110 THE DECREE of the Ministry of the Environment of the Slovak Republic of 14 February 2005 implementing some provisions of the Act on the protection of species of wild fauna and flora by regulating trade therein, amending and modifying some Acts The Ministry of the Environment of the Slovak Republic (hereinafter referred to as the „Ministry“) pursuant to Article 15, paragraph 5 of the Act 15/2005 on the protection of species of wild fauna and flora by regulating trade therein, amending and modifying some Acts (hereinafter referred to as the „Act“) lays down: Article 1 Subject of the Decree a) b) c) d) e) f) g) h) i) This Decree lays down details on the content and submission of applications for import permit, export permit and re-export certificate, details on the format of an official form of the Annex of import permit, export permit or re-export certificate, details on the content and submission of applications for exemption from prohibition of commercial activities or authorisation of movement, details on registration of scientists and scientific institutions in a specific list pursuant to Article 3 of the Act, a list of customs offices for carrying out checks and formalities for import of specimens into the Community and their export or re-export from the Community, a list of selected species, the holding of which is prohibited, details on keeping records of specimens, unalterable marking of specimens, certificate of registration as well as on a certificate of the origin of an animal specimen, a list of species for which records need not to be kept pursuant to Article 11, paragraphs 1, 3 and 7 of the Act and which are not subject to registration pursuant to Article 12, paragraph 17 of the Act, details on the content of a certificate of a veterinary administration authority on appropriateness of a breeding facility pursuant to Article 19, paragraph 3(a) of the Act. Article 2 Details on the content and submission of import permit, export permit and re-export certificate (1) A format of an application form for import permit, export permit or re-export certificate (hereinafter referred to as „application“) is presented in a specific legal instrument. 1 List of written documents that shall accompany application is stated in Annex 1. 1 Annex I of the Commission Regulation (EC) No 1808/2001 of 30 August 2001 laying down detailed rules concerning the implementation of Council Regulation (EC) on the protection of species of wild fauna and flora by regulating trade therein (OJ L 250, 19.09.2001), Part 5 - Application. 1 (2) Along with the data required by instructions and explanations in the application form the following data shall be provided: a) in box 1 or 3: registration number, date of birth or identification number, telephone and fax numbers of importer, exporter or re-exporter, b) in box 6: address of authorised location for live specimens of species listed in Annex A of a specific legal instrument2 which have been taken from the wild, c) in box 23: used transport means, expected date of import, export or re-export, intended customs office. When a revenue stamp is used, the bottom part of the revenue stamp shall be stuck in this box. (3) The importer shall ensure that the application for import permit is accompanied by the following documentary evidence (Article 6, paragraphs 3 and 4 of the Act): a) an authorisation to run business, if related to the subject of the application and if the importer holds such an authorisation, in the first application in a relevant calendar year, b) an original or a copy of an original of export permit or re-export certificate issued in accordance with the Convention on International Trade in Endangered Species of Wild Fauna a Flora3 (hereinafter referred to as „international agreement“) by a management authority of the State of export or re-export in case of import of specimens of species listed in Appendices to the international agreement, c) a written document proving that imported specimens were obtained in accordance with legal regulations on protection of such species in the State of export or in the State of re-export in case of import of specimens of a species not listed in the Appendices to the international agreement, d) detailed description of a facility where the imported specimen shall be located in case of import of a live specimen of species listed in Annex A of a specific legal instrument 2, except for a specimen of the second and subsequent generation offspring and an artificially propagated plant, e) a written certificate issued by a locally competent veterinary authority4 proving that a breeding facility for a live specimen born and bred in captivity of a species listed in Annex A of a specific legal instrument2 and for all specimens of a species listed in Annex B of a specific legal instrument 2 in a place of destination is adequately equipped for proper protection and care. The certificate shall include in particular the address of the place where the facility is located, the species and number of specimens for which it has been issued, f) a document on payment of administrative fee5. (4) The exporter shall ensure that the application for export permit is accompanied by the following documentary evidence (Article 6, paragraphs 3 and 4 of the Act): a) an authorisation to run business, if related to the subject of the application and if the exporter holds such an authorisation, in the first application in a relevant calendar year, b) a written document proving that the specimen was obtained in accordance with legal regulations on protection of such species and proving the source of a specimen pursuant to Article 12, paragraph 1 of the Act, c) a copy of an original of import permit or a copy of confirmation issued by a competent authority of the State of import that it will be issued, in case of export of the specimens listed in Appendix I to the international agreement, 2 Council Regulation (EC) No 338/1997 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein in valid wording (OJ L 061, 03.03.1997). 