CONTRACT in accordance with Article 5 in connection with Article 35 (3) (f) of
Regulation (EC) Nr. 1013/2006 of the European Parliament and of the Council of 14
June 2006 on shipments of waste (Regulation (EC) No 1013/2006) for disposal of
waste
Subject of this contract is the delivery of

Quantity of waste in kilogram or liter

designation and composition of the waste

waste identification/relevant code of EC-list of wastes

relevant entry according to Annex III, IIIA, IIIB, IV or IVA of Regulation (EC) No 1013/2006
This contract is effective until certificates have been issued that the disposal has
been completed for all shipments of waste having taken place within the scope of
this notification.
This contract includes the obligations
1) on / on the
Name and address of the notifier
to take the waste back if the shipment or the disposal has not been completed as
intended or if it has been effected as an illegal shipment, in accordance with
Article 22 and Article 24(2) Regulation (EC) No 1013/2006;
2) on / on the
Name and address of the consignee
a) to recover or dispose of the waste if it has been effected as an illegal
shipment, in accordance with Article 24 (3) EC-Shipment Regulation;
b) to bear the costs arising from the duty to return the waste to the area of
jurisdiction of the competent authority of dispatch and from its recovery or
disposal in an alternative and environmentally sound manner, if the

issues an incorrect certificate of disposal with the consequence that the
financial guarantee is released;
c) to ensure that the

i. sends within three days of receipt of the waste for disposal signed
copies of the completed movement document, except for the certificate
of disposal (that means except for the certificate according to field No
18 of the movement document), to the notifier and to the competent
authorities concerned;
ii. certifies under its responsibility no later than 30 days after completion
of disposal, and no later than one calendar year following the receipt of
the waste, that the disposal has been completed and sends signed
copies of the movement document containing this certification (that
means containing the certificate according to field No 18 of the
movement document) to the notifier and to the competent authorities
concerned.
