAL PROVISIONS
30. Persons shall be held liable for any violations of the Rules under the procedure and conditions laid down
in the legal acts.
31. Any actions or omission of the Authority in connection with the compliance with implementation of the
present Rules may be appealed under the procedure and conditions laid down in the laws of the Republic of
Lithuania.

such as premiums, extra pays, benefits, severance payments, monetary gifts, bonuses, compensations, and business trip daily allowance
are included. Social insurance contributions payable by the employer, funds for the purchase of equipment and work clothes, various
training courses, business trip expenses (travels, accommodation), and benefits from the State Social Insurance Fund in case of
temporary unemployment (illness, pregnancy and childbirth leave, and maternity leave until the baby is three years old) are not included.
