We distributed EPC Exhibit 130-20.2 Electronic commerce in 381, 658.8, and 343 during
EPC meeting 130 and promised to bring it back for proper discussion at meeting 131.
We are bringing it back with only one change in response to a comment from Deutsche
Nationalbibliothek about the original discussion of law of electronic commerce in EPC
Exhibit 130–20 (October 24, 2008). At the end of this exhibit is an appendix with the
relevant portion of EPC Exhibit 130–20.

Comment:
We agree that comprehensive works on the law of e-commerce be classed in 343.0811.
However, comprehensive works on contracts in e-commerce should still be classed in
346. We suggest that a note should be added to the new e-commerce notation “Class
comprehensive works on law of contract in electronic commerce in 346.0202854678.”
Response:
We agree with Deutsche Nationalbibliothek that “comprehensive works on contracts in ecommerce should still be classed in 346”; however, we believe that the appropriate
number in 346 is 346.07 Commercial law, which has the note, “Class here commercial
contracts . . . .” Because the class-here note has hierarchical force, sales contracts are
classed in the subdivision 346.072 Sale. Immediately below the interdisciplinary number

for contracts, 346.02 Contracts and agency, is a centered entry for contracts, 346.022–
346.025 Contracts. Under that centered entry are the notes “Class sale in 346.072” and
“Class contracts dealing with a specific legal aspect not provided for here with the aspect
in 342-347, e.g., partnership contracts 346.0682.”
We do not believe that notation 0285+ from Table 1 should be added at 346.07 or
346.072 to mean contracts in electronic commerce. We do not find literary warrant for
developing special provisions for contracts in electronic commerce. We therefore
propose to modify our November 18, 2008, proposal by adding the note at 343.08: “class
commercial contracts in 346.07.” The record below shows that newly proposed change
plus changes proposed in the November 2008 exhibit.

In EPC Exhibit 130–20 340 Law: Discussion paper on selected topics, we considered
electronic commerce (pages 6–8) and promised to bring a proposal for discussion at EPC
Meeting 130. In preparing this proposal, we have tried to give parallel development for
electronic commerce under 381 Commerce (Trade), 658.8 Management of marketing,
and 343.08 Regulation of commerce (trade). Since the interdisciplinary number for
commerce is 381, we have been especially mindful of its structure and wording.
At 381 Commerce (Trade), marketing is a class-here concept. Only management of
marketing is classed in 658.8. To parallel the structure at 381, we propose to discontinue
343.084 Marketing to 343.08 Regulation of commerce (trade) and put “marketing” in the
class-here note at 343.08. We cannot find literary warrant to justify a separate number
for law of management of marketing.
We propose to change the caption at 381.1 from “Marketing channels” to “Retail trade,”
the caption it had in DDC 21. Both concepts are classed there in DDC 22; we are just
switching what is in the caption and what is in the class-here note. Upon reflection, we
believe that in general it is more important for the captions to emphasize where retail
trade is classed than where marketing channels are classed. To maintain parallelism, we
propose to make the corresponding change from “Marketing channels” to “Retail
marketing” for the caption at 658.87. We propose to retain the caption “Retail trade” at
343.0811 and put “marketing channels” in the class-here note at that number.
At both 381.1 and 658.87, specific wholesale marketing channels go with the retail
channels, while general works on wholesale trade or wholesale marketing go in another
number (381.2 Wholesale trade and 658.86 Wholesale marketing). To parallel that
pattern at 343.08, we propose to relocate wholesale trade through specific marketing
channels from 343.0812 to 343.0811.
To provide for electronic commerce, we propose to make it the main topic at a number
that has a caption like “Electronic commerce; mail-order, telephone-order, television
shopping” (343.081142, 381.142, and 658.872). That means changing the captions at
381.142 and 658.872. We also propose subdivisions with captions like “Mail-order,
telephone-order, television shopping” (343.0811428, 381.1428, and 658.8728). We
propose putting the subdivisions on x8 because we think that in the future we may need
to subdivide for specific topics of electronic commerce.
At 658.872 we propose to delete mention of “pyramid marketing” because it is illegal in
many jurisdictions.
In deciding what to underline or present in strikethrough in the following proposal, we
have used the most recent version available to EPC; in other words, we are not marking
changes that have already been presented to EPC elsewhere. For 343 we are using
current DDC 22. For 381 we are using a version that is close to DDC 22 but that has
changes approved in EPC exhibit 128-23.1. For 658, we are using the version given in
EPC Exhibit 130-27.1, a PDF that has been presented but not yet approved.

Appendix. Law of electronic commerce (from EPC Exhibit 130–20,

Federica Paradisi (Italian National Bibliography) pointed out the need to provide for law
of electronic commerce. A copy of her note appears as an appendix to this exhibit. A
search in WorldCat on dd:343* and (su=electronic commerce) yields 665 hits.
We plan to propose a new subdivision for electronic commerce under 343.0811 Retail
trade. We plan to parallel the development at 381.1 Marketing channels (which has the
note “Class here retail trade”); however, we will first need to update that development.

and television commerce. Now electronic commerce is starting to overwhelm these
numbers and really needs to be separated. For example, here are some WorldCat

Appendix: Message from Federica Paradisi (Italian National Bibliography)
Electronic commerce
We ask for your assistance on a law issue not exclusively concerning the civil law, i.e.
electronic commerce law and legislation. This subject, that is not present in the DDC22
printed Edition, is mentioned in WebDewey but only associate with 380, and 650.
There are many publications on the electronic commerce law (more than 270 in our
OPAC) but it is not clear where to classify such publications (see also the online
catalogue of LofC and WorldCat where the works on this subject are classified both in
343.07 and 343.0994, and hardly ever in 343.08).
This last number is more frequently used by the BNI, if you consider that the subject
material usually includes such topics as commercial contracts, consumer protection, law
of competition in internet, advertising, intellectual property, the privacy law, means of
fund transferring, etc. topics traditionally covered by commerce legislation.
Another issue would be regarding the addition of the standard subdivision 0285’4678,
which seems to be corrected if added to the two abovementioned numbers 380 and 658,
but not when added to law numbers, e.g., 343.4508028446, when decoded, if read from
right to the left, would mean: Data processing or Internet applications of/to law of
commerce. The electronic procedures with Internet does not apply to the law, simply to
commercial operations. Internet is only the means of accomplishing the commercial
procedures.
Once the appropriate number has been decided, we feel that it would be necessary to
include the topic “electronic commerce” within the 340 schedules with cross references

between 343.0994 and 343.08 in order to give useful indications to classifiers. We also
would like to enrich the entry in the Relative Index, with the subheading (Electronic
commerce -> law).
