Effective Date: 28 August 2013 Page 1 of 2 Notes for Guidance This statutory declaration (Application to Transfer) is required to satisfy the requirements of; • • • NT Uncollected Goods Act NT Motor Vehicles Act NT Stamp Duty Act This statutory declaration (Application to Transfer) must be completed and presented to MVR accompanied Form R33 – Receipt under the Uncollected Goods Act or by a receipt that satisfies the requirements of Section 30 of the NT Uncollected Goods Act within 14 days of sale. Penalties under the Motor Vehicles Act may apply. MVR Form R33 has been developed to satisfy this requirement. Stamp Duty is $3 per $100, or part thereof or in any case the market value of the vehicle. For further details on exemptions, refer to the brochures available at MVR. A registration Transfer fee may also be applicable before this Application to Transfer will be approved. The transfer of registration will not be processed if the receipt is not presented with this statutory declaration. Penalties under the Motor Vehicles Act may apply. Registered owners/operators should be aware that in circumstances where only an offending vehicle is identified by red light or speed camera; any Traffic Infringement Notices will be sent to the registered owner/operator of that vehicle. Where a vehicle has joint (or multiple) owners the infringement notice is sent to the first person (or body corporate) named on the registration certificate; or the registered operator where nominated. Warning Persons who by false statement or misrepresentation, obtain or attempt to obtain registration or renewal of registration or transfer of a motor vehicle, are liable to a fine not exceeding 15 Penalty Units for an Individual (85 Penalty Units for a Company) or imprisonment for 6 months under the Motor Vehicles Act. Under section 59 of the NT Stamp Duty Act, persons who falsely declare the sale price and or the market value of a vehicle are liable to a penalty not exceeding 50 Penalty Units. A Penalty not exceeding 200 Penalty Units or imprisonment for 2 years may apply under the Oaths, Affidavits and Declarations Act for making a false or misleading statement in a statutory declaration. The Courts Decide Ownership Disputes Before buying, satisfy yourself that there are no outstanding loans (Encumbrance) on the vehicle and that the seller has the right to sell the vehicle, especially if it is registered in a business name. To transfer, you must first establish your identity and residency (if non-resident, please contact MVR). An NT driver licence will provide this evidence. If you send someone to MVR to transfer the registration on your behalf, that person must have your written authorisation and be able to prove their identity. Privacy Statement The Registrar of Motor Vehicles is required to collect information for Registrations, Licenses and Permits under section 92 of the NT Motor Vehicles Act.
