Once again, the world economy is going to make this year’s show a challenge for brokers – not to mention the fact that it falls right before the Presidential election. The article, “2012 Boat Show Season Arrives”, on page 4, offers tips from President of IYC Yachts and current FYBA Board Member Bob Saxon on how to maximize sales at this year’s show. How visible are you to clients, really? Today, it’s not enough to fly your banner on the boat show docks and advertise in yachting magazines and on brokerage websites. You also need to make your own website “pop up” when prospective buyers Google for the services you offer and yachts you represent. Check out “The ABCs of SEO” on page 8 for some valuable advice on how to optimize your site for search engines. Each year, the yachting industry becomes increasingly global. Today, brokers work with clients to purchase new and pre-owned yachts not only in The Netherlands, Italy and other European countries, but also in China and developing nations. AMVER: Your Client’s Yacht Could Save Lives Boat Show Season: ot and humid, humid and hot! This is South Florida in August! The summer doldrums! Maybe next summer I’ll take a trip to Alaska. Those brokers who head up north for the summer know what they’re doing! But it’s already back to school for kids though, and back to work for the rest of us, especially with boat show season quickly approaching. Boat show season will begin with Cannes on September 11-16 for the FYBA. For any members going over to the Med, we will have a booth in the Florida Pavilion thanks again to Enterprise Florida. We would also like to welcome Larry Bernaski who has taken over Julie Balzano’s position as Regional Manager of International Trade Development & Marine Industry Export Marketing for Enterprise Florida. Our booth will be located just in front of the Gare Maritime at the corner of the north dock at the Vieux Port (Old Port). All members are welcome to come by! Then it will be on to the Monaco Yacht Show for a couple of days, no booth but lots of walking the docks! The Fort Lauderdale International Boat Show, commonly known to our members as FLIBS, will be just around the corner after the Med shows on October 25-29. The FYBA will have a new location and new booth for FLIBS! Other surprises are to come, and all will be revealed in the next issue of COMPASS. Fall also means seminar season and we have them lined up for you! On September 11th, there will be the West Coast Yacht Sales Summit in Sarasota. It promises to be as much of a success as the East Coast Yacht Sales Summit was in June. The Yacht Sales and The Law seminar takes place on October 3rd, followed by the Charter Seminar on October 10th. Both of these seminars will be held at the Bahia Mar. Watch for our email blasts with more details. The Seminar Committee and Charter Professionals Committee hope that all members will clear their calendars for these dates as they are working hard to bring interesting speakers and topics. Not to be too idle for too long, we are organizing a Third Thursday Open House once again in Palm Beach. This will take place on October 18th. Last but not least, FYBA has finally gone mobile! While the U.S. economy remains mired in a slow, but steady growth pattern, many markets in Europe are in recession. Elsewhere, the once hot-growth Asian economies especially in China and India - are beginning to show signs of slowing down. All this, naturally, is having an impact on worldwide demand for yachts and megayachts. While most FYBA members say the market is better than it was two or three years ago, especially in the charter segment, yacht buyers remain cautious. That means brokers have their work cut out for them as the fall boat show season approaches. As always, advance planning is key. Major boat shows, such as the Fort Lauderdale International Boat Show (FLIBS), which this year runs from Oct. 25-29, offer huge opportunities to generate sales and meet new customers. But you can’t just show up with a display full of hot offerings and expect prospects to flock to your booth. Now is the time to start reaching out to past clients and current prospects, and engage in some aggressive pre-show marketing and promotions. And, as Bob Saxon, President of IYC Yachts and current FYBA Board Member, suggests in the Q&A that follows, it pays to maintain a positive attitude. In addition to discussing IYC’s plans for the upcoming fall boat show season, Saxon offers some tips that the brokerage community might find helpful. FYBA: For this year’s fall boat show season, do you plan to display as many boats as in previous years, or are you cutting back? Saxon: IYC has exactly the same number of slips and display configuration as we had last year. We’ve not cut back at all. In fact, we have made numerous changes to our display that will enhance the boat show experience for our customers. FYBA: In terms of promotions, are you doing anything special