3 The Convention on International Trade in Endangered Species of Wild Fauna and Flora (Notification of the Federal Ministry of Foreign Affairs No 572/1992). 4 Article 8 of the Act No 488/2002 on veterinary care, amending some other Acts, as amended. 5 Item 161a of Annex of the Act of the National Council of the Slovak Republic No 145/1995 on administrative fees as amended. 2 d) detailed description of conditions of shipment of a live specimen, including characteristics of a shipment facility, e) a document on payment of administrative fee5. (5) The re-exporter shall ensure that the application for re-export certificate is accompanied by the following documentary evidence (Article 6, paragraphs 3 and 4 of the Act): a) an authorisation to run business, if related to the subject of the application and if the re-exporter holds such an authorisation, in the first application in a relevant calendar year, b) a written document proving that the specimen was obtained in accordance with legal regulations on the protection of such species and proving the source of a specimen pursuant to Article 12, paragraph 1 of the Act, c) a written document proving previous legal import of re-exported specimens on the Community territory, in particular import permit and import notification, d) a copy of an original of import permit or a confirmation issued by a competent authority of the State of import that it will be issued, in case of export of the specimens listed in Appendix I to the international agreement, e) detailed description of conditions of shipment of a live specimen, including characteristics of a shipment facility, f) a document on payment of administrative fee5. (6) An importer, exporter and re-exporter can support an application for import permit, export permit and re-export certificate also with documentary evidence other than referred to in paragraphs 3 to 5, if these documents prove meeting the conditions for issuance of import permit, export permit or re-export certificate. Article 3 Details on the format of an official form of Annex of import permit, export permit or re-export certificate The format of an official form of the Annex of import permit, export permit or re-export certificate is presented in Annex 2. Article 4 Details on the content and submission of applications for exemption from prohibition of commercial activities or authorisation of movement (1) The format of an application for exemption from prohibition of commercial activities or authorisation of movement is presented in a specific legal instrument 6. (2) Along with the data required by instructions and explanations in the application form the following data shall be provided: a) in box 1: date of birth or identification number, b) when a revenue stamp is used, the bottom part of the revenue stamp shall be stuck in box 20. (3) The applicant shall ensure that the application for exemption from prohibition of commercial activities (Article 8, paragraph 2 of the Act) is accompanied by the following documentary evidence: a) an authorisation to run business, if related to the subject of the application and if the applicant holds such an authorisation, in the first application in a relevant calendar year, 6 Annex III of the Commission Regulation (EC) No 1808/2001, Part 3 – Application. 3 b) a copy of the truly and fully filled in certificate of the origin or of another written document pursuant to Article 12, paragraph 4 of the Act, c) a document on payment of administrative fee.7 (4) The applicant shall ensure that the application for authorisation of movement of live specimens (Article 8, paragraph 4 of the Act) is accompanied by the following documentary evidence: a) an authorisation to run business, if related to the subject of the application and if the applicant holds such an authorisation, in the first application in a relevant calendar year, b) a copy of the truly and fully filled in certificate of origin or of another written document pursuant to Article 12, paragraph 4 of the Act, c) a copy of import permit or a copy of certificate8, d) a document on payment of administrative fee7. (5) An applicant can support an application for exemption from prohibition of commercial activities or for authorisation of movement also with documentary evidence other than referred to in paragraphs 3 to 4, if these documents prove meeting the conditions for granting exemption from prohibition of commercial activities or for granting authorisation of movement of live specimens. Article 5 Details on registration of scientists and scientific institutions into a specific list (1) Scientists and scientific institutions (hereinafter referred to as “applicant”) shall submit the application for registration in a specific list to the Ministry. (2) If the applicant is a natural person, the following data shall be included in the application for registration: a) name, surname, permanent address and date of birth, b) a scientific area in which he carries out a scientific