Speaker Publication Agreement
In mutual consideration of the preparation by the undersigned Speaker of a paper
presented as part of the 2015 Annual Institute of the Energy & Mineral Law Foundation (EMLF),
and of the agreement by EMLF to publish the papers of the Institute in collective form, to furnish
Speaker with a complimentary copy of said collected papers, and to sell and distribute the papers
individually or collectively in book form and/or through other means and media, Speaker and
EMLF agree as follows:
1.
The paper prepared by Speaker (the “Paper”) is a contribution to a collective work
to be published by the EMLF and shall be considered a work made for hire under the copyright
laws of the United States of America. In any event, Speaker hereby irrevocably conveys and
assigns all right, title and interest in the Paper to EMLF, subject to EMLF’s grant of the license
described in Paragraph 3.
2.
Speaker hereby warrants that the Paper is his/her original work, that he/she is the
sole owner of all rights in the Paper and that it does not violate any copyright, right of publicity
or other rights of any third party.
3.
EMLF hereby grants to Speaker a non-exclusive royalty-free license to use the
Paper for Speaker’s own purposes, including the rights to reproduce it, distribute it, publicly
perform or display it and create derivative works based on it, provided that the Speaker
acknowledges in writing in connection with any such copies, displays or derivative works that
the original work was first published by EMLF who owns the copyright and that the copy,
display or derivative work is being reprinted with the permission of EMLF. This license does not
include the right to sell copies of the Paper, in whatever form. The term of this license shall be
the duration of the copyright in the Paper to be held by EMLF.
