Home Prices Mainly
Unchanged from 2006

Despite reports of a slumping housing
market, Long Island home prices remained
stable in 2007 with year ending average
prices fairing better than expected.
According to the Multiple Listing Service of
Long Island, Inc., (MLSLI) the 2007 closed
average sales price for a home on Long
Island was $515,539. When examining the
entire year, the 2007 average price in the tricounty area is virtually the same as 2006.
MLSLI reported an average selling price of
$516,194 for 2006.
Individually, Nassau County reported a
2007 average sales price of $ 597,044, 1.6%
less than a year ago when it was reported at
$606,859. Suffolk County reported a year
ending sale price of $465,458, which represents a 2% increase over 2006’s average sale
price of $456,419. Queens County reported
an average sale price of $481,168 which is
2.5% lower than 2006’s figure of $493,253.
Recent housing figures released by
MLSLI continue to show a gradual softening
of house prices and activity. Joseph E.
Mottola, CEO LIBOR/MLS said,
“December inventory levels,
while 12% higher than last
December, are still lower than
November 2007.” Mottola further notes that the median inventory price for December is 4%
less than it was a year ago, which
he says suggests that sellers are
continuing to respond to the market with price adjustments.
The National Association of
Realtors® (NAR) reports that they
expect home prices to recover in 2008. NAR
is predicting a 1.8 percent increase in home
sales through 2008 after a reported decline in
2007 of 1.4 percent. Over the next few
months home prices are expected to hold fairly steady and then begin to improve in the later
part of the year. Lawrence Yun, NAR’s Senior
Economist says, “Local real estate conditions
vary considerably, but with historically low
mortgage interest rates predicted for this summer, and sustained job growth, it could be a
good time for first time homebuyers with a
long-term view to test the housing waters.”

the next President of our country. Sometimes
elections are decided by only a few votes. It
is imperative that you vote as every vote

chapter president so they may dispense these
forms at all of their meetings These forms

who will get coverage for this project.

Amendments Proposed to NYC Co-op
Disclosure Legislation

Although NYSAR agrees with the spirit
behind
NYC
Councilman
Hiram
Monserrate’s (D-Corona) bill, which requires
cooperative corporations to disclose to
prospective purchasers the reasons for withholding consent to a proposed sale, NYSAR
does not support his proposed legislation.
The New York City Leadership is now
amending its version, Intro 119-A. This
amended version contains many provisions
that NYSAR sought in its’ proposed bill
including: transaction disclosure, applications must include the requirements of what
makes an application complete, and a
required timetable that boards and applicants must follow.
Differences in this new proposal include:
Uniformity in the Application and if a board
fails to take action on an application in the
required time, then it must refund the buyer
any funds paid to the board associated with
the application. Buyers may also file a civil
suit against a Co-op if the board fails to
make a timely determination or aggrieved
buyers may choose to commence a proceeding before the NYC Human Rights
Commission. Civil penalties may also be
levied against co-ops that fail to timely com-
ply with the provisions of the bill.
The NYC Council plans to hold a hearing
on this new proposed bill sometime soon, possibly in early February. While it is not possible
to amend Int. 119-A at this point, NYSAR will
have an opportunity to provide testimony on
the proposal when it is brought before the
Council. LIBOR will keep you updated when
we receive a final draft of the legislation.

Lawrence Yun, NAR chief economist,
said the market is experiencing uncharacteristic weakness. “Home sales remain weak
despite improved affordability conditions in
many parts of the country, but we could get
a quick boost to the market if loan limits are
raised in combination with the bold cut in
the Fed funds rate,” he said. “Home prices
are lower, mortgage interest rates continue
to decline and incomes are higher, but many

The Federal Reserve, in an emergency
meeting January 22, 2008, slashed the
key rate to 3.5 percent, citing a weakening economic outlook. The move marks
the Fed's biggest rate cut — three quarters of a point — in more than 20 years.

said the rate-cut was to help restore confidence in the U.S. economy.

