ADR PROCESS FLOW CHART State of Georgia Superior Courts of the Southern Judicial Circuit Alternative Dispute Resolution Program COMPLAINT FILED W/CLERK ADR REVIEWS CASE ELIGIBLE FOR ADR Non-exempt civil or domestic relation cases that are still pending after 150 calendar days after the original complaint is filed shall be referred to ADR Parties select neutral and schedule session within 15 days Rescheduling requires consent from opposing party & will take place within 30 days of previously scheduled session. ADR shall be completed within 30 days of the first ADR session 10 days for objections or notice of settlement Referral Order Signed By Judge Filed w/Clerk & Distributed Parties Inform ADR Program that session is scheduled within timelines ADR REVIEWS CASE NOT ELIGIBLE FOR ADR Initial session must be scheduled within 15 days after filing referral order Cases Exempt from ADR: Question of law only Appeal from rulings of admin agencies In Rem Condemnation Parties do not inform ADR Program that session is scheduled within timelines Indigent status application must be received by ADR Program within 5 days of scheduled session Party(s) elected ADR before filing or before referral order filed Settlement No Settlement Habeas Corpus and extraordinary writ Declaratory Judgment ADR Program selects neutral and schedules session within 30 days Potential for Violence URESA Actions ADR Session Scheduled Only Partial Settlement Reached Continuance Requested No Settlement Reached Other Good Cause Settlement Reached Parties will inform ADR Program Parties must file agreement reached w/Clerk & copy ADR Program The ADR Program will refer the case back to the Clerks’ civil docket ADR Informs Judge, Clerk & Parties of Non-Eligibility for Program Standard Civil Rules Apply
