RESORT VILLAGE OF SOUTH LAKE
BYLAW NO 22-15
A BYLAW TO REGULATE THE OPERATION OF VEHICLES WITHIN THE RESORT
VILLAGE OF SOUTH LAKE
The Council of the Resort Village of South Lake in the Province of Saskatchewan
enacts as follows:
1. INTERPRETATION
1.
“Clerk/Administrator” shall mean the clerk or administrator of the
municipality.
2.
“Curb” means the lateral boundaries of a roadway, whether or not
marked by curbing.
3.
“Heavy Vehicle” means a motor vehicle with or without a load which
alone or together with any trailer, semi-trailer or other vehicle being towed
weighs 4.5 tonnes or more.
4.
“Highway” means any street or public highway within the Resort
Village of South Lake, but does not include a Provincial Highway therein
as designated pursuant to the provisions of The Highway and
Transportation Act 1997.
5.
“Lug Vehicle” means and truck, portable engine or traction engine
having metal spikes, lugs or cleats projecting from the face of the wheels
or tires thereof, or having metal track tread.
6.
“Parallel Parking” means the parking of a vehicle with both right
wheels thereof drawn up to the curb on the right hand side of the highway,
or at a distance of not more than thirty (30) centimeters from such curb.
7.
“Park” “parking” have the meanings ascribed thereto by The Traffic
Safety Act
8.
“Place of Public Assembly” means schools, theatres, movie picture
theatres, churches, hockey and skating rinks, dance halls and public
assembly halls.
9,
“Power Turns” means to maneuver a vehicle in such a manner to
cause the rear of the vehicle to depart from its ordinary line of progress by
the sudden use of acceleration and/or braking.
10.
“Speed Zone” means any portion of a highway within the Resort
Village of South Lake, as designated here-in, and identified by a sign
erected and maintained at each end thereof, indicating the maximum
speed applicable thereto.
11.
“U-turn” means the turning of a vehicle so as to cause it to proceed
in the opposite direction from which it was proceeding immediately prior to
the commencement of such turn.
12.
“Vehicle” means a vehicle or a motor vehicle as ascribed to it by
The Traffic Safety Act.
13.
“Loading zone” means that portion of a public highway adjacent to
the curb designated by signs and/or marking for the exclusive use of
vehicles loading and unloading passengers or goods.
2. SCOPE
1.
“STOP” STREETS
The highways as listed in Appendix 1 are designated as “Stop”
streets.
2.
“YIELD” STREETS
The highways as listed in Appendix 2 are designated as “Yield”
streets.
3. INFRACTIONS
1. “STOP” STREETS
The provisions of The Vehicles Act shall apply to all traffic
approaching and facing a “stop” sign erected and maintained in
accordance with the provisions of Section 4 (1)
2. “YIELD” STREETS
The provisions of The Vehicles Act shall apply to all traffic
approaching and facing a “yield” sign erected and maintained in
accordance with the provisions of Section 4 (2)
3. MISCELLANEOUS” SIGNS
a. No person shall, except where authorized by resolution
of Council or when duly authorized by law, erect upon or
immediately adjacent to any highway, any sign, marker,
signal or light or any advertising sign or device.
b. No person shall deface damage, destroy or remove any
sign or marker erected pursuant to this bylaw.
4. LUG VEHICLES
No person shall propel, operate or drive any lug vehicle upon
any highway within the Resort Village without first having
obtained from the clerk a permit in writing authorizing same,
except if the lug vehicle is carried by means of a rubber-tired
trailer or other conveyance equipped with rubber tires.
5. PARKING
a. Except as otherwise provided herein, the parking of vehicles
is permitted on all highways within The Resort Village.
b) Subject to the provisions of subsection (a) no person shall
park a vehicle in any lane, nor in any street so as to obstruct the
entrance to any lane or to a driveway or approach leading to
private premises.
c) Notwithstanding the provisions of subsection (a), a farm
truck or commercial vehicle may be parked in any lane for the
purpose of taking on or discharging cargo, providing no such
vehicle or truck shall be parked for a period exceeding thirty
(30) minutes at one time unless written permission has first
been obtained from the Clerk or an RCMP officer for an
extension of such time limit.
d) Every person parking a vehicle upon a highway within the
Resort Village where parking is permitted, shall parallel park.
e) No person shall park a vehicle in any “NO PARKING” area
as designated in Appendix 4 at any time whether such areas
are marked on the curb or otherwise by signs erected and
maintained in accordance with the provision of section 4(4) to
indicate that parking therein in prohibited.
f) No person shall park a vehicle on any highway at one place
for a period of time exceeding twenty-four (24) hours.
g) No person shall park any vehicle in any private parking place
or on any private property unless he is the owner, occupant,
licensee or permittee of the parking place or private property,
except with the consent of such owner, occupant, licensee or
permittee.
6. NO PARKING ZONES
a. No parking or vehicles other than the a Fire Truck and
Maintenance Truck is permitted on Resort Village property
designated as R5 except for 45.7 metres (150 feet) abutting lots
1,2,3, and 4 of Block 20, Plan 59MJ02267.
b. No parking of vehicles is permitted on Resort Village property
designated as R10 as shown in Plan 59MJ02267.
