The Commission also processed 61 applications for Extension of Annual License. Fifty-four (54) institutions received their first Annual License and 12 accredited institutions were granted their first LBMA. Additionally, the Commission received 216 applications for Annual License renewal, 25 applications for Extension of Annual License, 50 applications for first Annual License, 166 LBMA annual reviews, and 12 applications for first LBMA that were not completed during this fiscal year because all of the conditions for licensure had not been met. • Fifty-eight (58) new institutional applications for a Provisional License were reviewed and submitted to the Commission during the 2013-2014 fiscal year and these institutions subsequently received a Provisional License. In addition, 72 applications for a Provisional License were reviewed but were not placed on a Commission agenda during this fiscal year because all of the conditions for approval had not been met. Commission staff also reviewed applications from collegiate institutions to create branch campuses. The applications for two branch campuses were reviewed and approved by the Commission and there were no applications for branch campuses that had not been completed during this fiscal year because all of the conditions for approval had not been met. 2 EXECUTIVE SUMMARY....continued • During the 2013-2014 fiscal year, 63 licensed institutions were reported as closed and 20 licensed institutions were approved for a Change of Ownership/Change of Control. At the close of the fiscal year, a total of 23 institutions were still working on fulfilling contingencies in order to have their Change of Ownership/Change of Control approved. • The Commission approved applications for 230 new program offerings and approved 17 modifications to existing programs during this fiscal year. In addition, the Commission’s staff members reviewed 711 new program applications submitted by LBMA institutions. At the close of the fiscal year, there were 129 applications for new programs, 10 modifications to existing programs, and 349 new LBMA programs that were not completed because all of the conditions for approval had not been met. • Four hundred thirty-six (436) degree-granting institutions are under the jurisdiction of the Commission. The total reported enrollment for the degree programs during FY 2012-2013 (the last complete reporting period) was 221,211 with 56,409 reported graduates. Currently, 356 (82%) of these degree-granting institutions are accredited by one or more regional or national accrediting agencies. [NOTE – Some of these 436 institutions offer both non-degree and degree programs] • A total of 582 licensed institutions offer only non-degree programs. The 2012-2013 reported enrollment for all non-degree programs was 65,945, with 38,912 reported graduates. Of these graduates, 28,642 (74%) were placed in jobs, joined the military, or are continuing their education at an institution of higher learning. Currently, 169 (29%) of the licensed, non-degree institutions are accredited by one or more regional or national accrediting agencies. 3 EXECUTIVE SUMMARY....continued • The following chart illustrates the number of degree-granting institutions and non-degree schools licensed by the Commission for Independent Education during the last five fiscal years. Non-degree and Degree-granting Institutions 600 550 500 2009-2010 2010-2011 450 2011-2012 2012-2013 400 2013-2014 350 300 Non-degree Degree-granting Skilled workforce and economic development • The Commission has been sharing institution licensure information with staff members from the Florida Department of Veterans Affairs’ Bureau of State Approving for Veteran’s Training, the Department of State’s Division of Corporations, and the Department of Education’s Office of Student Financial Assistance. These exchanges are part of an ongoing effort by the Commission staff to become more involved with any agency that may have an impact on the Commission and the institutions under its jurisdiction. 4 EXECUTIVE SUMMARY....continued • For the twenty-third year, Commission staff worked with the Florida Education and Training Placement Information Program (FETPIP) to track the placement of graduates of independent nondegree and degree-granting institutions. This fiscal year, 42 nondegree institutions and 98 degree-granting institutions agreed to voluntarily participate in this data collection effort. The participating institutions submitted graduate data via the Commission’s FETPIP Data Collection Web Page. These institutions submitted information on a total of 39,362 students who graduated during the previous fiscal year (2012-2013). This spring, FETPIP attempted to match the student records with employment data in order to verify each graduate’s employment status and occupational industry. A report of this information, aggregated on a program-by-program basis, will be sent in December 2014 to each participating institution. • Commission staff members continue to supply data regarding independent colleges and universities (and their degree-based programs of study) to the Florida Virtual Campus website (http://www.flvc.org). This site supplies an online computer software application that is used by students throughout Florida to plan for, and to monitor the progress of, their postsecondary education at participating Florida institutions. • The Commission annually supplies information about all licensed degree-granting institutions to the Department of Education for listing in the Florida Counseling for Future Education Handbook. • The Commission has submitted data concerning licensed institutions and the programs they offer to the Department for Economic Opportunity. These data are to be included in the Eligible Training Provider List (ETPL). The ETPL is used by Regional Workforce Development Boards to determine which institutions offer training programs that lead to the occupations that are contained within each Regional