NAR Reports: Existing-home Sales Down in
December But 2007 was Fifth Highest on Record
Nationally, existing-home sales declined
in December following several months of
stable activity, with total sales in 2007 at
the fifth highest on record, according to the
National Association of Realtors®.
Existing-home sales —slipped 2.2 percent to a seasonally adjusted annual rate of
4.89 million units in December from a pace
of 5.00 million in November, and are 22.0
percent below the 6.27 million-unit level in
December 2006.
For all of 2007 there were 5,652,000
existing-home sales, the fifth highest year

the Fed said in a public statement.
“Moreover, incoming information indicates
a deepening of the housing contraction as
well as some softening in labor markets.”
NAR believes that the 75-basis-point
cut in the Fed funds was a good step in
giving the economy the boost and sending a clear message to both the market
and to consumers. The cut will help
lower mortgage interest rates and lessen
the burden of adjustable-rate loans that
are resetting. NAR commends the
Federal Reserve Board on its bold action.

According to Freddie Mac, the national
average commitment rate for a 30-year, conventional, fixed-rate mortgage fell to 6.10 percent in December from 6.21 percent in
November; the rate was 6.14 percent in
December 2006. Last week, Freddie Mac
reported the 30-year fixed rate dropped to 5.69
percent. “Although interest rates on jumbo
loans have fallen somewhat, they remain well
above conventional mortgage rates,” Yun said.
Total housing inventory fell 7.4 percent at
the end of December to 3.91 million existing
homes available for sale, which represents a
9.6-month supply at the current sales pace,
down from a 10.1-month supply in
November. “The fall in inventory in
December is encouraging, but inventories
remain elevated and buyers have a clear edge
over sellers in many markets,” Yun said.
The national median existing-home price for
all housing types was $208,400 in December,
down 6.0 percent from a year earlier when the
median was $221,600. Because home sales
have slowed the most in higher cost markets,
there is a downward distortion to the national
median as the mix of closed sales has changed
over the past year. For all of 2007, the median price was $218,900, down 1.4 percent from
a median of $221,900 in 2006.

The Town of Brookhaven voted (4-3)
against the proposed building moratorium
that would have affected 11,000 properties
along the Forge River area. Former Town
Councilwoman Carol Bissonette had proposed a 24 month halt on any construction
that would have added cesspools along the
Forge River. The waterway is plagued by
an excess of nitrogen, a primary cause of
the Forge River’s ecological dysfunction.
This environmental proposal would have
made it burdensome on builders as no new
development applications, land use applica-
tions, including but not
limited to those for subdivision maps, site plan
development, land divisions, variances, special
permits, building permits for described property, wetlands and
waterways, or change of
zone
applications,
would have been accepted, reviewed and/or
granted approval by the Town with few
exceptions.

I would like to take this opportunity to
wish the membership and their families a
happy, healthy and prosperous New Year!
I am deeply grateful by the honor
bestowed upon me to serve as your
President. I take this responsibility very
seriously and pledge to you to provide
services that will make the Long Island
Board of REALTORS® the envy of every
trade organization in our country.
To begin with, I would like to state that
the health of our members is an essential
priority. This is an area that the State and
National Association of REALTORS®
have tried to address for years and have
not accomplished what we hope to
accomplish in the year to come. An
affordable health insurance plan, which
would be underwritten by health insurance carriers, as opposed to individual
policies, will be presented to the Board of
Directors for their approval in the very
near future.
It is also paramount to safeguard the
individual member’s wealth, whereby;
they can provide a comfortable nest egg
for their retirement. The Member
Services Committee will evaluate a comprehensive retirement plan which subsequently will be presented to the Board of
Directors for their consideration.
In 2008, with all the changes that are
taking place in the real estate market, it is
essential to provide an educational tool
that allows our members to be on the cut-
ting edge of their profession. The
Sweathog Program, known to be result
oriented training, instills the basic techniques in all aspects of the real estate
business. Our Education Committee will
finalize a class schedule. I strongly urge
all of you to take advantage of this program.
All of us have had the experience of
working hard to put a deal together, only
to get to the closing table to realize that at
best, our commission is being cut and at
worst, the seller refuses to pay any commission. We will continue to pursue our
statewide campaign to protect our hard
earned commissions. Once again our
biggest obstacle will be advancing the bill
through the Judiciary Committee. Stay
tuned to see how you can help us try to
get this bill signed into law.
Let me assure you, as in past, we will
also be a united force in safe guarding our
profession against the rules, regulations
and even laws that towns and municipalities embark upon to curtail our legal practices.
My accountability and dedication is to

County Directors with any input you may
have. Together we will take our organization to new heights.

