In exercise of the powers conferred by Article 73 of the Articles of
Association of Punjab Small Industries and Export Corporation Limited, the Directors of the
Corporation hereby make the following bye-laws to regulate the recruitment and conditions
of service of persons appointed to various posts of officers and other employees under the
Corporation namely:THE PUNJAB SMALL INDUSTRIES & EXPORT CORPORATION EMPLOYEES
SERVICE BYE- LAWS.
CHAPTER-I
PRELIMINARY:
1.1
These bye-laws may be called the Punjab Small Industries & Export Corporation
Employees Service Bye-Laws.
1.2
These bye-laws shall take effect from the 17th July 1965.
1.3
These bye-laws shall apply to every officer or other employee of the Corporation.
In these bye-laws, unless there is anything repugnant in the subject or context:-
a)
“ The Board” means the Board of Directors of the Punjab Small Industries & Export
Corporation Limited, Chandigarh;
b)
“Chairman” means the Chairman of the Board;
c)
“Bye-Laws” means the Punjab Small Industries & Export Corporation Employees
Service Bye-Laws for the time being in force;
d)
“Corporation” means the Punjab Small Industries & Export Corporation Limited,
represented by the Board of Directors or duly authorised officers of the Corporation;
e)
“Direct appointment” means an appointment made other-wise than by promotion or
transfer of a person already in the service of the Corporation or made by taking a
person on deputation from the Government or any other Corporation;
f)
“Duty” means the period of service which counts for pay, leave and other
emoluments, but does not include any period of suspension or extraordinary leave
without pay;
g)
“Employee” means a person (whether an officer or any other employee) employed
on any post under the Corporation, but does not include except for the purpose of
disciplinary action, a casual worker or a daily wage earner;
h)
“The Government “ means the Punjab Government in the Industries Department;
i)
“Honorarium” means the recurring or non-recurring payment granted to any person
from the funds of the Corporation;

j)
“Managing Director” means the Officer appointed by the Government to be the
Managing Director of the Corporation;
k)
“Permanent employee” means an employee appointed on a permanent basis
against a permanent post;
l)
“Probationer” means an employee provisionally employed to fill a permanent
vacancy on probation for the period specified in bye-law 3.1(h);
m)
“Temporary employee” means an employee appointed for a limited period for work
which is essentially of a temporary nature or appointed against a temporary post or
vacancy for a specified or unspecified period;
n)
“Posts” means the posts specified in Schedules ‘A’ and ‘B’ of the Bye-Laws;
o)
“Appointing Authority” means the authority competent to make appointment.
CHAPTER-II
NUMBER AND CHARACTER OF POSTS UNDER THE CORPORATION
2.1
The Board shall have power to make, from time to time such additions, deletions,
alterations or amendments in these bye-laws as it may deem fit and relax any of the
provisions contained therein.
2.2
For the purposes of these bye-laws, the posts under the Corporation shall be
classified into the following two categories namely:a)

Officers.
Other employees ;
2.3
The Board may direct that any post under the Corporation shall belong to category
(a) or category (b).
2.4
There shall be permanent as well as temporary posts under the Corporation; such
posts as are in existence immediately before the enforcement of these bye-laws are
specified in Schedules “A” and “B” respectively appended to these Bye-Laws.
Provided that the Board shall have the right to add or to reduce the number of such
posts or creates new posts with different designations and scales of pay whether on
a permanent or temporary basis.
2.5
All posts under the Corporation sanctioned from time to time shall, with the approval
of the Board be deemed to be added in either Schedule “A” or Schedule “B” as the
case may be.
2.6
The posts in Scheduled ‘B’ shall be reviewed by the Board at least once every year
in the month of April in order to decide which of them could be made permanent and
carried over to Schedule ‘A’.
Note: Schedule ‘A’ and ‘B’ indicate the posts existing as on 30-6-1971.

