Dear Blank…
Thank you for your letter re the Sexual Offences Bill.
The response offered by the Government that “Northern Ireland will conduct its own review” (Hansard HL 13 Feb 2003
col 882) and that a separate body of law for Northern Ireland should take precedence is not accepted by either the
Northern Ireland Human Rights Commission or the European Court of Human Rights in Strasbourg (Dudgeon case).
In any case no such argument is offered regarding the other clauses of the bill which prohibit amongst other things
bestiality and necrophilia and are being extended automatically to Northern Ireland as part of the bill. We therefore feel
that there is no reasonable argument for this exceptionalism, and we think that you will appreciate the absurdity of
outlawing such extreme behaviour without any recourse to local consultation, but delaying or interdicting the updating
of the law in relation to less outlandish behaviour which in England and Wales would be legal following the passing of
this bill.
We ask you, therefore to put pressure on the Government to change its decision on these matters. It would be
particularly helpful if you could