Year on February 1st, featuring the

was the perfect beginning for what I know is
going to be a great year for WCR.

Last year LIBOR and MLS’s own
Director of Network Administration Bill
Dimmler, completed his first ever
triathlon in honor of a little girl named
Francesca, who was diagnosed with cancer (Acute Lymphoblastic Leukemia)
when she was three years old, and to raise
money for the Leukemia and Lymphoma
Society — which helps people with these
deadly diseases. He raised over $4,500.
This year Bill will swim/bike/run in St.
Anthony’s triathlon again but he has also
added a second event. He will complete a
Half IRONMAN on June 8th through the
mountains of New Hampshire. As a
member of The Leukemia and
Lymphoma Society's Team in Training,
Bill has pledged to swim/cycle/run on
behalf of Francesca, Tristan, a three year
old boy who was found to have acute
lymphoblastic leukemia in March 2007,
and to help raise money for research and
patient assistance programs. Leukemia is
the #1 disease killer of children and the
leading fatal malignant disease of men
and women under the age of 35.
Although the causes of leukemia remains
unknown, recently developed treatments
and steady advances in research bring us
closer to a cure every day. Bill’s goal is
to raise $6,000 for The Leukemia and
Lymphoma Society by the fast approaching March 24th 2008, deadline. The
Leukemia and Lymphoma Society will
support vital programs including blood
research, patient aid, community service
and education. Please further the mission
of the LLS: to cure leukemia, lymphoma,
Hodgkin’s disease, myeloma and to
improve the quality of life of patients and

PR Campaign Will Focus on the
Relationship with Consumers
In February, the National Association of
REALTORS (NAR) will launch a new
Public Relations Campaign that is intended
to help consumers make better sense of all
the information they hear about the real
estate market in the media. The strategy is
called “Surround Sound” and this multifaceted campaign targets the perceived
pent-up supply of home buyers who are
remaining “on-the-fence” as a result of the
negative things they are hearing about
today’s housing market. The goal of the
program is to get these hesitant buyers information that will help them feel more comfortable with making their home purchase.
The Surround Sound program will help
generate positive media coverage about real
estate opportunities in local markets. The
program plans to counter the negative
national reports by featuring national radio
and television spots that will highlight the
value of homeownership as a long-term
investment. Additionally, the campaign
will bring attention to the combination of
low mortgage rates and declining home
prices, which are producing more affordable housing conditions in many areas of
the country.
The 2008 Public Relations Committee
for the Long Island Board of REALTORS
will meet on January 28, 2008 to determine
what direction, and what message, the
LIBOR PR campaign will go in during the
coming months. Details of the campaign
will be publicized in the next issue of “The
REALTOR” paper.

oil embargos, runaway inflation, and I was
a stay at home mom. But we bought the
house! We bought the “house” because we
wanted a “home”! We wanted to live in a
good neighborhood where we could raise
our children, we wanted nice neighbors,
barbecues, a community we could grow
with, and a home that we could make ours
by decorating it, improving it, celebrating
family events in it, and ultimately, by paying it off. We weren’t driven by the
prospect of using an equity line of credit to
finance a lifestyle that was beyond our
means. Living in that new home that was
“ours”, was lifestyle enough.
And to me, as this obvious truth of
perhaps a time gone by and of values we
have ceased to believe in took form and
became clearer in my mind, I needed to
share with the committee my firm belief
that the message that this is a “great time
to buy a home” is true! It is true for every
person who seeks a “home” for all of the
reasons I just mentioned. Interest rates
are low, lower than when I bought my
first home over thirty-two years ago.
Prices are competitive. Even if prices
fall a little more, does it matter to someone who is buying a home to actually
live in it and raise a family? Real estate
has always been at the mercy of economic cycles, and will continue to be at
their mercy long after you and I are no
longer a consideration. It always comes
back and if you are in it for the long haul,
you will not only profit financially, you
will have provided yourself and your
family with a rich and wonderful family
experience and values that travel with
them for their lifetime.

