INTRODUCTION
Hello, my name is Francis Featherby and welcome to my EBook on Process
Serving. I have been active in the field for going on 7 years now and have
chosen to teach other individuals like yourself how to get involved and
make a lucrative career out of serving papers. A few things to note before
we jump into it, as with any work from home opportunity, there are no
free lunches. I work very hard, as hard if not harder then a corporate man
working 10-hour days in an office. Your efforts will always determine your
rewards and for the people who think there really is an opportunity out
there that will make them rich without having to really work… you are
sadly mistaken. Process serving requires education, practice, and as most
new industries, it requires you to fail once or twice while you are learning.
Treat your new business like a job and you will see it grow much quicker
then if you treat it as an opportunity. Most people would give up anything
for the chance to be their own boss, set their own hours, or just choose
not to work certain days. This field like many fields offers those luxuries
however requires a greater deal of discipline and drive to ensure those
luxuries do not take place of hard work and ambition. I will give you the
tools you need to succeed, but it will always be up to you to use those
tools accordingly. With that said, I strongly recommend you read this
manual, and re-read this manual before you take on your first job. Once
you have the information, please don’t jump the gun and get in over your
head. I will be here to help you and answer questions, but I will not save
you from your own over zealous attitude, keep in mind, I too have a
reputation to uphold with these companies, as many of them I currently
work for. Let’s talk about the industry.
What is Process Serving?
Service of process is the service of writs, summonses, subpoenas,
and other court documents. The act signifies the delivering to or
leaving of such documents with the party to whom, or with whom,
they ought to be delivered or left. When they are so delivered, they
are then said to have been served. There’s most likely a much
easier way to say that… but you get the idea. Let me see if I can get
into a little finer detail regarding the industry.
A more formal way to look at the service of process is the
procedure employed to give legal notice to the person (defendant,
etc.) of a court or administrative body proceeding, to the person
that the document is directed to. This enables the person to
respond to the proceeding before the court, body or other tribunal.
Usually, notice is furnished by delivering a set of court documents
(summons, complaints, subpoenas, orders to show cause, writs,
and other court documents) to the person to be served.
In most Anglo-American legal systems, such as in the United States,
the service of process is effectuated by a legal process server who
must be an adult and (in most jurisdictions) not a party to the
litigation.
Legal process servers serve (deliver) legal documents such as
summons, complaints, subpoenas, and orders to show cause, writs,
and other court documents to an individual that is involved in a
court case. The legal document(s) must be served by the process
server in accordance with the rules and laws in the area, county, or
state that the service is being performed in. Service is considered
when the documents are personally handed to the defendant, or
when the defendant cannot be served personally, sub-serving to
someone in the same household or business. After serving the
documents, a process server must complete an Affidavit of Service,
which is also called a Proof of Service. This Affidavit or Proof of
Service verifies that the process server served the papers. It must
be notarized and returned to the party that requested service.
Some jurisdictions require or permit process to be served by a
court official or court officer, such as a sheriff, marshal, constable,
or bailiff. There may be licensing requirements for private process
servers, as in New York City. Other jurisdictions, such as Georgia,
require a court order allowing a private person to serve process.

In non-English speaking countries such
as France, the Netherlands, Germany, Japan, and China, which
follow the continental legal system based on the Napoleonic legal
codes, service of process is performed by a huissier de justice
(gerechtsdeurwaarder in Dutch), either in person or through the
mail. In those countries, there are two different types of service —
signification and notification. The huissier is only responsible for
signification, the more formal type of service.
It is very important that you make yourself aware of your
individual state laws regarding process serving. You must follow
these laws or you will be out of business before you start. To learn
about individual state laws regarding process serving please visit
the links below. If your state requires process servers to be
licensed, which are roughly 8 states currently, it is absolutely
imperative you follow the rules and regulations, and obtain a
license. This is generally not a difficult process, similar to being
licensed as a notary or other independent contractor for legal or
organized processes. The majority of states simply require the
server to be over the age of 18, but again, it is in your best interest
to familiarize yourself with the states laws, and proceed
accordingly.

