How Does the Troy Anthony Davis Case Impact Georgia?
The case of Georgia death row inmate Troy Anthony Davis is as simple as it is complex and this story is almost like a Greek Tragedy. This story is of lies, deception, families, life, death, torture, murder and the many faces of injustices in the South. The case begins with the murder of an off-duty policeman, Officer Mark Allen MacPhail in 1989 in Savannah,
Georgia and the man on death row for his murder Troy Anthony Davis. Troy Davis has always maintained his innocence and this story has gained, local, state, national and international attention. The case of Troy Anthony Davis has people from all over the world looking at Georgia and this report will tell you why.
The case of Troy Anthony Davis is a case of a young man at the age of 19 that was accused and convicted and sentenced to death for the killing of a white police officer in Savannah,
Georgia in 1989. The shooting took place after a fight that did not involve Troy Davis.
Troy Davis and some friends were playing pool late one night when a man, we will call Mr.
X began to argue with a homeless man over a can of beer. The homeless man was later pistol whipped by Mr. X with a 38 caliber weapon the same type of gun the policeman was killed with. Troy and a 16 year old man tried to stop this attack and were threatened to stay out of the fight, so they ran away from the scene. Officer MacPhail came out to see what the problem was and according witnesses, Mr. X then shot at the policeman and he was killed. According to sworn testimony Mr. X ran away, threw away his gun, changed his clothing and showed up at the police station several hours later with a lawyer and he pointed the finger at Troy Davis. Troy was accused and convicted based on the testimony of 9 eyewitnesses many of whom were interrogated without parents or a lawyer and some with past criminal history. There was no gun, no physical evidence and no motive for Troy to commit this crime. Years later 7 of the 9 witnesses say they lied because they were forced by the police to say Troy Davis did it. The witnesses one by one began to tell the truth that
Troy Davis was not the shooter, when asked what happened and why did they lie, they all had the same story, even though none of them knew each other. They changed their testimonies due to threats by the police, they were scared, threatened with jail and prison time, refused medical treatment and one witness could not even read or write and signed a statement against Troy.
In 1991 Troy Anthony Davis was sentenced to die by electrocution by the State of Georgia.
Once on death row from 1991-1996, Troy had no lawyer assigned to his case and this was a critical time in his appeals process. In the state of Georgia you do not have to have a lawyer for post-conviction appeals, which is very bad for people who are innocent. Funding to help death row inmates was cut and there was 1 lawyer trying to help more than 80 people on death row in Georgia.
In 1996 President Bill Clinton signed into law The Anti-terrorism and Effective Death
Penalty Act which limits appeals and basically says you only have two years to bring forth

proof of innocence after your conviction. Then President Clinton made the law retroactive to 1986, this means the law would affect people convicted 10 years before the law was even passed and therefore Troy’s case was already passed the time limit.
The witnesses that testified against Troy Davis began coming forward 4 years after Troy’s conviction and then the courts said it is too late to listen to this new evidence. The problem is that the U.S. Supreme Court says it is not unconstitutional to execute and innocent person if the state believes you got a fair trial in the beginning.
In 2003 one of the largest law firms in the United States Arnold & Porter in Washington,
D.C. began to represent Troy because they believe he is innocent. In 2005 they asked the
11 th
Circuit Court of Appeals in Atlanta Georgia to grant Troy Davis a new trial based on all the statements from witnesses that say he is not the shooter and that other witnesses have also come forward and said they saw the murder and that Mr. X is the killer of the policeman.
In February 2007 the largest Human Rights Organization in the world Amnesty
International wrote a 35 page investigative report called, “Where is the Justice for Me”, this report detailed the facts of the Troy Davis case and why a terrible injustice would take place if this man is executed by the State of Georgia. In April 2007 the 11 th
circuit Court of
Appeals said they did not have to look at actual innocence because of a procedural error that stated the old lawyers filed paperwork too late, so they could still proceed with the execution even though no court has listened to the claim of innocence or heard the witnesses recantations.
People from around the world were already talking about this case and asking questions, “ how can you kill a man with no physical evidence, no gun and with almost all of the witnesses used to convict him, recanting their statements.”
In June 2007 the United States Supreme Court did not select the case for their summer review and an execution date was set for July 17 th
at 7pm by Lethal Injection. The State of
Georgia still wanted to kill Troy Anthony Davis even though they had proof that he could be innocent. July 16, 2007, Troy’s lawyers and witnesses went before the Georgia Parole
Board, the last hope to save Troy from execution. This was the longest parole board hearing in Georgia’s history more that 10 hours long and the more than 50,000 letters and faxes from around the world, asking for his life to be spared. These letters came from people who were both for and against the death penalty. The Georgia Parole Board decided there was so much evidence and they needed more time so they granted Troy a 90-day stay of execution and another Parole Board Hearing was scheduled.
Before the next parole board hearing could take place, August 3, 2007, the Georgia
Supreme Court with a 4 to 3 decision said they would listen to oral arguments and decide whether the lower courts should have given Troy Davis a new trial. Since February 2007