The State Legislature has once again made

Manhattan Housing Prices at
Record High
The U.S. housing market may be a
seller's nightmare but Manhattan's
was a dream in the fourth quarter as
foreign buyers pushed up demand
while supply stayed tight, sending the
average sales price to a record high.
"Foreign demand has been a big
part of the story," said Jonathan
Miller, director of research at Radar
Logic and author of Prudential's quarterly overview reports, but foreigners
are not permitted to buy cooperatives.
"In a lot of new development we've
seen significant activity from domestic
purchasers as well," Miller added.

upload your own photo Y or N”. If “N”
(No) is selected the listing will be sent
to VIC for the photo to be taken and
$8.00 will be billed to the office.
If “Y” (Yes) is entered at “Do you plan
to upload your own photo Y or N” the
photo must be uploaded within 7 days.
If not uploaded, the listing will be sent
to VIC for the photo to be taken and
the listing office will be billed $8.00.
This charge will remain on the bill even
in those cases when the photo is
uploaded by the Participant prior to
MLS receiving the photo from VIC.

We’ve all heard the phrase, “a house is
not a home”, and I couldn’t agree more, but
I was recently forced to rethink the phrase
and its intrinsic importance while attending
a meeting of the advertising committee.
The meeting was well attended and the
attendees were enthusiastic; an enthusiasm
I’m sure was sparked by the eternal hope
and optimism of our peers that the next big
deal is right around the corner, even if the
corner is nowhere in sight.
Everyone was anxious to share their
ideas as to what our message should be
during the coming year when there is so
much concern and pessimism about the
market. One of the concerns of the committee was that the use of phrases that
suggest it is a great time to buy a home,
would appear self-serving, disingenuous,
and would lose Realtors® their credibility. Afterall, all you need to do is to listen
to the financial reports and the pronouncements of the financial pundits to
know that this is a terrible time to consider buying a home! Right?
Afterall, with uncertainty in the market
place, you might not be buying at the bottom of the market, and if the economy
stagnates you might not experience double digit appreciation of your real estate
investment during the coming year, and
of course with that scenario, you wouldn’t
be able to use your home as a piggy bank
to finance such things as: trips to far away
places, cars, and/or pay off credit cards.
Some believe we sell houses not homes,
and the economic markets tell us it is a
bad, bad time to be buying a house! I
believe those people have it all wrong! It
is a great time to buy a home!
I bought my first home in 1976 for
$55,000.00. My husband was earning
about $22,000.00 at the time, interest rates
were 8 1/2 percent, there was the threat of

With information at our fingertips, it’s
imperative for most of us to feel comfortable with electronic marketing tools. But
what’s the best way to market yourself electronically? Will e-mail or blogging work
best for holding on to prospects and convincing them to do business with you?
E-mail has a lot of positives. There’s no
doubt that most consumers, as well as most
real estate practitioners, are much more
familiar and comfortable with e-mail than
other electronic communication options. A
2005 survey by Forrester Research found
that only 2 percent of adults knowingly
used an RSS (really simple syndication)
reader or subscribed to blog content.
Another advantage of e-mail is that there
are many products and services to help you
create e-mail marketing campaigns and enewsletters and deliver images and HTMLformatted pages easily.
Unfortunately, spammers’ abuse of the email system has diminished its value as a
marketing tool. Even as you abide by the
federal CAN-SPAM Act, you still have to
get by the many spam filters out there. Very
few e-mail systems let senders know that an
e-mail was blocked, and many e-mail users
don’t know how to view blocked e-mail.
Even if it does get delivered, your message
stands a good chance of being deleted as
unwanted e-mail.
With spam working against you, a Web
log, commonly called a blog, might give
you a leg up in working with prospects. On
the positive side, you’re not pushing your
information at your targeted audience;
you’re pulling them to you with content
they find interesting and of value. A blog
also makes it easier for you to deliver richer, larger content, such as videos and graphic reports, without the need for big e-mail
attachments that get blocked as spam or
annoy a prospect with long downloads.
Another plus for blogs is the longevity of
your content. It’s there, categorized and
available, for as long as you want. Suppose
you post quarterly sold statistics for your
area. Because postings remain available,
you make it possible for visitors to do a
trend analysis of prices.
A blog is also a great tool in your efforts
to attract unknown prospects.
So, e-mail or blog? The best answer is both.
Offer both by linking all your marketing
communications. For example, an RSS
feed, provided by most blog platforms and
FeedBurner, allows visitors to subscribe to
and receive your posts when they’re published. Meanwhile, offer an e-mail subscription to visitors who don’t use an RSS
reader.
The bottom line: Familiarity with all the
new marketing technology will ensure that
whichever way consumers turn, you’re one
step ahead.