this year to drive sales? Saxon: We’ve reached out to some of the emerging markets with our advertising, and we are running ads in local upscale publications in order to drive the affluent resident sector to our display. We tend to forget that there is a lot of wealth between the Fort Lauderdale and Palm Beach regions and expect them to attend without prompts. We’re hoping this strategy will get them excited about attending. FYBA: Overall, how has 2012 looked as compared to last year? Saxon: It’s a down market, according to the market analysis statistics disseminated throughout the industry, but we’ve seen some recent activity, and charter has livened up considerably. Chartering is often the entry portal, and we see this as a good sign. FYBA: Is the ongoing Euro-crisis having a negative impact on business? Saxon: There are so many factors impacting our market presently that I can’t point the finger at the Euro-crisis as the single element having an adverse effect. It’s become a cliché, but it’s all about ‘uncertainty.’ Our stock market has peaked out and well beyond where it was five years ago, yet high-end buying is somewhat drowsy. I feel that once we are past the Presidential election, regardless of the outcome, business will pick up because our clients will have a sense of certainty about where our country is headed, even if it’s a bitter pill they have to swallow. The ABC’s are three basic strategies designed to give your website the best chance for search success! A – Architecture The Architecture or technical design of your website will affect how easy it is for the automated search engine “spiders” to read your site. Simple html web code is easy for an automated function like a search engine spider to navigate. If it’s easy for the spider to read the words and the code on your site, then it will effectively record words it finds, which is the first step to being shown in a search result. If you are designing a new website, the blog software from Wordpress is an excellent option. The search engine spiders easily navigate Wordpress; it is a flexible solution for creating contemporary-looking designs, and anyone can update a Wordpress website. On the other hand, one of the worst architectures to use for a website is a Flash design. Flash is very difficult for the spiders to read and it is not read by iPhones and iPods. A final tip for your site architecture is to use keyword phrases in your site navigation. For example, “internet marketing services” is better than “services”. You also should include a Site Map page with links to all of the other pages on your site. This makes it easy for the spiders to find and read the entire site. B – backlinks Backlinks are activated links from other websites to your website. Each backlink tells the search engines that there is something worth seeing on your website, a virtual endorsement for your site. Backlinks from important sites such as industry associations or media sites are better than links from small sites unrelated to your industry. Free tools and other compelling content are the type of things other sites will link to. Can you create a calculator or a free guide for your industry that bloggers and the media would refer to via a link? Another great way to get backlinks is to 8 august/september 2012 | florida yacht brokers association | www.FYBA.org offer to write guest articles and blog posts for prominent websites in your industry. Make sure to include your site link with your author byline. Google also is rewarding sites with a new type of backlink called “social signals” – when someone on Facebook “Likes” something on your website, “Tweets” about you or uses another signal from a social site, this is a new type of link or endorsement. C – Content The C in SEO is creating lots of great Content for your website. Google reads up to 1,000 words per page and the best way to be found by a user searching for a word phrase is to include that word phrase on your site. For example, I won’t be found for “internet marketing agency” if I don’t have the word phrase on my site. I recommend creating a page named with an important word phrase. The title of the page should use the target phrase, and the phrase should be repeated two or three times in the copy on the page. In addition, you could name a photo using your target phrase (Google can’t ‘see’ photos but it can read the name and alt-tag). Plus, you can use the phrase in navigation and links from other pages on the site. Google’s search spokesperson Matt Cutts has a great tip for content creation. He calls it the “apple a day” method. The old expression “an apple a day keeps the doctor away” refers to eating healthy fruits and vegetables. Adding a page of content to your site every day (or at least several pages per month) allows you to add several new targeted phrases on a regular basis, and it tells Google your site is alive and fresh. Adding newsletter articles, press releases