A description of the action proposed or refused by the school district: The school district proposes that the three year reevaluation for special education services is conducted by a multidisciplinary team to determine whether a child continues to meet state criteria for special education services. 3. An explanation of why the school district proposes or refuses to take the action: Children receiving special education services are required to be reevaluated every three years by state and federal law, unless the parents and the school district agree that a reevaluation is not necessary. 4. A description of other options that the IEP team considered and the reasons why those options were rejected: The team could have agreed to waive the reevaluation, however, the team has decided that new evaluation information is appropriate at this time. 5. A description of each evaluation procedure, assessment, record or report the school district used as a basis for the proposed or refused action: Students will be reevaluated using student records, teacher reports, observations, and updated information. All tools used are in accordance to the procedures outlined in the Procedures and Guidance for Ohio Education Agencies Serving Children with Disabilities. 6. A description of other factors that are relevant to the school district’s proposal or refusal: At this time no other factors are relevant according to the multidisciplinary team. 7. Provision of procedural safeguards: As a parent of a child with a suspected or identified disability, you have procedural safeguard protection under the Individuals with Disabilities Education Improvement Act (IDEIA) of 2004. Upon initial referral for an evaluation or parent request for an evaluation, you will be given a copy of your procedural safeguards. You will also be given a copy of your procedural safeguards upon request, upon receipt of the first state complaint under 34 C.F.R. §300.151300.153 and upon receipt of the first due process request under 34 C.F.R. §300.507 in a school year and in accordance with the discipline procedures in 34 C.F.R. §300.530 (h).