BobVila.com. Ultimate handyman
Bob Vila has found a home on the Web,
offering advice on all sorts of home
improvement projects. The site has easyto-use search functions that help you
wade through the vast amount of information to zero in on your topic of interest.
The Home Improvement Library provides
everything you need to tackle a project,
including articles, tips, and videos. The
library lets you browse by subject, task,
or location in the home where your project is based. If you need more guidance
on home repairs, check out the step-bystep illustrated Fix-It Club, which explains
how to diagnose problems and fix almost
everything, from a toilet to a garbage disposal. The site also has a page devoted
to online Design Tools to help plan out
your new kitchen, patio, or garden. You
can register on the site to save your
designs and access them later.
HGTV.com. The Internet home of the
Home & Garden Television Network has
free resources for decorating, remodeling, and gardening. The strength of this
site is its interactive tools and online
demos. In the section devoted to
Decorating, for example, before-and-after
slide shows provide ideas about how to
spruce up two of the home's most important rooms: Kitchens and Bathrooms. Or
you can use the Room Planner to create a
customized floor plan for any room in your
home and experiment with different furniture arrangements before trying it out for
real. The Remodeling section of the site
provides online How-To Demos that walk
you through projects like installing a
handrail or decorating with wallpaper.
HGTV.com's Gardening section, meanwhile, teaches gardening enthusiasts
about using the right Gardening Tools
and provides tips for executing various
Landscaping/Design projects.

new beginnings... Before we move forward, let’s reflect on our past accomplishments. In the past 4 years Pat Levitt has
dedicated innumerable amounts of hours
as well as physical, emotional and professional efforts. Pat and her team raised
over 1 million investment dollars for
RPAC. These investment dollars helped
put a stop to the Brookhaven transfer tax
and also kept the banks from entering our
business for another 2 years!

With the increased complexity of residential real estate brokerage has become
the inevitable inappropriateness of old
truisms and rules. Among them is the
NAR mandate that offers of compensation through multiple listing must be
unconditional. For the last decade this
mandate has been celebrated in its
breach more than by compliance. This is
true not only on Long Island but
throughout the Country.
Compensation to cooperating brokers
is intended to fairly reward them for the
work they are required to do and the
results they achieve for the listing broker’s client. However with the advent of
buyer brokerage on-line brokerage,
gooole, zillow, trulia, etc. cooperative brokerage is no longer so simple. Many new
factors enter into the mix. Nor are these
factors universal. Reasonable conditions
for the payment and collection of compensation differ from market to market.
The result is that the market has to
accept offers of compensation that are
subject to various conditions. Does this
mean that anything goes? Emphatically
NO! But, what is the new rule?
NAR and its member boards are struggling to find the answer to that question. At
the moment there is no new approach, but
at the November NAR Convention Sate
and Local Board Counsel seemed to be in
agreement with the following guide lines.
1. Are the conditions lawful?
a. Example: Not anti competitive or
not discriminatory with respect to a
protected class.
2. Are they complete on the face of the
listing?
a. Explanation: Can the cooperating
broker determine what they must accomplish simply by reading the listing information posted on the MLS.
3. Can the cooperating broker determine the amount of compensation and be
certain that its performance will entitle
them to compensation from the face of
the listing information.
a. Example: If the cooperating broker
produces a buyer who enters into a contract and closes with the result that the
seller pays the listing broker the full
commission that they will be paid.
Exception #1: No rule or set of guide
lines can ever be applied rigidly in all
cases. The above guide lines are no
exception. Where the listing broker is in
fact the broker who was the procuring
cause of the sale they and not the “cooperative broker”, who may in fact have
presented the offer of the buyer, is entitled to the entire commission. This most
frequently occurs when a buyer visits and
open house and is in fact convinced to
make an offer by the listing agent. This
buyer, however, while expressing the
desire to purchase, leaves the open house
and makes the offer through another
MLS broker. In such cases commission
entitlement will be determined in LIBOR
arbitration on the basis of procuring
cause and any conditional language on
the listing concerning cooperating broker
compensation will be just one fact to be
considered by the arbitrators along with
al other facts. This would be so even if
the listing said that no cooperating broker’s commission would be paid if the
buyer saw the property at an open house.