2.7
No person shall be appointed to any post under the Corporation unless he is:a)
b)
c)
d)
e)
a citizen of India ; or
a subject of Sikkim; or
a subject of Nepal; or
a subject of Bhutan; or
a Tibetan refugee who came over to India before the Ist January, 1962 , with
the intention of permanently settling in India or
f)
A person of Indian origin, who has migrated from Pakistan with the intention of
permanently settling in India
Provided that a candidate belonging to categories (b), (c), (d), ( e) and (f) shall
be a person in whose favour a certificate of eligibility has been given by the
Competent Authority, and if he belongs to category (f) , the certificate of eligibility
will be issued for a period of one year after which such a candidate will be retained
in service subject to his having acquired Indian citizenship
2.8
The power to interpret these bye-laws shall vest in the Board who shall also
be empowered to issue administrative instructions to the Managing Director to
enforce these bye-laws and to secure effective control by devising subsidiary rules,
delegation of powers, procedure or forms subject to revision by the Board at any
time suo-moto or on representation by an employee.
CHAPTER-III
RECRUITMENT AND RETIREMENT
3.1
RECRUITMENT:
a)

Recruitment to the various posts under the Corporation shall be made by the
Board by any one or more of the following methods;
i)
ii)
iii).
by direct appointment ; or
by deputation from Government or any other Corporation ;
by promotion of existing personnel or by transfer from one post to
another.
i)
Managing Director can make appointment to all posts specified
in Schedule “A” & “B” of the Service Bye-Laws.
Appointments to all posts under the Corporation shall be made by the
Board of Directors subject to delegation of Powers to the Managing
Director or any other subordinate authority.
ii)
c-i).
The Board/Appointing Authority may prescribe for various post under the
Corporation the qualification ,whether academic, technical or otherwise, or
tests or physical standards or any experience that it may consider necessary
and expedient for the efficient discharge of duties or conditions for
confirmation, promotion or continuance in service.
**ii)
Managing Director can prescribe for various posts carrying pay
scale up
to Rs. 3700/- or less and with the approval of Chairman for other posts under
the Corporation the qualification, whether academic, technical or otherwise
tests or physical standards, or any experience that he may consider
necessary and expedient.

d).
The age of a person, at the time of direct appointment to a post under the
Corporation, shall not exceed 35 years.
Provided that the Board may in specific cases relax this condition having regard to
the Qualification and experience of the candidate.
e)
No person, who has been dismissed from any public or private employment or has
otherwise ceased to be in the service of the Corporation, shall be re-employed
except with the express approval of the Board.
f)
The direct appointment of every person to any post under the Corporation shall be
subject to production by such person of a medical certificate of fitness from a
registered medical practitioner or the Medical Officer of the Corporation.
g).
All appointments shall, in the first instance, be on probation in respect of permanent
posts and on temporary basis in respect of temporary posts.
*h). Persons appointed in service whether through direct recruitment or by promotion,
shall remain on probation for a period of one year which may be further extended by
the appointing authority, provided the total probation period including extension, if
any, does not exceed two years.
i)
If , at the expiration of the period of probation the work of a probationer is found to be
satisfactory the appointing authority shall confirm him.
Provided that the appointing authority may in its discretion confirm him either
from the date next after the date of expiration of the period of probation or from the
date of his first appointment on probation.
j)
The period of temporary service against a permanent post shall be treated as part
of the period of probation, if it is followed by confirmation.
k)
Temporary service against a temporary post subsequently made permanent, will be
counted towards probationary period for purposes of confirmation.
3.2
Termination of Service.
The services of an officer or other employee of the Corporation may be terminated
by the Appointing Authority:-
i)
In the case of permanent officer or other employee by giving three months notice
on either side or, in lieu thereof, pay for the period the notice falls short of three
months.
ii)
In the case of temporary officer or other employee by giving one months notice on
either side or, in lieu thereof, pay for the period the notice falls short of one month,
and
iii)
In the case of an officer or other employee, on deputation from the Government or
any other Corporation by reverting him to his parent services