7. POWER TURNS
The operator of a vehicle shall not execute “power turns” on any
highway in the Resort Village.
8. SNOWMOBILES
Under the provisions of The Snowmobile Act, it shall be lawful
to operate a licenced snowmobile between the hours of 7am
and 10 pm on any public highway within the limits of the Resort
Village.
9. SPEED
No person shall operate a vehicle in the Resort Village of South
Lake at a speed greater than thirty (30) kilometers per hour.
10. U-TURNS
No person shall cause a vehicle to make a U-turn between
intersections and at the intersection of a highway with a lane or
an alley in the Resort Village.
11. WEIGHT RESTRICTIONS
a. No person shall operate a “single axle” vehicle or a
combination of single axle vehicle when combined gross weight
of the vehicle(s) with or without a load exceeds 9,100 kilograms
or 20,020 lbs.
b. Subject to subsection (a) no person shall operate a duel or
tandem axle vehicle or a combination of tandem axle vehicles
when the combined gross weight of the vehicle(s) with or
without a load exceeds 18,000 kilograms or 39,600 lbs on any
highway within the Resort Village.
c. The Council may authorize and issue an overweight permit in
circumstances where it is considered warranted.
d. The provisions of The Police Act and The Highways and
Transportation Act 1997 shall apply to the operators of vehicles
referred to in subsections 10 (a) & (b).
12. VEHICLES ON PUBLIC RESERVES
No person may operate or park a vehicle on any areas except
those designated as parking areas on any Public Reserve within
the Resort Village.
4. SIGNS
1. Council shall cause to be erected and maintained at all stop
streets listed in Appendix 1, at a distance of approximately three
(3) metres from point of intersection, an appropriate sign
containing the word STOP, so placed to face the traffic
approaching the intersection.
2. Council shall cause to be erected and maintained at all yield
streets listed in Appendix 1, at a distance of approximately three
(3) metres from point of intersection, an appropriate sign
containing the word YIELD, so placed to face the traffic
approaching the intersection.
3. Council may, be resolution, provide for the erection and
maintenance on any highway, and at any designation point or
point thereon, such signs as it may deem expedient for warning,
guidance, directions or information or information thereon.
5. IMPOUNDING
1. Any member of the RCMP or other person appointed by Council
may remove or cause to be removed any vehicle that is
unlawfully placed, left or kept on any street or lane, public
parking place or other public place or on municipally owned
property, and to impound and store such vehicle.
2. Where a vehicle has been impounded or stored after it has
been removed under subsection (1), it may be retained at a
place designated by Council for a period of thirty (30) days from
the date of removal unless the cost of removal, impounding and
storage are paid sooner. Upon payment of the full costs, the
vehicle may be released to the owner.
3. If the costs of removal, impounding and storage are not paid
within the period of thirty (30) days as specified in subsection
(2), the Resort Village shall have the right to recover the cost
from the owner of the vehicle by:
(a) legal action in a court of competent jurisdiction;
(b) sale by auction on publication of a notice designating the
time and place of sale at least fourteen (14) days prior to
the sale in a newspaper circulated in the area and on
sending such notice by registered mail to the owner at
the address appearing on the last registration of the
vehicle.
6. PENALTIES
1. Every person who contravenes any provision of this Bylaw is
guilty of an offence and liable on summary conviction to a fine
of not less than $50 and not more than:
(a) $2000 in the case of an individual;
(b) $5000 in the case of a corporation.
2. All fines, penalties and forfeitures mentioned in this Bylaw may
be recovered and enforces with costs by summary conviction
before a judge and, in default of payment, the person convicted
may be imprisoned for a term of not more than ninety (90) days,
unless the fine or penalty is paid sooner.
3. This Bylaw may be enforced, and the contravention of all
provisions of the Bylaw restrained, by any court action brought
by the Resort Village, whether or not any penalty is imposed for
the contravention.
4. Conviction of a person for a contravention of any provision of
this Bylaw does not relieve a person from compliance with the
Bylaw, and the conviction judge or justice of the peace shall, in
addition to any fine imposed, order the person to perform, within
a specified period, any act or work necessary for the proper
observance of the bylaw or to remedy the contravention of the
Bylaw.
5. A person who fails to comply with an order made pursuant to
subsection (4) within the period specified in the order, is guilty of
an offence and liable on summary conviction to a fine of not
more than $250 for each day during which the failure continues,
to imprisonment for a term of not more than ninety (90) days or
to both such fine and imprisonment.
6. In addition to the penalties provided for in this Bylaw where any
person licenced under the provisions of the Bylaw is convicted
of a breach of any of the regulations set forth in this Bylaw, such
person may have his licence suspended or revoked by the
Resort Village in accordance with The Traffic Safety Act.
7. Where any provincial licence is required by law as a condition
precedent to the issuance of a licence under this Bylaw, the
suspension or revocation of the provincial licence by the
provincial authority having jurisdiction, shall result in the
automatic suspension or revocation of any licence issued under
the provisions of this Bylaw for the same period of time during
which the provincial licence is suspended or revoked.
13.
Bylaw No. 7-90 is hereby repealed.
14.
This Bylaw comes into force and effect upon its passage.