President Approves Two-year
Ban on Banks in Real Estate
On December 26, 2007, President Bush
signed into law the FY2008 omnibus
appropriations bill which includes a twoyear provision prohibiting banks from
entering the real estate brokerage, property
leasing and management business. NAR
was well position to secure a permanent
ban. However, due to a last minute objection by Senator Robert Byrd (D-WV),
Chairman of the Senate Appropriations
Committee, the permanent language was
struck and replaced with a two-year ban. In
2008 NAR will be advocating Congress to
approve its Community Choice in Real
Estate bill (H.R.111/S.413).

New York Assembly Unveils
Plan to Help Struggling
Homeowners
In January, Assembly Democrats
announced a $180 million program to
assist homeowners who have fallen
behind on mortgage payments. The plan
includes $150 million in grants to help
borrowers to catch up on back payments
and to work out deals with lenders.
Another $30 million will be dedicated to
debt counseling, legal services and mediation. And to prevent a similar crisis in
the future, the Assembly is advancing
measures to stop predatory lending abuses. The legislation will address negative
amortization, prepayment penalties, lending without regard to repayment ability
and increase lender/broker responsibility
toward borrowers. Assembly Democrats
say the funding for the program should
be included in the 2008-09 state budget.

NYS Senator Bruno Pledges No
Increase in State Taxes‰
As legislators and the governor prepare
to return to the Capitol for the 2008 leg-
islative session, Senate Majority leader
Joseph Bruno vowed this past week:
“There will be no increases in state taxes
this year ...you can take that to the bank.”
The Senate Majority advanced a multibillion dollar property tax relief plan,
NY-STOP (Stop Taxing our Property).
The proposal doubles the STAR rebates
for most homeowners and triples rebates
for seniors. In addition, the plan would
give school districts the authority to eliminate residential property taxes over five
years, with revenue replaced by additional state funding.
House OKs Lift on Fannie,
Freddie Loan Limits
The economic stimulus package hammered out between the White House and
Congress on Thursday lifts the size of
home loans that may be bought or
insured by Fannie Mae and Freddie Mac.
The Fannie/Freddie cap would rise to
$729,750 for one year. Currently Fannie
and Freddie are capped at $417,000.
The measure also would permit the
Federal Housing Administration to indefinitely insure loans up to that same level.
Currently, FHA loans may not exceed
$367,000.
“The stimulus package announced
today is a positive step toward strengthening the housing market and our economy,” NAR President Dick Gaylord said
in a public statement. “The increase in
loan limits should provide liquidity to the
mortgage market in all parts of the country allowing qualified home buyers who
may have been on the sidelines to enter
the market.”
The measure is also expected to make
jumbo loans more affordable because it
will make them more attractive to
investors, who since summer have
shunned home loans that don’t pass
through Freddie or Fannie.

Case #6-6: Disclose Affiliated
Business Relationships Prior to
Recommending Real Estate
Related Products of Services
REALTOR® Z, a broker and sole pro-
prietor, had invested considerable time,
money and energy into developing her
website. Seeking to recoup some of her
costs, she approached virtually every
provider of real estate-related products and
services in her area, including financial
institutions, title insurance companies,
home inspectors, mortgage brokers, insurance agencies, appraisers, exterminators,
decorators, landscapers, furniture and
appliance dealers, rug and carpet dealers,
moving companies, and others about
advertising oh her home page. As a condition of having a link to their own sites
appears on her home page, REALTOR® Z
required that a fee be paid to her each time
a consumer “clicked through” from her
site to an advertiser’s.
Ads for providers of real estate-related
products and services who agreed to
REALTOR® Z’s terms appeared on her
home page under the heading “Preferred
Providers.” Immediately under the heading
read: “These vendors provide quality goods
and services. Please patronize them.”
Buyer A frequented REALTOR® Z’s
website seeking information about available properties. Using that website, he
became aware of a property on Elm Street
that he made an offer on through REALTOR® Z which was accepted by the seller. The sale closed shortly afterwards.
Buyer A was an avid remolder and,
using REALTOR® Z’s website, linked to