activity. (3) The applicant shall support the application for registration in a specific list as referred to in paragraph 2 with the following documents: a) an excerpt of his criminal record not older than three months, b) a certified document on completed education, c) a document proving professional practice of the applicant in the form of a declaration of professional institution or at least two experts in a given scientific area or a declaration on word of honour of the applicant, d) other documents proving professional profile of the applicant, if acquired, e.g. officially certified document proving his postgraduate course or his scientific degree, e) review of his professional, publication and scientific activities referring to the scientific area in which he carries out the scientific activity, f) authorisation pursuant to a specific legal instrument9. (4) If the applicant is a legal entity, in particular the following data shall be included in the application for registration: a) name and seat, statistical identification number of the organisation and phone (fax) number and email, 7 Item 161b of Annex of the Act of the National Council of the Slovak Republic No 145/1995 as amended. Articles 8 and 9 of the Council Regulation (EC) No 338/1997. 9 Article 7, paragraph 1 of the Act No 428/2002 on protection of personal data as amended by the Act 602/2003. 8 4 b) c) d) name, surname name, permanent address and date of birth of the person authorised to act on behalf of a legal entity, a scientific area in which it carries out the scientific activity, brief characteristics of the subject of activity, human resources, technical and other equipment. (5) The applicant in his application for registration in a specific list pursuant to paragraph 4 shall include: a) an officially certified copy of a deed of foundation or a copy of statute, unless established directly by law, b) other documents and information on expert profile of the applicant, c) a review of his professional, publication and scientific activities referring to the scientific area in which he carries out the scientific activity. (6) The specific list is annually published in the official journal of the Ministry. a) b) (7) The specific list is kept separately for natural persons, legal entities. (8) The register is available at the Ministry. Article 6 List of customs offices A list of customs offices for carrying out checks and formalities for import of specimens into the Community and their export or re-export from the Community is presented in Annex 3. Article 7 List of selected species, the holding of which is prohibited (1) Prohibition of the holding pursuant to Article 4, paragraph 1 of the Act shall be applied to the following live specimens: a) not indigenous species of Falconiformes and Strigiformes, b) sub-species of Red-eared Slider (Trachemys scripta elegans). (2) The provision of paragraph 1 shall not be applied to the holding of live specimens a) in ZOOs, b) in rescue centres for animals, c) by persons involved in an international programme for the protection of a species or sub-species to which paragraph 1 is applied. Article 8 Registration list of plant specimens (1) A registration list of plant specimens (hereinafter referred to as “registration list”) shall be kept separately for each genus of plant specimens and data shall be included into it according to the format presented in Annex 4. (2) The register list includes documents proving how plant specimens were acquired (Article 12, paragraph 20 of the Act), mainly document on purchase, donation contract, exchange contract, borrowing 5 contract, decision of a state administration authority in the area of the protection of specimens. The documents shall include identification of a subject from which the specimen was acquired (name, surname, permanent address of a natural person or name or trade name, seat and location of business of legal entity), mass or quantity of acquired specimens, data proving origin of specimens pursuant to Article 12 of the Act and date of acquisition of specimens. (3) Each page of the register list shall be numbered and identified by a stamp of a District Office for the Environment. Article 9 Species card of an animal specimen Data on a holder and data on a specimen shall be included in a species card of an animal specimen. A format of a species card of an animal specimen is presented in Annex 5. Article 10 Breeding and holding book of an animal specimen (1) A breeding and holding book (hereinafter referred to as “breeding book”) shall be kept for any species of an animal specimen referred to in Article 11, paragraph 7 of the Act. From this breeding book pages cannot be removed, new pages cannot be inserted and each page is numbered and marked by a stamp of a District Office for the Environment and the front page of such a book states the name, surname, or the name or trade name of the holder, permanent address, seat or location of business of the holder, location of breeding together with address and registration number. (2) The breeding book includes documents proving how plant specimens were acquired, mainly document on purchase, donation contract, exchange contract, borrowing contract, decision of a state administration authority in the area of the protection of specimens. The documents shall include identification of a subject from which the specimen was acquired (name, surname, permanent address of a natural person or name or trade name, seat and location of business of legal