there has been hundreds of stories about Troy Anthony Davis, blogs, TV news, radio programs, national magazines, international magazines, newspaper articles, websites, videos, and even songs written for Troy.
National lawmakers, international and national people speaking out on his behalf, lawyers, law schools and human rights groups asking questions about justice in Georgia. This case has state and national lawmakers thinking about changing laws to protect innocent people.
There has been an Eyewitness Identification Study going on in Georgia, citing Troy’s case.
The 1996 Anti-terrorism and Effective Death Penalty Act, references Troy’s case in
Wikipedia. Troy’s case has been written about in law journals and even in a book about death row families. The state of Georgia has a long history with the death penalty and because of racial bias and unfairness the death penalty was stopped in 1972 based on the
Furman versus Georgia case. In 1976 another Georgia case Gregg versus Georgia was a reason the death penalty was brought back.
37 years later the State of Georgia is under the microscope again because of the Troy
Anthony Davis case, a man convicted and sentenced to death with hatred, racism, lies , no weapon and no physical evidence can still be killed.
There have been more than 120 people exonerated from death row, that means they were found to be innocent on death row, 5 from the state of Georgia and two of them from
Savannah, Georgia. Eyewitness testimony has sent thousands of innocent people to prison and with the help of DNA some of them are being free. In the Troy Davis case there is no
DNA because he was not involved, so his witnesses are his DNA and they have come forward and said they lied.
Presently the Georgia Legislature because of the Southern Center for Human Rights,
Georgia Innocence Project and others are considering changing the ways police interrogate and obtain information from eyewitnesses because of cases like Troy Anthony Davis.
Presently there are no guidelines or standards.
On November 13 th
the lawyers representing Troy Davis and hundreds of supporters from around the county, representing more than 20 human rights organizations argued before the Georgia Supreme Court in Atlanta, Georgia, demanding the court grant Troy Davis a new trial based on all the evidence, that has never been heard before a jury in a court of law. Now it is up to the Georgia Supreme Court they have 6 months from November 13,
2007 to say whether Troy Anthony Davis will get a new trial or whether the state of
Georgia will try to execute and innocent man again.
Since Troy’s case has garnered world attention there is a Eyewitness Identification Study in Georgia, the Atlanta Journal Constitution and other large newspapers in Georgia have asked for abolition of the death penalty in Georgia, the state lawmakers are being challenged to get involved. The governor has received letters from the Pope and Bishop

Desmond Tutu and hundreds of other prominent people. U.s Congressman John Lewis,
Reverend Al Sharpton, Marc Morial, Dr. Joseph Lowery, Jessie Jackson and others have spoken out publically against this injustice and are asking for a new trial. Many people are talking about new legislation to abolish the death penalty, end racism in the South, police misconduct, prosecutorial misconduct and more ways to protect innocent people from going to jail or prison.
How has the case of Troy Anthony Davis impacted Georgia, the full impact we may never know but his case has made a virtual crater in the face of injustice in the state of Georgia, exposed racism and the need for criminal justice reform.