the Real Rug company website, among
others. Interested by what he found there,
he subsequently visited their showroom in
person and purchased wall-to-wall carpeting and several expensive area rugs.
Given the size of Buyer A’s order, one of
the owners of Real Rug came to oversee
the delivery and installation. In the course
of conversation with Buyer A, he commented favorably on the amount of referral business received from REALTOR®
Z’s website. “And to think I only pay a
small fee for each customer who’s referred
to me by REALTOR® Z,” he added.
Buyer A was somewhat surprised that
REALTOR® Z would receive money for
referring clients and customers to
providers of real estate-related products
and services and contacted the local association of REALTORS®. The association
provided him with a copy of the Code of
Ethics. Reading it carefully, Buyer A concluded that REALTOR® Z’s actions might
have violated Article 6, and he filed an
ethics complaint against REALTOR® Z.
At the hearing, REALTOR® Z defended herself and her website, stating that the
advertisements for real estate-related
products and services on her website were
simply that, only advertisements and not
recommendations or endorsements of the
products and se rvices found there. She
acknowledged she collected a fee each

REALTOR® A had listed Seller S’s vintage home. Buyer B made a purchase offer
that was contingent on a home inspection.
The home inspection disclosed that the gas
furnace was in need of replacement
because unacceptable levels of carbon
monoxide were being emitted.
Based on the home inspector’s report,
Buyer B chose not to proceed with the purchase.
REALTOR®A told Seller S that the condition of the furnace and the risk that it
posed to the home’s inhabitants would need
to be disclosed to other potential purchasers.
Seller S disagreed and instructed REALTOR® A not to say anything about the furnace to other potential purchasers. REALTOR® A replied that was an instruction he
could not follow so REALTOR® A and
Seller S terminated the listing agreement.
Three months later, REALTOR® A
noticed that SELLER S’s home was back
on the market, this time listed with REALTOR® Z. His curiosity piqued, REALTOR® A phoned REALTOR® Z and
asked whether there was a new furnace in
the home. “Why no,” said REALTOR® Z,
“Why do you ask?” REALTOR® A told
REALTOR® Z about the home inspector’s earlier findings and suggested that
REALTOR® Z check with the seller to see
if repairs had been made.
When REALTOR® Z raised the question with Seller S, Seller S was irate.
“That’s none of your business,” said Seller
S who became angrier when REALTOR®
Z advised him that potential purchasers
would have to be told about the condition
of the furnace since it posed a serious
potential health risk.
Seller S filed an ethics complaint against
REALTOR® A alleging that the physical
condition of his property was confidential;
that REALTOR® A had an ongoing duty to
respect confidential information gained in
the course of their relationship; and that
REALTOR® A had breached Seller S’s
confidence by sharing information about
the furnace with REALTOR® Z.
The Hearing Panel disagreed with Seller
S’s contentions. It noted that while REALTORS® do, in fact, have an obligation to
preserve confidential information gained
in the course of any relationship with the
client, Standard of Practice 1-9 specifically provides that latent material defects are
not considered “confidential information”
under the Code of Ethics. Consequently,
REALTOR® A’s disclosure did not violate
Article 1 of the Code of Ethics.

3-HOUR CE CERTIFICATE COURSE — Attention
Realtors: CE Law change requires fair housing training
effective July 1, 2008. A revision to Section 441 of the Real
Property Law now requires all real estate licensees who are
renewing their license on or after July 1, 2008, to complete
22.5 hours of approved continuing education, three hours of
which must include fair housing and/or discrimination of the
sale or rental of real property or an interest in real property.
This course satisfies that 3-hour requirement. (This new law
does not apply to those exempt from the CE requirement.)
This fair housing program is guaranteed to provide you with
insight for applying the law to “real world” real estate.
