Action Requested: Acknowledgement of Commissioner Archer's signature to
participate in Outreach, Prevention and Early Intervention Services program
funding for the Shawnee County Health Agency (SCHA) through the Kansas
Department of Health and Environment (KDHE).
SCHA programs operating under the Outreach, Prevention and Early Intervention
Services program funding are Bright Beginnings Healthy Futures-Nurse Family
Partnership and Kansas Children's Service League's Healthy Families.
In order to receive funding from KDHE, SCHA must provide match dollars in the
amount of $175,000, which will be paid from the Early Childhood Block Grant. There is
no cost to Shawnee County.

PETITION FOR FORECLOSURE OF MORTGAGE
COMES NOW, Plaintiff, Wells Fargo Bank, National Association, and for its cause of
action against the Defendants states as follows:
1. Plaintiff is a corporation duly organized and existing by virtue of law.
2. Venue is proper in this District by way of the subject matter, i.e., the foreclosure of a
mortgage on certain real estate located in the County of Shawnee, State of Kansas.
3. On or about December 14, 2004, Dale E Miller (Deceased), [hereinafter "Borrower(s)"]
borrowed money from, executed and delivered to Wells Fargo Bank, National Association, a
Note, payable in monthly installments, in the original principal sum of $174,500.00, together
with interest as stated. A true and correct copy of the Note is attached and incorporated by
reference as if fully set forth as Exhibit 1.
4. As a part of the loan transaction and in order to secure payment of the Note, Borrower(s)
and Nellie R Miller executed and delivered to Wells Fargo Bank, National Association, a
Mortgage of the same date upon the following described real estate:

The department has contracted with Westlaw since 2011 to provide two computer terminals that
are linked directly to their database, allowing inmates to schedule time to conduct research as
they need, pursuant to the Constitutional requirement to provide inmates access to the courts.
The previous agreement, executed on March 3, 2011, called for a 36-month service at successive
annual increases of 5%. This agreement maintains the same terms for the next three years,
beginning on April1, 2014.
The County Counselor's office has approved this service agreement as to legality and form. The
cost of the service agreement would begin at $486.21 a month that will be paid for from the
inmate wellness account (JL213000000) and will not come from the department's detention
fund or any other County tax dollars.

General Provisions for Non Government Subscribers Only. This Order Notification is subject to approval by West, a Thomson Reuters business
(West)in St Paul, Minnesota, and is governed by Minnesota law. The state and federal courts sitting in Minnesota wilt have exclusive jurisdiction over any
claim arising from or related to this agreement Applicable sates, use, personal property, value added tax (VAT) or equivalent, ad valorem and other taxes are
payable by Subacriber. Subacriber may be charged interest for overdue installments and subscriptions and for other open account chargea. If any
installments, subscriptions, subscription services, Westlaw Charges or open account charges remain unpaid 30 days after becoming due, all unmatured
installments, including all amounts that are or would become due and payable for the remaining term of Subscriber's Subscriber Agreement, shall become
immediately due and payable at the sole option of West. Interest charged may be adjusted to the then-highest current rate aRowable on Minnesota contracts.
This Order Notification may not be assigned sublicensed or otherwise transferred without West's prior written consent. All coftection fees, including but not
limited to attorneys fees, are payable by Subscriber. Transportation and handling (FOB origin) charges will be added for print products. West may request a
current financial statement and/or obtain consumer credit report on the undersigned individual to determine creditworthiness. West will only request
consumer credit information on the undersigned if the undersigned is applying for credit as an individual or if the undersigned's consumer credit information is
necessary for West to consider granting credit to the aforementioned company. If Subscriber inquirea whether a credit report was requested, West wUI
provide information of such, if a report was received and the name, address and telephone number of the agency that supplied the report. Usage Cap for

APPROPRIATION. Shawnee County is subject to the Kansas Cash
Basis Law, K.S.A. 10·1101 et seq. U: in the judgment of the Financial
Administrator, Audit-Finance Office, sufficient funds are not
appropriated to continue the function performed in this agreement and
for the payment of the charges hereunder, County may terminate this
agreement at the end of its current fiscal year. County agrees to give
written notice of termination to contractor at least thirty (30) days prior
to the end of its current fiscal year. In the event this agreement is
terminated pursuant to this paragraph, County will pay to the contractor
all regular contractual payments incurred through the end of such fiscal
year. The termination of the contract pursuant to this paragraph shall
not cause any penalty to be charged to the County or the contractor.
DISCJ.AJMER OF LIABILITY. Neither the County of Shawnee nor any
department thereof shall hold harmless or indemnifY any contractor for
any liability whatsoever.
ANTJ·DISCBJMINATJON CL4USE. The contractor agrees: (a) to comply
with the Kansas Act Against Discrimination (K.S.A. 44-1001 Ill seq.)

