1. Prior finance concurrence will be required for waiver
of Demurrage/Wharfage charges above Rs 25,000/- per
wagon/per consignment respectively. Cases submitted to
GM should be routed through coordinating HOD of
Comml. Deptt and FA & CAO.
2. DRMs have full powers to write off of demurrage and
wharfage charges in respect of consignments not taken
delivery of and subsequently disposed off by auction, and
remaining uncovered after setting off the sale proceeds
realised from the auction sales. The amount realised in
auction should be set off against freight demurrage and
wharfage charges, in that order.
3. The waiver of demurrage charges shall be on a per
wagon basis. Waiver of wharfage charges will be on
consignment basis except in the case of Train load
consignments it will be on per wagon basis.
4. Where Demurrage cases are being handled by officers
of operating department, CCM/Sr DCM etc will mean
COM/SrDOM etc.

(i).The Performance Guarantee shall be released to the contractor after
physical completion of the work based on the ‘ Completion Certificate’
issued by the competent authority [see note (iv) below] stating that the
contractor has completed the work in all respects satisfactorily.
(ii) The Performance Guarantee shall also be released if a contract is
closed on administrative account without any financial liability on both
parties.
(iii) The Security Deposit, however, shall be released only after the
expiry of the maintenance period and after passing the final bill and
after ‘ No Claim Certificate’ furnished by the contractor. A certificate
in this regard to be issued by the competent authority [see note (iv)
below]. The certificate, inter alia, should mention that the work has
been completed in all respects and that all the contractual obligations
have been fulfilled by the contractors and that there is no due from the
contractor to Railways against the contract concerned.
(iv) The Competent Authority shall normally be the authority who is
competent to sign the contract. If this competent Authority is of the
rank lower than JA Grade, then a JA Grade Officer(concerned with the
work) should issue the certificate.
(v) The security deposit recovered from the running bills of a
contractor can be returned to him before the maintenance period and
after the physical completion of work if he so desires, in lieu of
FDR/Irrecoverable Bank Guarantee for equivalent amount to be

1. For Part-II, Constitution of Tender Committee and Accepting Authority for Single Tender cases should be at least one step higher than the
members nominated in case of open tender/limited tender except where GM is the accepting authority. This restriction is as envisaged in the SOP
for Works Matters.
2. Executive department means Commercial. Sister departments implies: Medical/Stores depending on whether it is for catering tender or for
other than catering.
3. The JAG level representative of Commercial Department will consist of either Dy. CCM in Hqrs. or Sr. DCM on the Divsion.