Demand Occupations List. 5 EXECUTIVE SUMMARY....continued • Commission staff members work with the DOE’s Community College and Technical Center MIS staff to continuously update the common set of Classification of Instructional Programs (CIP) codes used by Florida’s public and nonpublic postsecondary education sectors. This taxonomy allows programmatic offerings from both the public and private vocational education sectors to share common CIP codes and CIP titles, where possible, and to have distinct CIP codes and CIP titles when necessary. In addition, each of these programs is “linked” to an occupational outcome using the codes found in the Standard Occupational Classification Manual. These linkages are used by the Department of Economic Opportunity and the Regional Workforce Development Boards to identify which institutions offer training programs that lead to occupations included on each Regional Demand Occupations List. • The Commission staff has been meeting with staff members from the state agencies that are responsible for the licensure of individuals who enter certain professions. Since institutions under the Commission’s jurisdiction offer many of these programs of study, the Commission continues to exchange data with these other agencies in an attempt to develop uniformity between the standards that govern the licensing of institutions, the regulations for licensing professionals, and the rules governing the practice of a profession. Some of these regulatory groups are: The Florida Department of Health’s Board of Acupuncture, Board of Massage Therapy, Board of Nursing, Board of Dentistry, Board of Pharmacy, the Bureau of Emergency Medical Services, the Florida Council of Licensed Midwifery, and the Electrolysis Council; the Department of Business and Professional Regulation’s Board of Cosmetology; the Department of State’s Bureau of Licensing; and the Department of Transportation. 6 EXECUTIVE SUMMARY....continued Quality efficient services Records All applications, forms, correspondence, and other materials submitted to the Commission are considered public record under the Public Records Law. These documents are available to the public at the Commission office located at 325 West Gaines Street, Suite 1414, Tallahassee, Florida 32399-0400. The retention schedule for these records is three (3) years. In addition, student records from closed institutions are permanently stored (in electronic form) at the Commission’s office. Annual Report Section 1005.22, Florida Statutes, requires the Commission for Independent Education to prepare an Annual Report of its activities. This report is sent to the Commissioner of Education for submission to the State Board of Education. Additional copies are submitted to the Governor, the Speaker of the House of Representatives, the President of the Senate, the Minority Leader of the Senate, and the Minority Leader of the House of Representatives. Meetings The Commission meets bimonthly, usually in the months of January, March, May, July, September, and November. All meetings of the Commission, and any of its committees, are open to the public. Advance notice of these meetings is always given through the Florida Administrative Weekly. The Commission maintains official minutes of its proceedings, an audio tape recording of every meeting, and has a video record of the meetings that are webcast. 7 EXECUTIVE SUMMARY....continued Each Commission member receives the meeting agenda before each meeting as an automated document (on CD). The CD contains “links” to images of all of the documentation pertaining to each agenda item. This “automated agenda” also allows each Commission member to enter comments, for future reference, directly onto their copy of the electronic document. The Commission conducted the first webcast of a Commission Meeting in March 2005. The Commission has now webcast all of the regular meetings since the beginning of the 2006-2007 fiscal year and is planning to continue to webcast all of the Commission meetings during the 2014-2015 fiscal year. Institutional Database In accordance with section 1005.22(1)(i), Florida Statutes, the Commission shall serve as the central agency for the collection and distribution of current information regarding the institutions under its jurisdiction. These data may include, but are not limited to, information such as: the institution’s administration; the length of all programs; student costs; student enrollment; number of graduates and graduate placement (in accordance with section 6E-2.004(10)(e), Florida Administrative Code); student demographics; the date of licensure and next annual license renewal; and the institution’s street address and phone number. Other information is collected in response to specific needs or inquiries. All of these data have been incorporated into the Commission’s Information Management System (CIMS). The design elements of the CIMS have now expanded to include all the various “systems” that the Commission uses to manage and present information. These systems include the Commission’s database, website (www.fldoe.org/cie/), and automated agenda. In addition the Commission employs automated e-mail messaging (including videos), electronic presentations (i.e. PowerPoint), and the coordinated development of office processes and procedures to support the automated data management system. 