I am a landscaper and I will be storing compost/blending it with topsoil at my own facility
and transporting this compost for use in landscaping projects. Is there a requirement for my
facility to be registered and to be on the transport register? Blending compost with topsoil
does not constitute a “mixing, blending” OFSI plant, so the landscaper does not need to
register his facility. The landscaper does not need to register as an OF/SI end user either if he
does not keep farmed animals. If transportation is from the facility directly to the landscaping
project, the landscaper does not need to register as an ABP haulier.
If I am a landscaper and I take compost directly from a compost plant for use in landscaping
projects, do I have to be on the transport register? Landscapers do not need to register as ABP
hauliers as long as they have no farmed animals. If the composting plant transports compost
to the landscaper in one of its trucks, it must be registered as an ABP haulier. If a haulage
company transports the compost, it must be registered as an ABP haulier.
If I am a landscaper retailing compost bags less than 50kg, do I have to register my facility?
There is no requirement under the ABP Regulations to register this premises because it is
retailing bags under 50kg.
If I am a landscaper retailing compost bags greater than 50kg do I have to register my
facility? Yes, registration is required because the premises is retailing bags that weigh over
50kg.
If I am a garden centre retailing compost in bags less than 50kg is there a requirement for my
facility to be registered? There is no requirement to register this premises because it is
retailing bags under 50kg.
If I am a garden centre retailing compost in bags greater than 50kg is there a requirement for
my facility to be ‘registered’? Yes, registration is required because the premises is retailing
bags that weigh over 50kg.
If I am a tillage farmer or grow vegetables commercially and farmed animal do not have
access to these premises, what requirement do I have to comply with? The tillage farmer and
commercial vegetable grower are OF/SI end users and do not require registration under the
animal by-products legislation if no farmed animals are kept at the holding. However, the
commercial vegetable grower may have further responsibilities as a food business operator
and should contact the Horticulture and Plant Health Section in DAFM at Backweston, Co.
Kildare.