discriminate against any person because of race, religion, color, sex,

include in all solicitations or advertisements for employees, the phrase
"equal opportunity employer"; (c) to comply with the reporting
requirements set out in K.S.A. 44-1031 and K.SA 44-1116; (d) to
include those provisions in every subcontract or purchase order so that
they are binding upon such subcontractor or vendor; (e) that a failure to
comply with the reporting requirements of (c) above or if the contractor
is found guilty of any violation of such acts by the Kansas Human
Rights Commission, such violation shall constitute a breach of contract;
(f) If the contracting agency determines that the contractor has violated
applicable provisions of ADA, that violation shall constitute a breach of
contract; (g) if (e) or (f) occurs, the contract may be cancelled,
terminated or suspended in whole or in part by the County.
Parties to this contract understand that subsections (b) through (e) of

fewer than four employees or whose contract with the County totals
$5,000 or less during this fiscal year.

Request for Approval of Second Amendment to Master Services Agreement
with Securus Technologies, Inc.

On June 7, 2012 the County approved an agreement with Securus Technologies, Inc. (Securus) to
provide inmate telephone services for the Department of Corrections. Pursuant to that agreement, the
county was provided a commission on all calls made by the inmates, both intrastate and interstate.
In August 2013, the Federal Communications Commission (FCC) handed down a ruling that expressly
prohibited governmental entities from receiving commissions on interstate inmate telephone calls, and
providing a cap on the per-minute costs that can be charged for these calls. The implementation of the
ruling was delayed pending some short term appeals processes that Securus and other entities initiated.
While there are continuing court challenges to the FCC ruling, it has gone into effect for the time ·
being, and we are therefore bound by the terms of the ruling.

The attached agreement alters the agreement we have with Securus to the degree required by the
implementation of the FCC ruling. The impact of this ruling and subsequent agreement adjustment is
a commission reduction of approximately $1,870.00 monthly, based on the interstate call volume
experienced since Securus assumed control over inmate phone service in August 2012. If the ruling is
successfully challenged, we will put forth an another amendment re-implementing the original
commission terms for interstate calls.
Accordingly, I am requesting your approval of this second amendment to the agreement with Securus.

This SECOND AMENDMENT ("First Amendment") is effective as of February 11, 2014 ("Second Amendment
Effective Date") and amends and supplements that certain Master Services Agreement by and between Shawnee

WHEREAS, in accordance with Federal Communications Commission 47 CFR Part 64 [WC Docket No. 12-375; FCC
13-113]- Rates for Interstate Calling Services ("FCC Order"), effective February 11, 2014, Provider and Customer
agree to modify the calling rates charged under the current Agreement;
NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as
follows:
1. Effective February 11, 2014, the Calling Rates Table set forth in the Schedule to the Agreement shall be
modified to reflect that the interstate call rates shall not exceed the rate caps set forth in the FCC Order.
2. Notwithstanding anything to the contrary contained in the Agreement, in accordance with Federal
Communications Commission 47 CFR Part 64 [WC Docket No. 12-375; FCC 13-113]- Rates for Interstate
Calling Services- effective February 11, 2014, no commission shall be paid on revenues earned through the
completion of interstate calls of any type received from the Agreement.
3. Except as expressly amended by this Second Amendment, all of the terms, conditions and provisions of the
Agreement shall remain in full force and effect.

CONTRACTUAL PROVISIONS ATTACHMENT
The undersigned parties agree that the following provisions are hereby
incorporated into the contract to which it is attached and made a part thereof;

TERMS HEREIN CONTROLLING PROVISIONS. It is expressly agreed
that the terms of each and every provision in this attachment shall
prevail and control over the terms of any other conflicting provision in
any other document relating to and a part of the contract in which this
attachment is incorporated.

AGREEMENT WITH KANSAS LAW. It is agreed by and between the
undersigned that all disputes and matters whatsoever arising under, in
connection with or incident to this contract shall be litigated, if at all, in
and before a Court located in the State of Kansas, U.S.A, to the
exclusion of the Courts of any other states or country. All contractual
agreements shall be subject to, governed by, and construed according to
the laws of the State of Kansas.