entity), mass or quantity of acquired specimens, data proving origin of specimens pursuant to Article 12 of the Act and date of acquisition of specimens. (3) The registry for previous calendar year shall be closed on 1 January and data on basic breeding stock (mass or quantity), ratio of sexes, mass or quantity of all development stages, immature specimens, quantity of prepared specimens and source of kept specimens shall be transferred to the registry for a new year. Article 11 Unalterable marking of specimens (1) Live specimens of vertebrates of species listed in Annex A of a specific legal instrument2 shall be unalterably marked in a manner presented in a specific legal instrument 10. The same manner shall be used to mark live specimens of vertebrates of species listed in Annex B of a specific legal instrument2, except for specimens of birds of the first generation offspring which shall be marked by a unique seamlessly closed foot ring 11. Article 36, paragraph 5 of the Commission Regulation (EC) No 1808/2001. 6 legal instrument2 with an injection transponder (so called microchip) any mark of injection transponder can be used. The specimens of species listed in Annex 6 shall not be marked. (2) Live specimens of vertebrates of species listed in Annex C and in Annex D of a specific legal instrument2, which are subject to registration pursuant to Article 12, paragraph 17 of the Act, shall be marked in the same manner as the specimens listed in Annex B of a specific legal instrument 2. (3) As unalterable marking of specimens of species listed in Annex A of a specific legal instrument2 is considered to be a marking pursuant to paragraph 1 and DNA profile, which proves identity of a specimen, parenthood and generation 1. of birds and mammals of indigenous species of protected animals12, that are specimens of species listed in Annex A of a specific legal instrument2, except for their rehabilitation that lasts less than three months, 2. of other birds and mammals of specimens of species listed in Annex A of a specific legal instrument2, except for red-fronted parakeet (Cyanoramphus novaezelandiae), that are used for reproduction including their offspring. (4) Seamlessly closed leg rings referred to in a specific legal instrument11 shall hold a code consisting of numbers and letters. a) b) c) d) (5) The unalterable marking shall not be applied to young mammals at the age of nursing if such a marking can threaten their life or health, to bird eggs and young birds if they stay in a nest or in care of parents if such marking could threaten their life or health, within not more than three months of their age, to eggs of reptiles and young reptiles within three months of their age if they stay with their original holder or if, according to an opinion of a District Office for the Environment advised by the scientific authority of the Slovak Republic, physical characteristics of a specimen do not allow safe application of the given marking method. (6) The method and code of unalterable marking and in case of injection transponders also the mark are recorded in documents on registration related to a specimen and in the certificate of the origin and in the certificate of registration. Article 12 Certificate of registration Data on a holder and data on a specimen shall be included in a certificate of registration. A format of a certificate of registration of a specimen is presented in Annex 7. Article 13 Certificate of the origin of an animal specimen (1) Certificate of the origin of an animal specimen (hereinafter referred to as “certificate of the origin“) shall be issued without undue delay only for final development stage of an animal specimen. A certificate of the origin shall not be issued for animal specimens that are a) in rehabilitation lasting not more than three months, 12 The Act 543/2002 on nature and landscape protection as amended. (2) A certificate of the source shall be issued separately for each specimen only once. (3) Data on a holder and data on a specimen shall be included in a certificate of the source. The format of a certificate of the source is presented in Annex 8. An original of a form of a certificate of the source shall hold a hologram. Article 14 List of species for which records need not to be kept and which are not subject to registration A list of species for which records need not to be kept pursuant to Article 11, paragraphs 1, 3 and 7 of the Act and which are not subject to registration pursuant to Article 12, paragraph 17 of the Act is presented in Annex 6. Article 15 Entering into force This Decree shall enter into force on 1 April 2005. A species card is issued for each species separately and each specimen is recorded in a separate line. If necessary, other numbered pages can be inserted in a species card. Boxes in a species card shall be filled in as follows: SPECIES (scientific name) – scientific name of a specimen the species card is maintained for HOLDER´S REGISTRATION No. – registration No. assigned to specimen’s holder by the scientific authority of the Slovak Republic HOLDER – name, surname, name or trade name, permanent address, seat or location of business of the holder; in case of legal entities also name and surname of the person authorised to act on behalf of these legal entities CITES, EC Annex – No. of Appendix to the Convention on International Trade in Endangered Species of Wild Fauna and Flora and a letter of Annex in which the species is listed pursuant to the Council Regulation (EC) No 338/1997.