Serving Papers
When a company hires you, you will be given a set of
instruction detailing the specifics of each serve. Some serves may
be as simple as dropping the papers in a mailbox, knocking on the
door, and heading home. Some serves will require a little more
finesse. Some times the company serving the papers will require
the party to verbally identify themselves, once that happens, you
are able to leave the papers anywhere on the property as they have
identified themselves as the accurate recipient of the papers. Some
companies will require you to physically deliver the papers into
people’s hands. While this can be tricky, this is always my favorite
type of serve. I enjoy coming up with creative ways to make people
accept the papers. There are all sorts of ways to make somebody
grab a piece of paper, while I won’t be sharing mine with you, I
have no doubt you can come up with some interesting methods
yourself. Always keep in mind, do not break the law, do not put
yourself in danger, and do not do anything to further upset the
individual being served. Always be professional and confident and
you will go far in this industry.
When you begin sending out your introduction letter,
there are a few things to expect. First, most of the companies will
not respond to you immediately, that’s okay, they look at all of
their emails and will file it under potential contractors for serving
work and use it in the future. I will also be showing you a follow up
letter I use specifically written for companies that do not respond
at all to you initial attempts for work.
A few things to make sure you have before we get to the
introduction letter. You will need a briefcase of some kind, plenty
of pens; a flashlight is always helpful, and reliable transportation.
Public transportation is okay as well, but occasionally you will get
a “rush job”, which is papers that need to be served within 24
hours, if this get’s offered to you… TAKE IT! Rush jobs are excellent
as they show your commitment to the company, and also your
initiative and drive… did I mention they pay about double what a
normal serving job does?
Introduction letter to Process Serving Companies
This letter is the same letter I used when starting out.
You will be contacting several companies to inform them of your
availability and location. Don’t get frustrated if the companies
don’t need help in your area; always be cordial, as they most likely
will sometime.
I would suggest setting up a new business email address
specifically for your serving business. Always try to look
professional with your address and never think humor will win a
company over. It may win me over, but these companies are
looking for professionalism. It is not a bad idea to look into
creating a company name and setting up an informative website.
Companies will respond better to people who seem to have a
business that is thriving, rather then a start up business who is still
wet behind the ears. Your website does not have to be fancy or
flashy, just simple, professional and informative.
The Letter:
Dear (Company Name)
I am writing to inform you of my availability for process serving.
My current location is (Detroit Michigan) and I am willing to travel
within 100 miles from my hometown to complete jobs. I would like
to formally introduce myself and make you aware of my
availability. I pride myself on prompt turn around and professional
candor before, during, and after my serving tasks. If you are ever in
need of a contract server in this area, please keep me in mind.
Thanks and I look forward to hearing back from you.
Sincerely, (your name)
Be sure when you put this letter together, you change all of the
applicable names, such as mine, and the Company name. This letter
worked wonders for me when starting out, mainly because your
not specifically asking for a job, your just asking for recognition of
your availability. Keep it simple and professional and it will take
you far.
Once you get a job
Once you get your first job, you will be responsible for completing
the job according to how the company instructs. Most jobs will
simply require you to deliver the papers to the individual in
question, however it is important to keep your eyes open for
details. Some cases will require a signature; some will only require
you to deliver the package to the individual or relative of the
individual. Some require verbal confirmation that the individual is
the proper recipient of the court papers. This information will be
given to you prior to starting the job, but it is very important you
read carefully through the job description and complete it
correctly.

Pay?
I suppose your wondering by now how much it pays to serve
papers?
On average, the cost of a routine service can pay anywhere from
$35 – $100. Prices can be lower in some states and higher in
others. As the serve becomes more difficult or costly for the
process server, you can expect to make more. You may also be
reimbursed for expenses such as gas. Additionally, if you have a
rush serves or you need papers served the next day or on a
holiday you can expect to earn more.