3.3
RECORD OF SERVICE
The following record of service of every officer and other employee shall
be
maintained:i.
Personal File.
ii.
Service Book and
iii.
C.R. File.
Note:Files at Nos. (i) and (ii) shall be maintained by the office and the file at No.
(iii) shall remain in the personal custody of the Managing Director or an
officer authorised by him.
3.4
a)
SENIORITY & PROMOTION :
Seniority:
The Inter-se-seniority of persons appointed to posts carrying the same scale
of pay shall be determined by the dates of their substantive appointments to such
posts:
Provided that if two or more persons are substantively appointed to such
posts on the same date, their seniority shall be determined as under:-
i)
A person recruited by promotion from the service of the Corporation shall be senior
to a person recruited otherwise;
Provided that in the case of promotion of two or more persons, their inter-seseniority shall be determined according to their seniority in the posts from which
they have been promoted.
ii)
A person on deputation shall be senior to a person recruited by direct
appointment ;
Provided that in the case of two or more persons on deputation their inter-seseniority shall be determined according to their seniority in the parent service;
iii)
In the case of persons recruited by direct appointment the older in age shall rank
senior to the younger; and
iv)
In any other case, the persons in the higher scale of pay shall be considered to be
senior to a person in the lower scale of pay and where the scales of pay are
identical, the person drawing higher salary shall rank senior.
Promotion
**b)
i)
Promotion to all cadre posts up to the rank and level of DGM / Executive Engineer in the nontechnical / technical wings of the Corporation be considered and decided on Seniority-cumMerit basis as per procedure for such promotions being followed in the Punjab Govt. for
similar level posts.
ii)
For considering promotions to the various cadre posts above the level of DGM / Executive
Engineer, Corporation shall, however, consider and decide the promotions on merit –cumSeniority /basis.
iii)
Corporation should follow the norms/criteria for determining eligibility as per the guidelines
contained in the letter issued by the Govt. circular letter dated 6.9.2001 and letter dated
29.12.2000. However, there will be no relaxation in the qualifications / experience, clearance
of type test/ departmental examination as already laid down in the promotion policy approved
by the BODs.
* 3.5 Superannuation and Retirement;a) Every officer or other employee of the Corporation other than a Class IV employee
shall retire on attaining the age of 58 years;

b)
An employee of the Corporation in Class IV shall retire on attaining the age of 60
years.
c)
Notwithstanding anything contained in these rules, an employee of the Corporation,
whose date of birth falls on any day other than 1st of that month shall on attaining
that age of superannuation determined in accordance with the provision of clauses
(a) and ( b) above, as the case may be, retire on the last day of that month, which
shall be a working day . An employee, whose date of birth is 1st of month, shall
retire on the afternoon of the last day of the preceding month.

Every officer/official of the Corporation shall be entitled to cash payment in lieu of
unutilised earned leave subject to a maximum of 300 days on the date of
retirement in accordance with the Govt. instructions issued from time to time.

The employees retiring on invalidation on the advice of Medical authority shall be
paid leave salary in lumpsum on the pattern of Punjab Govt. employees as allowed
to them vide instructions issued by Punjab Govt. Circular letter No. 1/22/784FR/6149, dated 8.7.1981 except, however, that half pay leave would not be
included while reckoning the period of 180 days.
**f)
the Punjab Civil Service(Premature Retirement) Rules, 1975, shall apply mutatis
mutandis with amendments and instructions issued from time to time by the Punjab
Government, to the officers and other employees of the Corporation.
*** 3.6
Gratuity :-
“ Gratuity shall be payable at the rate of 15 days wages based in the rate of wages
last drawn for every completed year of service or part thereof in excess of the 6 months to
every officer or other employee on termination of his employment after he has rendered
continuous service for not less than 5 years subject to maximum of 20 months wages or
Rs. 10,00,000/- & whichever is less.

On superannuation; or
On his retirement or resignation;
On his death or disablement due to accident or disease.
Provided that completion of continuous service of five years shall not be necessary
where the termination of the employment of any employee is due to death or
disablement.
Note;- Wages means wages as defined in payment of Gratuity Act. 1972.
3.7
Compulsory Contributory Provident Fund;-
Every officer or other employee of the Corporation shall be entitled to membership
of the scheme of contributory provident fund under and in accordance with any law for the
time being in force.

