Supreme Court Agrees with Firefighters
On June 29, 2009 the Supreme Court upholds lower court (by a
vote of 5-4) that New Haven's decision to ignore the test results
violated Title VII of the Civil Rights Act of 1964 in Ricci v.
DeStefano. The complaint in a nutshell: Firefighters (white and
Hispanic) took a tests for promotions and passed but the
city abandoned the test results because no black
firefighters passed. Read more here.
HIRING THE WRONG EMPLOYEE
CAN COST YOUR COMPANY $$$!
Employees are both your greatest asset and your greatest
liability. Now more than ever it is important to find out
BEFORE hiring an employee if they are the right match for
your company AND the position.
The wrong employee can create a negative work
environment, exploit sick leave and other benefit programs,
drop the ball on the job and leave you hanging by quitting
with no notice. The wrong employee can be the one you
spend all your time "handling" and create more work instead
of less.
Here are some strategies to help you avoid the wrong
employee and hire the right employee:
·
Don't hurry to hire. You need time to consider all
options and find the right employee. Even if it means
overtime for other employees, hiring an independent
contractor or outsourcing the work until you find the right
person to hire. The time and money spent to find the right
person is nearly always less than hiring the wrong person
(not to mention less headaches).
·
Make your employment application thorough; make
sure it contains an "at-will" clause, an Equal Employment
Opportunity (EEO) statement, and an authorization for
reference checks and pre-employment testing if given. Get
great ready-to-use employment applications on BernieNet
under the Hiring tab. DeemHR also provides a huge
selection of pre-employment testing (discounted prices to
HRNet members, see below).
·
Carefully screen applicants using pre-interview
questionnaires and standardized interview questions
(this helps any possible discriminatory allegations, which
difficult economic times may increase). HRNet has many
sources for interview information; BernieNet under Hiring
tab and HRThatWorks also has several resources.
·
Take the time to conduct reference checks on past
employers, and background checks on driving, criminal and
credit records when appropriate. If you don't feel qualified to
do this, hire an outside agency to do it for you. Now more
than ever this is an important step. Be sure to read the
checklist about this on BernieNet under the Hiring tab.
