Regulations Governing Commissioned Management and Preservation of Historic Sites 古蹟委託管理維護辦法 中華民國九十年十一月七日內政部台(九十)內民字第九Ο七七八二七號令訂定發布 Article 1 These Regulations are enacted in accordance with Paragraph Three, Article 28 of the Cultural Heritage Preservation Act (hereinafter referred to as "the Act"). Article 2 The consigning agency for the management and preservation of a historic site (hereinafter referred to as “the/a site”) may consider the current condition and classification of the site as well as the will of the owner or manager along with goals and requirements for a site’s preservation when commissioning all or a part of the items listed in Article 29-1 of the Act to any other agency. Article 3 The central competent authority for national, First and Second-class historical sites may authorize administration and operating agencies to manage and preserve a site; and may, in absence of such agencies authorize the local municipal or county (city) government to manage and preserve the site. Article 4 The commissioned management and preservation of private historic sites must be conducted with the owner’s consent; and the owner, or a consignee, may be commissioned preferentially to conduct the management and preservation the site. If the owner or assigner is unwilling to accept the commission, the municipal or county (city) government may commission a public interest foundation to preserve and manage the site. Article 5 The consigning agency will determine the classification of the site as well as the scope of the project and term of commission for management and preservation. The term of commission will not exceed four (4) years but may be extended depending on the performance of the commissioned agency. Article 6 The consigned agency for the site will initiate and keep data on the preservation and management of that site; contents of said data must include: repair records, lists of contractors and traditional artisans under commission on the site as well as detailed descriptions, drawings, photos and lists of previous managers, properties and usage of the site. Article 7 Written contract shall be signed for commissioned management and preservation of historic sites. 1. A written contract must be signed for the commissioned management of all historic sites. 2. Written contracts for the commissioned management of all historical sites must be signed. 3. The commissioned management of a site must be ratified by a contract that has been signed by all relevant parties. Article 8 The Consignee will submit a report detailing incomes, expenditures and the results of the management and preservation of the site; said report will be submitted annually before the end of February to the consigning agency for the management and preservation of the site and then forwarded to the central competent authority for their records. Article 9 The administration and operating agency of public historic sites will record all management and preservation expenses for the site in their annual budget. Any level of the government may provide appropriate subsidies for the management and preservation of private historic sites. Article 10 These Regulations shall come into force as of the date of promulgation.
