RESOLUTION NO. 89-2013 (AMENDED) INTRODUCED BY: COUNCILPERSONS LINDA GARRITY AND ANN MARIE DONEGAN A RESOLUTION AUTHORIZING THE MAYOR AND A COMMUNITY DEVELOPMENT COMMITTEE MEMBER TO ENTER INTO NEGOTIATIONS WITH BEREA ANIMAL RESCUE ORGANIZATION TO PROVIDE ANIMAL (Dog and Cat) SHELTER SERVICES FOR THE MUNICIPALITY WHEREAS, from time to time the City’s Police Department captures stray dogs and is requested to capture cats within the City limits; and WHEREAS, the Berea Animal Rescue Organization has previously proposed to accept a limited number of stray dogs and cats at its facility. Now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF OLMSTED FALLS, COUNTY OF CUYAHOGA, STATE OF OHIO, THAT: SECTION 1. The Mayor and a Community Development Committee member are hereby authorized to enter into negotiations with Berea Animal Rescue Organization to provide animal shelter services for the municipality. Negotiations shall be completed and proposed to Council by November 30, 2013. SECTION 2. Compensation for the services provided shall be pursuant to the agreement negotiated. SECTION 3. The final agreement as negotiated shall be considered by Council by Resolution. SECTION 4. This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public in compliance with the law. SECTION 5.