3.8
GENERAL
a)
The whole time of an officer or other employee shall be at the disposal of the
Corporation. The working hours shall be fixed in such a manner as may be deemed
fit by the Corporation in public interest.
b)
No officer or other employee shall directly or indirectly engage in any other
business, occupation employment nor shall he enter into any partnership , accept
any fees, endowment or commission whatsoever from any party other than the
Corporation except with the previous permission of the appointing authority.
c)
Every officer or other employee shall be liable to be transferred by the appointing
authority from one post to another or to any place which it may consider necessary
in the interest of the Corporation.
d)
No officer or other employee of the Corporation shall take part in politics or in any
political demonstration or stand for election as member of any House of State
Legislature or of any local authority or indulge in such activities which may cause
embarrassment to Corporation.
e)
The Corporation shall, in respect of acts done in good faith and in the interest of the
Corporation, extend protection to an officer and other employee of the Corporation
in a court of Law or elsewhere.

Apropos of the Punjab Govt. instructions which are and be continued to be followed
on any point for which there is no corresponding provisions in the Service Bye-Laws
of the Corporation.
** 3.9
EX-GRATIA GRANTS:The ex-gratia grant to be given to the family of deceased employee shall be
regulated in accordance with the provisions of Punjab Civil Service Rules and
instructions issued there under from time to time.
CHAPTER - IV.
4.1

PAY & ALLOWANCES.
For the purpose of this chapter ,the terms:“Pay” means the monthly pay drawn in a time scale and includes ‘Personal’,
“Special” ‘ Dearness’ or “Deputation ” pay, but does not include any allowance.
“Substantive pay”, means the minimum or stage pay in time scale substantively
held;
“Personal Pay” means an additional pay granted to an officer or other employee:
i)
to save him from loss due to revision of pay of reduction therein otherwise than as
a disciplinary measure; or
ii)
in exceptional circumstances, on other personal considerations.
d)
“Special Pay” means additional pay granted in consideration of:-
i)
the specially arduous nature of duties; or
ii)
A specific addition to the work responsibility; or

e)
“Award” means a fixed amount awarded in recognition of meritorious work performed
by an officer or other employee of the Corporation.

“Allowance” includes Dearness Allowance, Travelling Allowance, Deputation
Allowance, Conveyance Allowance, Sumptuary Allowance, Over-time Allowance,
Chandigarh Compensatory Allowance, house rent or any other kind of allowance
sanctioned by the Board from time to time.
f)
4.2
An officer or other employee of the corporation shall on appointment be eligible to
the minimum of the scale of the post to which he is appointed.
Provided that the appointing authority may, in consideration of special
knowledge, training or experience, allow a higher initial start to any person.
*4.3
The appointing authority may in recognition of exceptional good service of an
employee/ officer working in commercial/ operational unit, grant to him :i)
ii)
An award not exceeding one month’s Pay of the employee/ officer.
One or two increments in the time scale of his/her post.
Provided that the benefit shall be given to an employee/officer subject to following
conditions:The above benefit shall only be available to the employee(s)/officer(s) working
in commercial/operational units of the Corporation
a)
b)
The benefit/profit earned by the employee(s)/officer(s) to the corporation
should be quantifiable.

Provided that payment of incentive under the incentive scheme may be made to the
sales and other staff, including class-IV, employees working under regular pay
scales in the various emporiums being run by the Corporation.
Board authorized M. D. to grant incentives upto Rs.1000/- per employee
particular year to those employees working in non-commercial Sections.
4.4
(a)
in
a
Government servants on deputation to the Corporation may either:-
i)
accept the pay scale of the post under the Corporation subject to the fixation of their
pay in such pay scale by the appointing authority or
ii)
Continue to enjoy their pay scale in their parent service plus deputation pay as
approved by the Government and other allowances as admissible to them in
Government service.
NOTE:
A Government servant on deputation to the Corporation will be entitled to claim benefits of higher
pay scale or of fixation of pay at a higher level with or without retrospective effect in the
Corporation, if such benefits have accrued to him in his parent service consequent upon decision
in his favour of his appeal or representation or otherwise, as a matter of course.
b)
Where an employee of any other Corporation is appointed to any post under the
Corporation, his conditions of service shall be such as may be decided by the
appointing authority.
4.5
The Corporation shall pay to the Government leave salary and pension contributions
or any other liability in respect of all its officers or employees taken on deputation
from the Government in accordance with the rules of Government in force for the
time being in this behalf.
4.6
An increment in a time scale may be drawn as a matter of course by an officer or
other employee of the Corporation unless it is withheld or deferred by the appointing
authority on the ground of suspension, grant of extra-ordinary leave without pay or
punishment.