This can also vary however. We spoke about rush jobs earlier,
the rush jobs can pay upwards of $150 to $200 for one job. The
trick to this industry is building relationships with your
companies, creating steady workflow and reliable income. Once
you are completing jobs on a regular basis, you can enjoy
income of $75,000 to $100,000 yearly. Many individuals, who get
started in this business, take on a team or start their own
legitimate business. Creating a team of people who can serve
will make your company very appealing to larger National
companies, as they feel secure that there work will get done in a
timely fashion, because you have several people on your staff to
ensure things get done quickly and efficiently.
Also keep in mind, you have very little overhead for this
business. Office supplies and gas to and from serving jobs is
really the majority of it. When I started my business and got to
the point were I could hire people, I only paid my employees
when they served, similar to a commission. I would certainly
help them obtain jobs, but they knew that they were only getting
paid for papers they serve. This creates incentive and also
doesn’t allow employees to rest on their laurels, which costs
you money.
Some Things to Remember
Trespassing
In nearly every state, process servers are restricted from
trespassing on property as a means of serving process. Such
invasions, no matter how innocuous, are regarded as not only
invalid, but also illegal and may result in penalties for offenders.
Gated communities and apartment buildings have created a
difficulty for process servers; however, most are required to
allow process servers to enter them.
In California, “Registered Process Servers” are granted “…a
limited exemption against trespassing.” This allows servers to
enter a private property for a reasonable period of time to
attempt service of process. Similarly, in California, gated
communities which are “…staffed by a security guard, or where
access is controlled, must allow a Registered Process Server to
enter for service of process upon presenting valid identification,
and indicating to which address the process server is going.”
The problem is that this does not prevent the security guard
from contacting the resident and alerting them that a process
server is on his way to their residence.
In Washington State “Registered Process Servers” are granted a
limited exemption or affirmative defense against trespassing:
The actor was attempting to serve legal process, which includes
any document required or allowed to be served upon persons or
property, by any statute, rule, ordinance, regulation, or court
order, excluding delivery by the mails of the United States. This
defense applies only if the actor did not enter into a private
residence or other building not open to the public and the entry
onto the premises was reasonable and necessary for service of
the legal process.
Deadlines
Most states have a deadline for completing service of process
after filing of the summons and complaint. In New York, for
example, service must be completed in 120 days after filing for
almost all cases.
Dies non juridicum
Some states prohibit the delivery or serving of documents on
Sundays, holidays, and/or election days (dies non juridicum).
However, some states will allow the service of documents under
special circumstances. One such circumstance is when the
service of process is pursuant to a court order.
According to various laws, service of process cannot be
performed on Sundays in Florida, Maine, Massachusetts, New
York, Rhode Island, South Dakota, Tennessee (unless with a
court order), Texas, Virginia, or West Virginia. It can also not be
performed on election days or at your place of religious service
on Sunday in Michigan, or on holidays in Minnesota. Finally, in
New York, process cannot be served on Saturday upon a person
who keeps Saturday as holy time.
Tips for Serving
Here are a few questions in checklist form that will make
each serving job much easier. Ensuring you have all of the
information you need to complete a job will enhance your
potential for ongoing work, and also reflects your
professionalism and willingness to complete jobs correctly and
thoroughly.
Tips for Good Process Service
1. Is the name, address and phone numbers correct and
complete?
2. Is both the work and home addresses and phone numbers
provided?
3. Does the person being served have any aliases or nicknames
that are known?
4. What kind of vehicle do they drive? Examples: Year, make,
model, color or other helpful identifiers.
5. Do you have a picture or physical description of the person to
be served?
6. Is there a specific time service should be made?
7. Have they been avoiding service or are they expecting and
agreeable to service?
8. Is this a routine or rush service? If this is a rush serve,
please call ahead before finishing the paperwork, so we can
arrange for the service
9. Can your papers be sub-served?
10. Double check the paperwork. Is everything stamped,
signed and spelled correctly?