8 EXECUTIVE SUMMARY....continued On-site Visitations The CIMS continues to be used to schedule all of the Commission’s on-site visits to licensed institutions. As on-site visits are requested by the Commission, an interface with the Google Earth software application is used to locate any other licensed institutions in the selected area. The requisite information for all institutions that are selected for an on-site visit is then transmitted, via the Internet, to the Commission’s Institution Evaluators in the field. Commission for Independent Education’s staff members conducted 644 on-site visitations to schools, colleges, and universities under the Commission’s jurisdiction during the 2013-2014 fiscal year. These visits were carried out to evaluate an institution in terms of physical facilities, student records and student record storage, on-site equipment and supplies, instructional and administrative personnel, the institution’s catalog and student contract, class schedules, academic programs, tuition charges, placement and counseling services, agents’ licenses, faculty qualifications, and advertising policies. Consumer Services Commission staff members received over 1,000 calls per month on the toll-free phone line from individuals seeking information about nonpublic postsecondary educational institutions in Florida. The Commission investigates complaints about institutions under its authority in order to ascertain whether or not legitimate deficiencies exist. All allegations that are received by the Commission concerning any of these issues are referred to the Consumer and Compliance Services Section in order to ascertain if there has been a violation of the Commission Rules or of pertinent sections of the Florida Statutes. 9 EXECUTIVE SUMMARY....continued During the 2013-2014 fiscal year, 341 consumer complaints were received in the Commission’s office. These complaints can be grouped in the following areas: 5 - institutional advertising; 91 academic matters; 37 - tuition, refunds and other costs; and 168 personal problems. 2013-2014 Complaints Tuition Academic Personal Advertising The Commission also sent 36 Letters of Noncompliance to entities that appeared to be operating a school or college without a license. Each organization that is contacted is expected to cease the cited activity, and to apply for and obtain a Provisional License from the Commission, if it cannot show that its activities legitimately fall outside the Commission’s jurisdiction. 10 EXECUTIVE SUMMARY....continued Annual Budget An annual budget must be approved by the Commission and submitted to the Legislature by the Florida Department of Education. The budget allocation was $3,875,390.00 for the 2013-2014 fiscal year. At the time of publication, $3,648,044.87 has been received from all of these revenue sources and was deposited into the Institutional Assessment Trust Fund. As part of the total revenue collected, there was also $233,176.48 received in Student Protection fees, from the non-degree schools, which was deposited into the Student Protection Trust Fund. One way the Commission accomplishes this is through the examination of each non-degree or degree-granting institution’s application for a first Annual License or a renewal of Annual License. These reviews monitor information pertaining to any changes in the program offerings and curriculum, cost of tuition, institutional policies, institutional administration, institutional ownership and control, administrative staff, and instructional personnel. These schools, colleges and universities provide annual information that pertains to enrollment, withdrawals, and graduates for each program of study. Licensed institutions also supply statistical data on the composition of the student population. Any licensed school that offers non-degree programs is required to submit Student Protection Fund fees. In addition, Commission staff members annually review any financial documents that are required, the applicable contracts/enrollment agreements, and the institutional catalogs. Two hundred eight-nine (289) non-degree schools and degreegranting colleges and universities completed a review of Annual License during the 2013-2014 fiscal year. There were also 54 institutions that received their first Annual License during this time period. Two hundred sixteen (216) reviews of Annual License and 50 applications for first Annual License were received but were not completed during this fiscal year due to deficiencies in the institution’s submission. Those institutions, which are accredited by accrediting agencies that have been approved by the Commission, are granted licenses which are valid for the same period as their current grant of accreditation. In the first year of the approval of their LBMA application by the Commission, these institutions are granted the Licensure by Means of Accreditation status. In order to maintain LBMA licensure status for each remaining year of their grant of accreditation, these institutions must submit an LBMA application for annual review to the Commission for Independent Education. In 2013-2014, 12 institutions were granted their first LBMA credential. These student records are optically scanned and placed on the DOE network’s hard drives for permanent storage. Those records are then maintained for the future servicing of student records requests. During this fiscal year, 47,358 student records that were retained by the Commission as hard copies have been transferred to electronic storage media (there are now approximately 2,150,000 images stored by the Commission). The Commission staff also sent out 1610 sets of images of these documents to the students from these closed institutions who requested copies of their academic records. Detailed information about each of these laws can be found at the legislature’s website (www.leg.state.fl.us). ● SB 524 - Relating to Sexually Violent Predators BRIEF SUMMARY Amends section 1005.10, Florida Statutes, to require that an institution licensed by the Commission for Independent Education must inform students and employees at orientation and on its website of the existence of the Department of Law Enforcement’s sexual predator and sexual offender registry website as well as the toll-free telephone number that gives access to sexual predator and sexual offender public information. Section 1005.10, Florida Statutes, is created to read: 1005.10 Sexual predator and sexual offender notification; nonpublic colleges, universities, and schools. -Each nonpublic college, university, and school shall inform students and employees at orientation and on its website of the existence of the Department of Law Enforcement sexual predator and sexual offender registry website and the toll-free telephone number that gives access to sexual predator and sexual offender public information pursuant to s. 943.043.” EFFECTIVE DATE July 1, 2014 97 2014 LEGISLATIVE SUMMARY.