and new product description pages is a great way to “apple a day” your site. Good luck with your ABC’s and SEO results! Attorney at Moore & Company, P.A. Maritime Law The Sun Never Sets T he world is getting smaller. And you are going global in places like Italy, Germany, Brazil, Singapore, Australia and China. You’ve been dealing in these countries for almost 20 years. After all, that’s the nature of the yacht brokerage business. It’s inherently international. But have you stopped to ask yourself what the ramifications are for you and your client with regard to the different laws that apply country to country? As we progressively move toward a more international business model, we rarely take notice of the fact that each country we step into has a different set of laws and regulations with very different remedies, and consequences than we may be accustomed to. Let’s take China as an example. Doing business there is very appealing. The lure of labor arbitrage, quick builds, and cheap prices on the front end of a transaction can persuade savvy purchasers to enter Chinese waters. But the path to happiness on a Chinese deal is never on the front end; it’s on the back end. Protecting yourself in any business transaction is important. However, when the stakes are high and the deal is in a country like China, it becomes even more important to take proper precautions. Notable risks include the use of exotic financing instruments for the purchase and/or construction of vessels, such Letters of Credit, which allow a U.S. purchaser to forestall ultimate payment until the end of the construction period, but also run the risk of coming due even though your vessel was not constructed. One way to protect yourself when using a Letter of Credit is to secure a valid, highly rated, verified Performance Bond to cover a construction default. Also consider utilizing deal-specific escrow accounts, as well as currency hedging. Deals should be done with proper due diligence and should include a provision for an owner’s 10 representative to remain onsite at all times during any build or construction period. And, while we all know that brokerage commissions should be received up front, it is imperative for the health of your long term relationship with the purchaser that your are not completely absent from the deal moving forward. So proceed with caution. Another notable risk is the perceived inability to perform due diligence on the yard and/or construction because it is taking place on Mainland China. To counter this risk, insist on arranging for your client and an expert to visit the yard, inspect its capabilities and verify its prior work and operations. Finally, be sure to hire an owner’s representative, capable of conversing in Mandarin and English, who can remain onsite during the build. Asking tough questions up front will protect you (and your client) on the back end. Not only do you want to protect your commission, your relationship with your client, and your exposure to possibly being sued for negligent referral, but you also want to preserve your reputation. Another potential risk in dealing with China is that there are limited remedies should a breach occur. Contract provisions that simply call for a venue in Florida and for the application of Florida law are simple but flawed because U.S. judgments cannot be enforced in China. More intricate structures, sometimes involving arbitration tribunals and predetermined escrowed funds can be used. China is a robust economy with tremendous opportunity, but it must be met with a degree of caution and a legal process to adequately protect you from the inherent risk of a cross-border transactions. Knowledge of the laws and regulations in China is an important part of the due diligence process in any deal. Over 500 passengers and crew members were onboard and in clear and present danger. In response, the Coast Guard orchestrated a massive response in which nearby vessels of all sizes and classes arrived at the scene within hours to take on survivors. The vessel sank soon after, but by then, every single person who had been on board just hours beforehand was alive, accounted for, and safe. In large part this great success story was due to the close proximity of cruise ships in the Alaskan trade. This incident was also the entrance of AMVER to the global media but this was not the first use of this little known system in recovery effort on the high seas. Established in 1958 at the NYC Customs House, the Automated Mutual-Assistance Vessel Rescue System or AMVER has always been in a league of its own as a worldwide ship reporting system. Today AMVER’s goal is still the same: to arrange for assistance to persons and affiliate associate vessels in distress at sea. Time and time again it has served as a valuable asset to search and rescue authorities across the world, locating nearby vessels that are able and willing to help in a particular situation. It