While the mare remains at the farm where the stallion stands, there shall be a per day
charge of ___________, with __________ additional if mare is accompanied by foal, for
board and keep, due and payable by the end of each month and in any case due before
mare leaves the farm where the stallion stands. The mare owner further understands that
he/she is responsible for any veterinarian and farm costs incurred for collection of the
stallion, breeding and pregnancy checking of the mare (such as palpation, ultrasound,
artificial insemination, collection of the stallion, etc.)
The mare owner authorizes Joint Venture Farm, its owners, employees and agents to
make all expenditures necessary for the routine and ordinary care of the mare and/or foal.
In the event extraordinary or emergency care or other action is required, Joint Venture
Farm, its owners, employees and agents agree to make such attempts to contact the mare
owner as may be reasonable under the circumstances. If the mare owner cannot be
reached, Joint Venture Farm, its owners, employees and agents are authorized to take
such action and make expenditures as in its sole judgment appear necessary to insure the
continued health and safety of the mare and/or the foal. All expenditures made in
accordance with this paragraph shall be the sole obligation of the mare owner.
All accounts for stud fees, board, keep, expenditures (such as veterinary, farrier, stallion
collection, etc.) must be paid before the mare or foal depart from the farm where the
stallion stands. The mare owner must give Joint Venture Farm and its owner, Ruthanne
Gardner, forty eight (48) hours notice before pickingup his or her mares.
The mare owner warrants that the mare and, if applicable, her foal, are free from
transmissible disease or infection, and the mare is in sound breeding condition, when she
arrives at the farm where the stallion stands or, if this breeding is by transported semen, at
any and all times of insemination. The mare owner agrees to provide and pay for a
current veterinary certificate of health for the mare and foal, have the vaccination records,
negative Coggins test of the mare and foal, and negative urine culture and cytology for
the mare prior to the mare’s arrival at the farm where the stallion stands.
Joint Venture Farm, its owners, employee and agents, will exercise judgement in the care
and supervision of the mare and/or foal, but will not be responsible for accident, sickness
or death to either or both.
Live Foal Guarantee & Contract Length: Joint Venture Farm, its owners, employees and
agents, will make a diligent effort to successfully breed the mare, and will work with the
mare owner so far as it is reasonable to achieve this goal. However, as breedings are
occasionally unsuccessful despite the efforts of all concerned, the mare owner shall have
the right to return breeding(s) only and solely as follows: where the mare has been
serviced or attempts made to service her through at least two successive heat cycles in the
contract year, but she has failed to produce a live foal which stands and nurses within 72
hours of birth in the year following the contract, the mare owner shall be entitled to return
privileges for the same mare or another mare approved by Joint Venture farm in the year
following the contract date. For this guarantee to apply the mare owner must notify the
stallion owner in writing of the death of the foal within one week of the death of the foal
or within one week of finding the mare open. This notice must be accompanied by a
statement from a licensed veterinarian as to the circumstances of the foal’s death or the
mare being found open. The breeding contract is for one live foal only and the mare
owner may use the contract for up to two years to achieve that live foal. After that time
the contract is null and void, although a new contract may be issued at the discretion of
the stallion owner.
The mare owner shall perform all of his/her obligations under this contract, or all
guarantees are null and void. Where the breeding is by transported semen, or the foal is
born elsewhere, Joint Venture Farm reserves the right to require that a licensed
veterinarian attest in writing to the times and circumstances of the insemination and/or
viability of the foal as a condition to honoring the Live Foal Guarantee.
Once the mare is pronounced in foal, the mare owner agrees to provide a healthy and safe
environment for the mare and fetus and for the mare and neonatal foal once born for the
first 72 hours of life. This condition is intended to afford the mare every opportunity to
carry to term and deliver a healthy foal. This healthy environment would include, but not
be limited to:
a. Proper nutrition to keep the mare in good body condition (not too thin or too fat)
to allow her to support a pregnancy and nurse a foal. It should be understood that
this condition includes access to fresh water.
b. Proper health care including a vaccination and de-worming schedule
recommended and supervised by a licensed veterinarian, with the veterinarian
understanding that the mare is in foal. Also, the mare owner must have the mare
vaccinated against the abortion from rhinopneumonitis at 3, 5, 7 and 9 months of
pregnancy or all guarantees of this contract are null and void.
c. Proper farrier care.
d. Adequate exercise and fresh air.
e. Adequate housing and fencing.
Should the mare owner choose to remove the mare from the farm where the stallion
stands before she can be bred through at least two heat cycles and certified in foal by a
licensed veterinarian or, if the breeding is by transported semen, fail to have the mare
inseminated through at least two heat cycles and certified in foal by a licensed
veterinarian, all unpaid fees and expenditures shall be immediately due and payable, and
Joint Venture Farm, its owners, employees and agents shall not have any liability
hereunder.
Registration (including all fees and paperwork associated with registration) of the foal
resulting from the breeding of the mare and stallion designated in this contract is the sole
responsibility of the mare owner. Joint Venture Farm will provide the required breeding
certificates along with the addresses and phone numbers of the applicable breed
associations and futurities to the mare owner when all fees due are paid in full to Joint
Venture Farm owners and its agent (to include, but not limited to, the farm where the
stallion stands and the veterinarian and farrier).
Should the above named stallion die, be sold by the owner, or become unfit for service
before servicing the mare, or if the mare dies or becomes unfit to be bred before she is
serviced, then this contract is null and void. At the time the mare is first serviced, or the
first shipment of semen is sent, which ever applies, this paragraph shall become null and
void.
This contract shall not be assigned or transferred, and in the event said mare is sold, the
fee, if unpaid, shall be due and payable and, whether paid or unpaid, no refund or return
breeding shall be due under any circumstances.
This agreement is executed and constitutes the entire agreement between both parties
involved and may not be modified except in writing signed by both parties hereto. When
the representative of Joint Venture Farm signs and returns a copy of this contract to the
mare owner it will then be binding on both parties, subject to the terms and conditions in
this contract.
This contract shall be governed by, interpreted by and enforced under the laws of the
State of Florida. Any suit or action commenced by or against Joint Venture Farm, its
owners, employees or agents must be filed and heard in the County of Madison, State of
Florida.