4.7
Specific sanction of the appointing authority shall be required to cross an
efficiency bar in any time Scale.

4.8
Service in a higher scale of pay shall count for increment both in the
substantive scale of pay and in the higher scale of pay.
4.9
Special pay at a rate not exceeding 10% of basic pay to be determined by the
appointing authority be allowed to a person holding charge of an independent
post in addition to his own duties for a period exceeding one month.
4.10
When a person in a lower scale of pay is appointed to officiate in a higher
scale of pay, he shall draw his minimum of the higher scale or his pay shall be
fixed in the new scale a stage next above his basic pay in the lower scale if it
is more than the minimum of the new scale.
4.11
The officers and other employees of the Corporation shall receive such
allowances as may be sanctioned by the Board from time to time.
4.12
The Board may grant an honorarium or retaining fee to any person for any
service rendered by him to, or work done by him for the Corporation.
4.13
Any sum of money or pay or allowance due to any officer or other employee of
the Corporation that may have remained unclaimed may be transferred to,
and held in the suspense account for a period of three years from the date on
which the payment is normally due and will thereafter be treated as lapsed to
the Corporation.
CHAPTER-V
5.1
LEAVE
i)
The admissibility of leave of all kinds to any officer or other employee
of the Corporation shall be governed by the Punjab Civil Services
Rules as amended from time to time.

Managing Director can sanction all kinds of leave to the Officers and
other employees of the Corporation to any extent admissible under the
Punjab Civil Service Rules.

Allow joining time on transfer provided that it does not exceed six
working days.
CHAPTER-VI
6.1
PENALTIES
An officer or other employee of the Corporation may be awarded any one or
more of the following Penalties:a)
Warning or reprimand or censure;
b)
With–holding of increment or increments including stoppage at the
efficiency bar;

c)
Reduction to a lower time scale;
d)
Recovery from pay of loss caused to the Corporation;
e)
Removal or dismissal from service;

The penalties referred to in bye-law 6.1 may be imposed by order in writing of the
Appointing Authority.

6.3 i) Any person in the employment of the corporation may be placed under suspension
by order in writing of the appointing authority for the purpose of holding an enquiry
into charges against him.

ii)
Notwithstanding anything contained in it, the Chief Engineer is hereby
authorized to suspend any of the technical and other field staff (excluding
Head Office Staff) up to the level of Junior engineer working under him found to
have committed financial irregularities for holding an enquiry against him, as may be
decided by the disciplinary authority.
During the period of suspension, such person shall be entitled to receive
subsistence allowance equal to one-half of his substantive pay plus allowances
thereon:
Provided that:

the difference of his pay and subsistence allowance may be given to such
person on his reinstatement if the appointing authority so directs in writing
and;
the subsistence allowance already paid to such person shall not be refundable to
the Corporation in case a person is dismissed or removed from service.
The penalties enumerated in bye-laws 6.1 above may be imposed on any one or
more on the following grounds, namely: -
a)

Strike or inducing others to strike;
Wilful insubordination or disobedience;
Negligence, inefficiency or indolence;
Irregular attendance;
Unauthorised divulgence of any information or document detrimental to the
interests or reputation of the Corporation.
Theft, pilferage, fraud, dishonesty, misappropriation, defalcation or
embezzlement;
Absence from duty without leave or overstaying leave, except under
circumstances beyond control provided that the appointing authority may
order such period to be treated as period spent on leave of any kind;
h)
Arrest of conviction on a criminal charge or for an offence involving moral
turpitude or depravity or degradation of character.
i)
Insanity;
j)
Anti-national activities; or

Failing to use official language Punjabi in Gurmukhi script in the official work
of the Corporation or violating the provisions of the Punjab Official Language
Act, 1967 or any instructions applicable in connection with the use of Punjabi
in official work of the Corporation.
All Officer and other employees of the Corporation shall be required to scrupulously
desist from practicing sexual harassment of women employees in any form, as by
law defined, and any violation of this requirement shall attract penalty(ies) as
aforesaid.