TERMINATION
DUE
TO
LACK
OF
FUNDING
APPROPRIATION. Shawnee County is subject to the Kansas Cash
Basis Law, K.S.A. 10-1101 et seq. If, in the judgment of the Financial
Administrator, Audit-Finance Office, sufficient funds are not
appropriated to continue the function performed in this agreement and
for the payment of the charges hereunder, County may terminate this
agreement at the end of its current fiscal year. County agrees to give
written notice of termination to contractor at least thirty (30) days prior
to the end of its current fiscal year. In the event this agreement is
terminated pursuant to this paragraph, County will pay to the contractor
all regular contractual payments incurred through the end of such fiscal
year. The termination of the contract pursuant to this paragraph shall
not cause any penalty to be charged to the County or the contractor.
DISCLAIMER OF LIABILITY. Neither the County of Shawnee nor any
department thereof shall hold harmless or indemnity any contractor for
any liability whatsoever.
ANTI-DISCRIMINATION CLAUSE. The contractor agrees: (a) to comply
with the Kansas Act Against Discrimination (K.S.A. 44-1001 et seq.)
and the Kansas Age Discrimination in Employment Act, (KS.A. 441111 et seq.) and the applicable provisions of the Americans With
Disabilities Act (42 U.S.C. 12101 et seq.) [ADA] and to not
discriminate against any person because of race, religion, color, sex,
disability, national origin or ancestry, or age in the admission of access
to or treatment or employment in, its programs or activities; (b) to
include in all solicitations or advertisements for employees, the phrase
"equal opportunity employer"; (c) to comply with the reporting
requirements set out in K.S.A. 44-1031 and K.S.A. 44-1116; (d) to
include those provisions in every subcontract or purchase order so that
they are binding upon such subcontractor or vendor, (e) that a failure to
comply with the reporting requirements of (c) above or if the contractor
is found guilty of any violation of such acts by the Kansas Human
Rights Commission, such violation shall constitute a breach of contract;
(f) if the contracting agency detennines that the contractor has violated
applicable provisions of ADA, that violation shall constitute a breach of
contract; (g) if (e) or (f) occurs, the contract may be cancelled,
terminated or suspended in whole or in part by the County.
Parties to this contract understand that subsections (b) through (e) of
this paragraph number 5 are not applicable to a contractor who employs
fewer than four employees or whose contract with the County totals
$5,000 or less during this fiscal year.
6.
ACCEPTANCE OF CONTRACf. This contract shall not be considered
accepted, approved or otherwise effective until the required approvals
and certifications have been given and this is signed by the Board of
County Commissioners of the County of Shawnee, Kansas.
7.
ARBITRATION, DAMAGES, WARRANTIES.
Notwithstanding any
language to the contrary, no interpretation shall be allowed to find the
County has agreed to binding arbitration, or the payment of damages or
penalties upon the occurrence of a contingency. Further, the County
shall not agree to pay attorney fees and late payment charges; and no
provisions will be given effect which attempts to exclude, modifY,
disclaim or otherwise attempt to limit implied warranties of
merchantability and fitness for a particular purpose.
8.
REPRESENTATIVE'S AUTHORITY To CONTRACT. By signing this
document, the representative of the contractor thereby represents that
such person is duly authorized by the contractor to execute this
document on behalf of the contractor and that the contractor agrees to be
bound by the provisions thereof.
9.
RESPONSffiiLITY FOR TAXES. The County shall not be responsible for,
nor indemnity a contractor for, any federal, state or local taxes which
may be imposed or levied upon the subject matter of this contract.
10.
INSURANCE. The County shall not be required to purchase, any
insurance against loss or damage to any personal property to which this
contract relates, nor shall this contract require the County to establish a
"self-insurance" fund to protect against any such loss or damage.
Subject to the provisions of the Kansas Tort Claims Act (K.S.A. 756101 et seq.), the vendor or lessor shall bear the risk of any loss or
damage to any personal property to which vendor or lessor holds title.

Board of Commissioners approval is requested to award bids for pool chemicals for the operation
of aquatic facilities for the 2014 season.
On February 6, 2014, the Board of Commissioners gave approval for the Parks & Recreation

nearly $2 million in revenue. The estimated expenditure for these items is expected to be

facilities intermittent employees will be hired and trained to provide these services. There are
sufficient funds available in the Parks & Recreation Budget for this request.

the software used in maintaining and updating the parcel data that is the fotmdation upon which our
geographic information system (GIS) is built.
Traditionally, this has been paid for with Land Records Committee funding. However, because those
funds are being utilized for other purposes, that source is not being considered for this payment. There are
sufficient funds in the Appraiser's budget.
