Individual Purchase orders shall be placed on the Supplier/s for each of STPI centre as listed at Section-X, which needs bandwidth during the proposed period of one year. Service Section II, corresponding to each of such purchase orders Clause No.: 29.7 shall be covered under separate Service Contracts, each of which valid for a period of one year from the date of service delivery. STPI shall invite the rates in the following manner: Bidder has to quote Basic Unit Price per E1 per month for first six months. Rate for the next six months shall be 90% of the rates finalized for the first six months. Rate finalized for the second six months shall be applicable for the existing Bandwidths and new requirements. The prices being quoted at the time of tender are most competitive prices, price should remain firm for a period of 1 year. Bidder request to remove the 6 monthly price revision clause. After the finalization of the tender the existing Section II , BW service at old rates shall either be Clause No.. 29.9 terminated or renewed at the new finalized price (as the case may be). Payment shall be made on quarterly in advance basis subject to submission of the Bank Guarantee of equal amount and valid for a period of One Year. The payment of the first quarter shall be made only after successful testing/commissioning of the service. The payment will be made based on each site delivered, accepted and invoice generated. Termination Clause: purchaser can terminate the service agreement by giving one month notice in advance to supplier. In case, the bidder stops service without notice, STPI has right to revoke the bank guarantee. Quantum of liquidated damages assessed and levied by the purchaser shall be final and not challengeable by the supplier. Force Majure reason attributable to service provider STPI may impose LD and in case of extreme situation STPI may cancel the undelivered portion of the order without assigning any financial liability.” We request this clause to be _mended to incorporate following:- For any delay in delivery due to reasons attributable to bidder ,bidder agrees to pay a penalty equal to 0.25% per week of delay, subjected to a maximum of 2.5% of annual recurring charges applicable on undelivered portion of the contract. In the event of Purchaser terminates the contract in whole or in part, pursuant to clause 16, the Purchaser may procure, upon such terms and in such manner as it deems appropriate, goods similar to those undelivered and the supplier shall be liable to the Purchaser for any excess cost for such similar goods. STPI may terminate the contract in whole or in parts, pursuant to clause 16, without assigning any financial liability on the bidder. The bidders required to submit the reports as and when required by TRAI in required format. 23 Section V, Clause No.:3.2 Microwave last mile links shall be established upon prior approval from STPI and all such links shall be given a relaxation in the latency up to a maximum of 30 ms and uptime up to 0.5 %. We suggest the assured link uptime required? Is it 99.5% or 99% in case of microwave? Termination of the bandwidth on GE/STM4/STM-1/DS3/E1/FE /V.35 interfaces would be done at the STPI gateway routers in respective STPI locations across the country. 24 Section V, Clause No.:2 The following shall be standard Interfaces: V.35 interface, E1-G.703 Balanced/unbalanced DS3- Copper Unbalanced STM-1 G.703 Electrical Interface Ethernet / Metro-Ethernet/ Fast Ethernet (Full Duplex) /Gigabit Ethernet STPI has asked for V.35 Interface, which required additional hardware. However the commercials sheet does not demarcate for additional hardware cost. We request you to please provide additional column space for quoting the V.35 hardware cost? The minimum guaranteed throughput shall be 99% while the other service parameters like Latency, Packet loss shall be measured at a maximum of 90 % loading only. Service Availability: - The International Bandwidth provider shall guarantee that the services will be available for 99.5% or better, of time averaged over a period of 30 days with reference to each parameter Namely Throughput, Round Trip delay & Packet loss. Non Conformance to the limits of any of the parameters shall be counted towards service unavailability. Table A Latencies Please clarify on the service provider scope of work for load balancing configuration, as all the hardware equipment including terminating CPE routers are being provided by STPI only. Throughput is data transfer rate= (total data/time taken). Throughput cannot be measured with historical reports. In this regard TRAI propose performance degrade after 80% loading of the port. The guaranteed throughput can never be 99% and hence we suggest relaxing this clause & making it to 95% and with a loading of 80% only. Section V, Clause No.:4.5 Section V, Clause No.:4.7 The average packet loss on the circuits should be less than 1%. It shall be measured by computing the percent packet loss of one thousand pings (with acknowledge for each previous packet received) of sixty four bytes each. This confirmed packet loss is the measurement of packet loss from STPI router to the router of Internet backbone tier-I carrier in USA/Europe/Australia/other Asia-Pac countries. Packet loss is desired to be measured online using relevant software tool and online reports are expected. 4.7 The distinction between Service Availability and Service Outage shall be made as per the parameters in the Table-B below: Table-B-----------------Through put ≥ 99% of the contracted Bandwidth Penalty for Service 1. We suggest that the packet loss should be measured from the STPI router till the edge router at the ISP end. 2. STPI will be measuring the Packet loss himself or SP shall be measuring from STPI router onwards and providing report. IN case SP to measure and provide report STPI to provide the SNMP access of CPE router and CPE router shall support IP SLA features.
