1 FUJIFILM AUSTRALIA PTY LTD ABN 80 000 064 433 Instax Competition: Which Instax are you? ("Competition") Terms and Conditions 1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the Competition is deemed acceptance of these Terms and Conditions. 2. The promoter is FUJIFILM Australia Pty Ltd, ABN 80 000 064 433, of 114 Old Pittwater Road, Brookvale, NSW 2100 ("Promoter"). 3. Subject to paragraph 4 below, entry is only open to residents of Australia who attend the Digital Show 2013 at the Melbourne Exhibition Centre on 13th, 14th or 15th September 2013 (“Digital Show”). Employees of the Promoter and its agencies associated with this Competition and their immediate families are not eligible to enter this Competition ("Entrants"). 4. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter the Competition. The parent or guardian may be called to verify consent and may be required to sign a release at the discretion of the Promoter. The release will also require the winner’s parent or guardian to accept responsibility for the acts and forbearances of the winner. The release must include the full name, address and telephone number of the winner’s parent or legal guardian. Failure to provide such proof, particulars or releases will immediately invalidate the winner’s entitlement to the prize, subject to State legislation. 5. The Competition runs from 10am (AEST) to 5pm (AEST) on 13th, 14th and 15th September 2013 (“Competition Period”). 6. To enter the Competition and to be eligible to win a prize, Entrants must, during the Competition Period: a. fully complete the online Competition entry form available at the FUJIFILM stand at the Digital Show during the Competition Period, including replying in 25 words or less to the question “Which Instax are you?” to indicate whether the Entrant prefers FUJIFILM’s Instax Mini 8 camera or Instax Mini 90 camera and the reasons for their preference; and, b. otherwise comply with these Terms and Conditions ("Competition Entry"). 7. Only one Competition Entry per person is permitted. Any Entrant who submits more than one Competition Entry will have all entries apart from their original Competition Entry deemed invalid. 8. Entries will be deemed to be accepted at the time of receipt of the Competition Entry and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. If an Entrant's contact details change during the Competition Period, the Entrant must promptly notify the Promoter of the relevant change. A request to access or modify D:\533562367.doc 2 any information provided in a Competition Entry should be in writing and directed to the Promoter. 9. This is a game of skill and chance plays no part in determining the winners. All Competition Entries will be judged according to originality and creative merit. By entering the Competition each Entrant warrants to the Promoter that each entry submitted is an original creative work of the Entrant which does not infringe the rights of any third party. The Entrant agrees to indemnify the Promoter, its related entities and its officers, employees and agents, against all claims and costs by third parties arising from a breach of the warranty set out in this paragraph 9. Entries must not have been published previously and/or have been used to enter other competitions or win prizes in any other competitions. 10. There are a total of 2 prizes to be awarded in the Competition to the best 2 entries. The prize winners will be selected according to the originality and creativity of their response to the question, “Which Instax are you?” (reference to paragraph 6(a)). Judging will take place at the offices of the Promoter at 114 Old Pittwater Road, Brookvale, NSW 2100 by Monday 30th September, 2013. 11. The 2 winners will each have the choice of receiving either a FUJIFILM Instax Mini 8 camera (RRP $99.00) or a FUJIFILM Instax Mini 90 camera (RRP $199.00). 12. If a winning entry is deemed by the Promoter not to comply with the Terms and Conditions, the entry will be discarded and a new winner will be determined from those entries eligible to receive a prize. 13. The prize winners will be notified by email on or before Wednesday 2nd October 2013. Notice of the prize winners will also be published on the Promoter’s Facebook page after the winners have been contacted. 14. The total prize value is up to AU$398.00 (including GST). Prize value is based on the prize RRPs and is subject to change. The Promoter accepts no responsibility for any variation in the prize value. 15. The prize, in whole or in any part, is not transferable and is not exchangeable or redeemable for cash, goods or services. 16. The Promoter and their agencies associated with this Competition, accept no responsibility for prizes, prize information or for prizes lost in transit. 17. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. 18. To the extent permitted by law if the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value. 19. If the prize winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian. D:\533562367.doc 3 20. If a prize remains unclaimed by 10:00am (AEDST) on Friday 11th October 2013, an unclaimed prize winner selection will take place at the offices of the Promoter. In such event, the original winner will forfeit the prize and the prize will be awarded to the entry judged next best. The new winner, if any, will be contacted by email. 21. The decision of the Promoter in relation to the conduct of the Competition and the prize winners is binding and final and the Promoter will not enter into any correspondence regarding the Competition result. 22. The Promoter reserves the right to require the prize winner to provide proof of identification and/or proof of residency or address details in order to claim the prize. Proof of identification, residency and address considered suitable for verification is at the discretion of the Promoter. If the prize winner cannot provide suitable proof, the prize winner will forfeit the prize in whole and no substitute or cash will be awarded in lieu of the prize. 23. The Promoter reserves the right to disqualify any Competition Entry which, in the opinion of the Promoter, contains objectionable content, profanity, potentially insulting, or defamatory statements or if the Competition Entry does not comply with these Terms and Conditions. The Promoter also reserves the right to, in its sole discretion, disqualify any Entrant whom the Promoter believes has tampered with the entry process or has engaged in conduct in relation to the Competition that the Promoter believes to be fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter. 24. The prize winner must comply with all the conditions of use of the prize and the prize supplier's requirements. 25. To the extent permitted by law, no responsibility will be accepted by the Promoter, their related bodies corporate, employees, associated agencies or suppliers to the Promoter (together the "Parties") for any late, lost or misdirected entries or for any claim arising from the conduct of the Competition. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the Entrant cannot be contacted during business hours on the relevant dates. 26. To the extent permitted by law, the Parties will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, misadventure, accident, personal injury, death, damage or claim which is suffered or sustained (whether or not arising from any person’s negligence) in connection with: a. the Competition or any prize won; b. any act or omission (whether negligent or not) of the Parties, or any person associated with any of them; or c. any circumstances outside the Parties’ reasonable control. 27. To the extent permitted by law, if for any reason this Competition is not capable of running as planned, due to causes beyond the control of the Promoter, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, D:\533562367.doc 4 fraud or technical failures, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, and recommence it from the start on the same conditions subject to any government regulation. 28. In the case of the intervention of any outside person or event which changes the result or prevents or hinders the determination of the Competition, including but not limited to vandalism, power failures, tempests, acts of terrorism, natural disasters, civil unrest, strikes or any other event beyond the control of the Promoter; the Promoter may in its discretion cancel, terminate, modify or suspend the Competition and recommence it from the start on the same conditions subject to any government regulation. 29. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages.