began as an experiment, confined to the waters of the North Atlantic for its first few years. As maritime computer technology advanced, so did the program. Its computer-based software produces surface pictures, which display all AMVERparticipating ships near any given area of the ocean. With this technology, it became much simpler and easier to locate not only a ship in distress, but also any other vessels in its vicinity. Furthermore, radio stations from California to Sweden joined the network, increasing the system’s already-expansive coverage. AMVER has orchestrated assistance in a variety of situations, ranging from crew injuries or passenger medical emergencies to fires and floods onboard. Specifically, a nearby vessel may have a doctor on board, or the capacity to take in survivors, as in the case of MS Prinsendam. In 1992, an AMVER-participating ship recovered famed French yachtswoman Florence Arthaud after her trimaran capsized, resulting in the program’s exposure on NBC’s “Today Show” and other network television programs. A similar incident shortly thereafter landed AMVER in a National Geographic magazine feature. Yet, the system is still undersubscribed by Vessels that could do so much to respond and save life at sea. Thus, the purpose of this article: Enrolling the Yacht World. It can be easily understood that the success of the program is directly tied to participation. The more enrolled Vessels, the greater the chance of search and rescue authorities locating a vessel nearby to help, and the more effective AMVER becomes. Luckily, there are plenty of incentives to register: enrolling in AMVER is free, voluntary, and open to vessels of all flags. Vessels incur no additional obligation to respond to a distress call than what already exists under international law of the sea. All information is protected and only used in true emergency situations. A vessel simply sends a sail plan electronically to AMVER, reporting its location every 48 hours until arriving at its destination. With this basic information, the system can predict vessel locations at any given time, and greatly improve chances of quick aid in the case of an emergency by finding the best ship to respond to a situation and allowing all others to continue their voyage. Today, over 22,000 vessels from over 100 nations are enrolled in AMVER. Around 4,000 are on plot each day, and these numbers are only growing but the yacht world is under represented. Enrollment was originally limited to merchant ships only, but has been recently expanded to allow cruise ships, research vessels, FPSO’s, fish processors, and private yachts to participate. More than 3,000 lives have been saved by AMVERparticipating ships in the past decade. The program has been lauded worldwide, with many governments actively encouraging participation. HIBBE Maritime Attorney “Guidance in the right direction” The New Year Will Bring Changes to MARPOL Annex V By: Will Nock, Safety and Technical Manager International Registries, Inc. / The Marshall Islands Registry R evisions to the International Convention for the Prevention of Pollution from Ships (MARPOL) Annex V (Garbage) will come into force on January 1, 2013. The revisions were adopted through Resolution MEPC.201(62) during 62nd session of The Marine Environment Protection Committee (MEPC) of the International Maritime Organization (IMO), which was held in July 2011. The most notable of these revisions is that the discharge of all garbage into the sea will be prohibited, except as provided otherwise in Regulations 4, 5, 6, and 7. This means that items such as dunnage, lining, metal, bottles, and other items can no longer be thrown overboard, regardless of the vessel’s distance from shore; which may require some creative storage solutions for smaller vessels. In addition, 10.2 of Annex V will require that every vessel of 100 gross tons (GT) and above, and every vessel which is certified to carry 15 or more persons, have a Garbage Management VESSEL REGISTRATIONS OFFSHORE COMPANIES MARINE LENDING Initial Consultation without cost or obligation Plan. This lowers the tonnage requirement from its current level of 400 GT, which will have implications for a large number of smaller vessels; such as offshore supply vessels (OSV), tugs, and yachts. The establishment of the Garbage Management Plan may be challenging for the yachting community given that there may be a learning curve for many owners, crews, and managers whose yachts fell below the 400 GT requirement. Guidance on how to properly create and implement a Garbage Management Plan can be found in Resolution MEPC.220(63). Other changes have also been made to Annex V, including updates of definitions, the addition of regulations pertaining to the discharge of animal carcasses, and an expansion of the requirements for placards onboard. Comprehensive guidelines for implementing the revised MARPOL Annex V can be found in Resolution MEPC.219(63).
