Updated on 20.11.2008 NATIONAL FOR THE TRUST WELFARE OF PERSONS WITH AUTISM, CEREBRAL PALSY MENTAL RETARDATION & MULTIPLE DISABILITIES (Ministry of Social Justice & Empowerment Government of India) Introduction Background of this Handbook under RTI Act, 2005 1.1 This handbook has been prepared in pursuance to Section 4 of the Right to Information Act, 2005 to provide information on National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation & Multiple Disabilities. Objective of this handbook 1.2 To provide/access information from the National Trust set up for the welfare of persons with Autism, Cerebral Palsy, Mental Retardation & Multiple Disabilities. Intended users 1.3 Persons with disabilities, parents, guardians, voluntary organizations working for the welfare of persons with Autism, Cerebral Palsy, Mental Retardation & Multiple Disabilities. Organization 1.4 National Trust for the Welfare of Persons with Autism, Cerebral Palsy Mental Retardation & Multiple Disabilities Ministry of Social Justice & Empowerment Definitions 1.5 a) National Trust Act means National Trust Act for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation & Multiple Disabilities Act, 1999. b) “PWD Act” means Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 c) “Autism” means a condition of uneven skill development primarily affecting the communication and social abilities of a person, marked by repetitive and ritualistic behaviour; d) “Board” means Board of trustees constituted under Section 3 of the National Trust Act.1999 e) “Cerebral palsy” means a group of non-progressive conditions of a person characterized by abnormal motor control and posture resulting from brain insult or injuries occurring in the pre-natal, peri-natal or infant period of development; f) “Chairperson” means the Chairperson of the Board appointed under clause (a) of subsection (4) of section 3 of the National Trust Act. g) “Chief Executive Officer” means the Chief Executive Officer appointed under subsection (1) of Section 8 of National Trust Act. h) “Member” means a Member of the Board of the National Trust and includes the Chairperson. i) “Mental Retardation” means a condition of arrested or incomplete development of mind of person which is specially characterized by sub-normality of intelligence. j) “Multiple Disabilities” means a combination of two or more disabilities as defined in clause (i) of Section 2 of the PWD Act. k) “Persons with Disability” means a person suffering from any of the conditions relating to autism, cerebral palsy, mental retardation or a combination of any two or more of such conditions and includes a person suffering from severe multiple disability l) “registered organization” means an association of persons with disability or an association of parents of persons with disability or a voluntary organization, as the case may be, registered under Section 12 of the National Trust Act. No fee is charged for filing of the request and providing of information. However, the cost of each book/ printed material shall be charged on actual basis. Chapter - 2 2.1) Objectives / Purpose of the Public Authority The National Trust is a statutory body under the Ministry of Social Justice and Empowerment, Government of India, set up under the Ministry of Social Justice & Empowerment for the welfare of persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities” Act (Act 44 of 1999). The basic objectives of the National Trust are: a) to enable and empower person with disability to live as independently and as fully as possible within as close to the community to which they belong; b) to strengthen facilities to provide support to persons with disability to live within their own families; c) to extend support to registered organizations to provide need based services during period of crisis in the family of persons with disability; d) to deal with problems of persons with disability who do not have family support; e) to promote measures for the care and protection of persons with disability in the event of death of their parent or guardian; f) to evolve procedures for the appointment of guardians and trustees for person with disability requiring such protection; g) to facilitate the realization of equal opportunities, protection of rights and full participation of persons with disability; and h) to do any other act which is incidental to the aforesaid objects. 2.2) MISSION STATEMENT The National Trust Believes in1. Their Right to a life of quality, dignity, equality and justice. 3. Their Right to family life. 4. Their Right to protection, care and guardianship. The National Trust is committed to facilitate1. Opportunities that empower and enable persons with disability through training, care, income and social inclusion. 2. Ways and means of strengthening families. 3. Environments that are free from physical, informational and psychological barriers. 4. Ideologies and societies that are inclusive in nature. 5. Programme that are affordable, accessible and available. These will be achieved through1. Partnership between Governments, people with disabilities, their families, voluntary organizations and civil society. 2. Development ofa) Self help groups b) District level bodies c) Sustainable services d) Information services e) Networks and multisectoral linkages 3. Convergence with mainstream developmental programmes in the communities. VISION STATEMENT The National Trust is dedicated to the creation of a nation-wide movement, which will lead to affirmative action for the protection, care, and inclusion of persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities within or close to their own communities. Social, Financial, emotional and physical security of a comprehensive nature is the ultimate goal of the National Trust. In furtherance of this goal, the National Trust will strive for pervasive social change which permeates into mainstream activities of community life so that persons with these disabilities in India can lead a life of quality, dignity, and justice in societies which are free from bias, prejudice, stigma and discrimination. A society which puts the person ness of disabled people first, is the larger vision of the National Trust. 2.3) The National Trust was set up in the year 2000 for the welfare of persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act 44 of 1999 is committed, inter alia, to providing protection, shelter and care of persons with these four disabilities. 2.4) The National Trust is the Government’s response to the needs of persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities. The Government is increasingly concerned about the needs for more affirmative action in favour of these persons. The Trust aims to reach not only disabled persons but also to their families by providing a comprehensive range of benefits, training and services. 2.5) 1. The working of the National Trust is instrumentalized through Local Level Committees headed by District Collectors, with a member each from disabled persons and NGOs. 2. The National Trust is operational through voluntary organizations including parents associations. 