…continued ● SB 1036 - Relating to Nursing Education Programs BRIEF SUMMARY This legislation requires the staff of the Commission for Independent Education to monitor the implementation of the numerous sections of this law. The new legal requirements that affect licensed institutions include, but are not limited to, the following: ● Mandating an examination prep course that must be completed by graduates of approved programs that do not take the National Council Licensure Examination (NCLEX) within 6 months of graduation; ● Requiring that all clinical training must occur in the United States, its possessions or territories; ● Allowing institutions to increase the use of simulations in clinical training up to 50%; ● Stating that students transferring from an approved program, at an institution that is under the Commission for Independent Education, which has been terminated by the Board of Nursing shall not have their NCLEX scores included in the pass rate of the institution that accepts the transfer of these students; and ● Mandating that all nursing education programs must be accredited (in accordance with section 464.003, Florida Statutes) by July 1, 2019 or within five years after first enrolling students. Subsection (4) is added to section 464.008, 61 Florida Statutes, to read: 464.008 Licensure by examination. – 98 2014 LEGISLATIVE SUMMARY.…continued (4) If an applicant who graduates from an approved program does not take the licensure examination within 6 months after graduation, he or she must enroll in and successfully complete a board-approved licensure examination preparatory course. The applicant is responsible for all costs associated with the course and may not use state or federal financial aid for such costs. Section 464.019, Florida Statutes, is amended to read: 464.019 Approval of nursing education programs.(1)PROGRAM APPLICATION APPLICATIONS.-…. (b) The program’s nursing major curriculum consists of at least: 1. Fifty percent clinical training in the United States, the District of Columbia, or a possession or territory of the United States for a practical nursing education program, an associate degree professional nursing education program, or a professional diploma nursing education program. 2. Forty percent clinical training in the United States, the District of Columbia, or a possession or territory of the United States for a bachelor’s degree professional nursing education program. (c) No more than 50 25 percent of the program’s clinical training consists of clinical simulation…. (5) (6) ACCOUNTABILITY.-…. (d) If students from a program that is terminated pursuant to this subsection transfer to an approved or an accredited program under the direction of the Commission for Independent Education, the board shall recalculate the passage rates of the programs receiving the transferring students, excluding the test scores of those students transferring more than 12 credits.…. 99 2014 LEGISLATIVE SUMMARY.…continued (11) ACCREDITATION REQUIRED.(a) A nursing education program that prepares students for the practice of professional nursing, that was approved under this section before July 1, 2014, and that enrolled students before July 1, 2014, must become an accredited program by July 1, 2019. (b) A nursing education program that prepares students for the practice of professional nursing and that was approved under this section before July 1, 2014, but did not enroll students before that date, must become an accredited program within 5 years after the date of enrolling the program’s first students. (c) A nursing education program that prepares students for the practice of professional nursing and that is approved under this section after June 30, 2014, must become an accredited program within 5 years after the date of enrolling the program’s first students. (d) This subsection does not apply to a nursing education program provided by an institution that is exempt from licensure by the Commission for Independent Education under s. 1005.06(1)(e).” EFFECTIVE DATE July 1, 2014 ● HB 7015 - Relating to Military and Veteran Support BRIEF SUMMARY This legislation expands the “Educational Dollars for Duty” program, which supplies student financial assistance for members of the Florida National Guard, to include all institutions licensed by the Commission for Independent Education. Subsections (7) and (8) of section 250.10, 95 Florida Statutes, are amended to read: 250.10 Appointment and duties of the Adjutant General.(7) The Adjutant General shall develop an education assistance program for members in good standing of the Florida National Guard who enroll in an authorized course of study at a public or nonpublic postsecondary institution or technical center of higher learning in the state which has been accredited by an accrediting body recognized by the United States Department of Education or licensed by the Commission for Independent Education. Education assistance also may be used for training to obtain industry certifications approved by the Department of Education pursuant to s. 1008.44 and continuing education to maintain license certifications. An Informal Hearing was requested by the school and was held at the March 27, 2014 Commission Meeting. A Motion for a Final Order was approved at that meeting and was issued to the school. This institution has been ordered to conduct an orderly closure Green Cross School of Nursing (#3955) - At the November 2013 Commission Meeting the Commission issued a Notice of Intent to Deny alleging that the school was in violation of Chapter 1005, Florida Statutes and/or Chapter 6E, Florida Administrative Code.