Any other sufficient ground.

6.5
An appeal against an order of the Appointing Authority imposing any penalty shall
lie to the Board within one month of the date of the service of the order and the
Board’s decision on such appeal shall be final.
Provided that a joint appeal shall not be entertained.
Provided further that where a penalty has been imposed by the Appointing
Authority with the approval of the Board, the person on whom the penalty has
been imposed may apply to the Board for revision of its decision within one month
of the date of service of the order imposing the penalty.
CHAPTER -VII
MEDICAL ALLOWANCE
7.1
Omitted and framed New Medical Rules, 1980 in 104 th meeting held on
30.5.1980.
CHAPTER -VIII.
TRAVELLING ALLOWANCE:
8.1
Omitted and incorporated new Travelling Allowance Rules, 1979 in 100th
meeting held on 6th February, 1979.
CHAPTER-IX
DELEGATIONS;9.1
The Board may confer on the Managing Director or any other officer or the
Corporation any of its powers in these bye-laws by resolution. The Managing
Director may with the approval of the Board confer on any officer of the
Corporation any of his powers including his delegated powers by written
authorisation. Delegated powers shall be exercised subject to such conditions
and limits as may be prescribed in the resolution or authorisation by Board.

ANNEXURE ‘C’
A)
Delegation of powers to the Managing Director vide Resolution No. 5 of the 25th
meeting of the Board of Directors held on 6-11-1975.
“ Resolved to delegate powers, as in the explanatory note to the Managing Director
under the employees service Bye-Laws of the Punjab State Small Industries
Corporation and to append them as Annexure ‘C’ the said Rules :-
SECTION 3.1(b) (i)
Make appointments to all posts carrying pay upto Rs. 1100/- specified in Schedule
‘A’ or ‘B’ of the Service Bye-Laws.
SECTION 3.1(c) (ii)
Prescribe for verious posts carrying pay scale of Rs. 1100/- or less and with the
approval of Chairman for other posts under the Corporation the qualification, whether
academic, technical or otherwise or tests or physical standards, or any experience that he
may consider necessary and expedient.
SECTION 5.1(iii)
Sanction all kind of leave to the officers and other employees of the Corporation to
any extent admissible under the Punjab Civil Service Rules, allow joining time on transfer
provided that it does not exceed six working days.
SECTION 7.1(iv)
Sanction reimbursement of medical charges incurred by an officer or other
employees of the Corporation for his own treatment or for the treatment of his family if the
expenditure does not exceed Rs. 1000/- provided that the reimbursement exceeding Rs.
1000/- will require sanction of the Board.
B)
Resolutions passed by the Board vide 189th meeting of the Board of Directors held
on 7.11.1996 :The Board of Directors resolved to make Managing Director of the Corporation
appointing and punishing authority under the PSIEC Employees Service Bye-Laws
in respect of all categories of posts.
The Board of Directors further resolved that the appeal against the orders of the
Managing Director regarding the award of punishment shall lie to the Board of
Directors with 30 days.

The Board of Directors further resolved that the appeal against the orders of the
Managing Director regarding employees in the pay scale of Rs. 2410-4000 shall be
to the Board of Directors.
It was further resolved that appeals with respect to the orders of the Managing
Director with respect to the employees in less than the pay scale of Rs. 2410-4000
shall be made to a Personnel Sub Committee consisting of the following members
of Board of Directors: i)
Chairman of the Board
ii)
Secretary, Industries & Commerce.
iii)
Managing Director of the Corporation.