3. Promoting the benefits of the Legal Guardianship for the persons having these four disabilities 4. Grant-In-Aids was provided under Reach and Relief Scheme in favour of 113 centers for running Respite Care, Day Care and Prolonged Care Centers. 2.6) The services are being provided by the National Trust are as under:1. Constitution of Local Level Committees (LLC) at district level headed by District Collector with a member each from NGO and a person with disability. 2. The National Trust provides financial support under following schemes:a. Reach and Relief Scheme as supported under under113 Day Care, Respite Care and Prolonged Care Centers in the country. The scheme was operational upto 31.03.2005 and in place of this scheme new scheme was introduced during the current financial year namely “SAMARTH-CENTER BASED SERVICES” for providing financial assistance to Respite Care and Prolonged Care Centers. b. Samarth (Centre Based) Scheme: This scheme has been launched in the year 200506. As on 31.3.2008, 115 projects are running throughout the country c. The Community Based Caregiver Training Scheme aims to fill the gap between the disabled persons and their families for external support in care giving in the larger context of the communities in which they live. d. Supported Guardianship provides financial security to severely disabled persons who are destitute and abandoned by supporting the cost of guardianship. The scheme will be closed w.e.f. 1.4.2009. e. State Nodal Agency Centers (SNAC) – One SNAC in each State and State Nodal Agency Partners have been set up to provide coordination assistance for implementing the activities of the National Trust at a faster pace to reach maximum number of people specially parents and siblings. As on October 2008, there are 28 SNACs and 38 SNAPs. f. Aspiration (Day Care Centre) Scheme – The aim of the scheme is to work with children 0-6 years with developmental disabilities, to make them ready for mainstream and special schools. This is an early intervention programme. This scheme was launched during 2007-08. g. Remote Area Funding Scheme - The main aim of the scheme is to stimulate National Trust activities in unrepresented districts and awareness generation amongst parents of persons with disabilities, its family members & related Govt. officials/teachers & facilitation of services. h. Gyan Prabha (Scholarship) Scheme provides scholarship to encourage persons with Autism, Cerebral Palsy, Mental Retardation & Multiple Disabilities for pursuing post schooling any vocational training/professional courses for enhancement of their skills. i. The income generated from this corpus is being utilized to achieve the objects of the National Trust, for which it was conceived by the Govt. of India. The National Trust started functioning from the year 2000 and has been in existence for the last 5 years. The Trust has been providing financial assistance in the shape of grant-in-aid to NGOs for the welfare of persons with these 4 disabilities. The National Trust has for the purpose introduced various schemes after obtaining prior approval from the Govt. of India. The details of each scheme are given as under: - 1) Reach and Relief Scheme:- This was a pilot scheme for providing of grant-in-aid to NGOs for running of Day Care, Respite Care and Prolonged Care Centers for the beneficiaries under 4 disabilities. The scheme was introduced and implemented in the year 2001and was in operation up-to March 2005. The National Trust has funded 100 organizations and during the operational period an amount of Rs.13,55,87,101/- was released for meeting the cost of both Recurring and Non-recurring items of the institution concerned. The National Trust has introduced a new scheme namely “SAMARTH – CENTER BASED SERVICES” in place of this scheme for both short term and long term (Prolonged Care) services for the welfare of persons having the 4 disabilities. 2) Samarth (Centre Based) Scheme: This scheme has been launched in the year 2005-06. As on 31.3.2008, 115 project are running throughout the country. 3) Community Based Caregivers Training:- The scheme was introduced by the National Trust for filling up the gap between the needs of the disabled persons and their families, visà-vis need for external support in the shape of imparting of training, post-training follow-up and close liaisoning with the families through caregivers trained in the 4 disabilities. The National Trust has helped in providing training to 184 Master Trainers under various levels like I, II and III since the introduction of the scheme, an amount of Rs.11,30,626/- has been spent for training of these personnel in the country. 4) Supported Guardianship:- The scheme was introduced with the main object for providing financial support to severely disabled persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities, who are destitute and abandoned by supporting the cost of guardianship for the above mentioned group within their own communities. Under the scheme, the National Trust has so far disbursed an amount of Rs.8,31,000/-. 5) State Nodal Agency Center:- The National Trust in order to propagate its activities has appointed 22 NGOs in various States of the Country to function as Information Centers, project mentoring, training centers and networking in respect of these 4 disabilities. By appointing the State Nodal Agencies, the working of the National Trust has got huge fillip as a multiplicative effect is taking place all across the country. The State Nodal Agency Centers appointed in the year 2003-04 have trained a large number of persons, conducted 52 Workshops, 103 Rural Awareness Programme in remote areas and imparted training to 67 parents and siblings. An amount of Rs.65,91,310/- has been released by the National Trust for the purpose. This scheme has been revised and now in addition to a SNAC in every State/UT there are State Nodal Agency Partners. So far 28 SNACs and 38 SNAPs have been appointed through out the country. Besides, to ensure an institutional arrangement for regular interaction and cooperation with the State Government and district level functionaries, State Level Advisory Committees under the Chairpersonship of Secretary, SW of the concerned States have been constituted in all the States. 6. Niramaya a health insurance scheme has been launched under which insurance cover upto Rs. 1.0 lakh is available to persons with Autism, Cerebral Palsy, Mental Retardation & Multiple Disabilities for a variety of health services ranging from OPD to cashless hospitalization. The scheme is free for persons having family income upto Rs.15000/- and others may join the scheme on payment of an amount of Rs.200/- p.a. only. Initially the scheme was launched on pilot basis expecting to cover 1.0 lakh persons with disabilities in 10 districts of the country. Now the scheme is available for the whole country (excluding J&K). 7. Two schemes, namely, (i) Aspiration – School Readiness Programme (Day Care Centre Scheme) and (ii) Remote Area Funding have been launched and funds have been released to the NGOs Chapter – 16 Activities of the National Trust are available on its website.
