Defence Determination 2005/15, as amended to date. For previous amendments see Note to Defence Determinations 2010/1, 2, 3 and 4. 3 EXPLANATORY STATEMENT Defence Determination 2010/5 This Determination amends Defence Determination 2005/15, Conditions of Service (the Principal Determination), made under section 58B of the Defence Act 1903 (the Act). Chapter 5 of the Principal Determination sets out provisions dealing with leave, and Chapter 6 sets out provisions dealing with relocations on posting in Australia for members of the Australian Defence Force (ADF). The purpose of this Determination is to make the following changes. Amend the provision for recreation leave. Provide disturbance allowance rates for members with dependents (unaccompanied). Clause 1 of this Determination sets out the manner in which this Determination may be cited. Clause 2 of this Determination provides that the Determination commences on the day it is made, as provided by subsection 58B(4) of the Act. Clause 3 specifies that the amendment is made to the Principal Determination, as amended. Clause 4 amends subclause 5.2.26.1 of the Principal Determination to remove the word 'basic' in relation to recreation leave. The word 'basic' relates to a specific sub-type of recreation leave and limits the application of the provision to that form of leave. The amendment allows the clause to apply to all types of recreation leave. Clauses 5 and 6 amend the table in subclause 6.1.15.2 of the Principal Determination. Clause 5 removes item 1A of the table which provides the rates of disturbance allowance for a member with dependents (unaccompanied). Clause 6 amends item 2 of the table to include members with dependants (unaccompanied) to enable them to receive the disturbance allowance rates available to members without dependents. These changes provide the disturbance allowance rates to members with dependents (unaccompanied) when they have a removal on posting. Criteria are provided for the exercise of discretions under the Principal Determination, as amended by this Determination. Adverse decisions are subject to merits review under the ADF redress of grievance system, including an appeal to the Defence Force Ombudsman. Authority: Section 58B of the Defence Act 1903
