DMC/DC/F.14/Comp.1218/2/2014/ 28th January, 2015 ORDER The Delhi Medical Council through its Executive Committee examined a complaint of Shri Sandeep Gupta r/o. C-127, Shakti Nagar Extn, Ashok Vihar, Delhi – 110052, forwarded by Directorate of Health Services, alleging medical negligence on the part of doctors of Maharaja Agrasen Hospital, in the treatment administered to complainant’s father Shri R.K. Gupta at Maharaja Agrasen Hospital. The Order of the Executive Committee dated 5th December, 2014 is reproduced herein-below :“The Executive Committee of the Delhi Medical Council examined a complaint of Shri Sandeep Gupta r/o. C-127, Shakti Nagar Extn, Ashok Vihar, Delhi–110052 (referred hereinafter as the complainant), forwarded by the Directorate of Health Services, Govt. of NCT of Delhi, alleging medical negligence on the part of doctors of Maharaja Agrasen Hospital, Punjabi Bagh, New Delhi-110026 (referred hereinafter as the said Hospital), in the treatment administered to the complainant’s father Shri R.K. Gupta (referred hereinafter as the patient) at Maharaja Agrasen Hospital. The Executive Committee perused the complaint, reply of Dr. Suparna Jha, Dy. Medical Superintendent, Maharaja Agrasen Hospital enclosing therewith joint reply of Dr. Rajeev Chawla and Dr. Hitesh Punyani, reply of Dr. Bharat Gopal, Dr. Bharti Saxena, Deputy Medical Superintendent, made to the Directorate of Health Services, Govt. of NCT of Delhi and copy of medical records, as supplied by the Directorate of Health Services, Govt. of NCT of Delhi. The Executive Committee observes that the complainant alleges negligence in the treatment of the patient and serious damage to the patient’s health (which is mentioned by the complainant as hale and hearty) due to faulty treatment given by the treating doctors. The Contd/: (2) complainant further alleges in his complaint that the patient was a diagnosed patient of diabetes, hypertension, coronary artery disease (with PTCA done twice in year, 2006 and 2009) and obstructive sleep apnoea for over fifteen years. The patient had presented to the emergency of the said Hospital on 10th June 2013 with complaints of pain in left ribs for two days (as mentioned in the complaint of the patient). The attending doctors in the discharge slip have mentioned about cough and expectoration for ten days which had progressively increased and deteriorated two days prior to presentation. A diagnosis of type-II diabetes mellitus, hypertension, CAD with lower respiratory infection was considered. As the pCO2 was high at admission (90 mm), the patient was advised a trial of non-invasive ventilation with oxygen (which appears a reasonable approach) on part of the treating team of doctors. The patient subsequently deteriorated with rising pCO2, while on BIPAP, which can occur at times initially, and which then requires invasive ventilation for complete recovery. However, before this recourse could be resorted to, the patient was discharged on request and taken by the attendants elsewhere. In view of the above, it is, therefore, the decision of the Executive Committee that prima-facie no case of medical negligence is made out on the part of doctors of Maharaja Agrasen Hospital, in the treatment administered to the complainant’s father Shri R.K.
