CHECKSHEET #4 TEMPORARY ACCOMMODATION CHECKSHEET – BANKS PENINSULA AREA Residential - One accommodation unit This Checksheet outlines the requirements and standards for temporary residential accommodation involving one accommodation unit within the Banks Peninsula District Plan area. The requirements and standards are contained in Clause 7 of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011 and the associated public notice issued by the Council on 9 April 2011. Please complete all sections in the Customer Use column, using Y where the standard is complied with, N where the standard is not complied with, or NA where the standard is not relevant to the activity, and provide any supporting/explanatory comments in the middle column. NOTE: If your proposed temporary accommodation activity is not included in the list of activities below, or if any of the following standards are not complied with, the temporary accommodation is not a permitted activity and you will instead need to apply for a site specific public notice to be issued, using form P-031a. If the proposed activity does not meet the requirements list in (A)(1) below, it is not allowed under the Order and a resource consent will need to be applied for instead. Customer use [ ] (A) Type of activity: 1. The proposed activity must be temporary residential accommodation for persons displaced from their normal place of residence because of (select as relevant): [ [ ] 2. The activity must comply with the definition of accommodation unit in the public notice, i.e. “a structure of no more than 150m² in gross floor area for the purpose of providing temporary residential accommodation. The unit may include facilities normally associated with residential accommodation such as a kitchen, living area, bathroom, toilet and bedrooms. Accommodation unit may also include a campervan or caravan. The site shall be connected to or be serviced by: [ ] a means of sanitary sewage disposal [ ] a potable water supply that meets the standards of the Canterbury District Health Board and NZ Fire Service ] a method of discharging stormwater that does not discharge stormwater onto adjoining properties or adversely affect water quality ] a power supply. [ [ Servicing information: [ ] 2. Any new structures must be one storey and relocate-able Comment: [ ] 3. New structures must be set back a minimum of 3 metres from any road boundary and 1 metre from any internal site boundary (i.e. boundary with neighbouring property) and any other building on the site, with the exception that the road and internal setbacks for sites within the Residential Conservation Zone may be a minimum of 1.5 metres (attach site plan). Note: These set back requirements may be varied for structures provided by the Department of Building and Housing if authorised by the Resource Consents Manager or Planning Administration Manager. Comment: [ ] 4. Site coverage by total buildings must not exceed 50% of the site, with the exception that site coverage may be up to 80% of a site located within the Residential Conservation Zone. Note: This site coverage requirement may be varied for structures provided by the Department of Building and Housing if authorised by the Resource Consents Manager or Planning Administration Manager. Comment: [ ] 5. The activity must not require the external alteration or destruction of any building scheduled in the City Plan. Comment: [ ] 6. The activity must not require the alteration or destruction of any tree scheduled in the District Plan, unless authorised by the Resource Consents Manager or Planning Administration Manager for structures provided by the Department of Building and Housing. Comment: [ ] 7. The activity must have access directly or indirectly from an existing road or a Council/ Government provided road or carriageway. Comment: [ ] 8. Upon cessation of the temporary use or the expiry of the time limit under the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011, the site must be remediated to its original state and be left clean and tidy. Comment: [ ] 9. The activity must not involve subdivision of land. Comment: [ 11. ] The activity must not create any significant adverse effects (relating, but not limited to, noise, dust, mud, light spill, odour, traffic generation, refuse disposal, animal control and visual amenity) that will, in the opinion of a Council Enforcement Officer or Environmental Health Officer, cause nuisance for occupiers of surrounding sites. Note: If any significant adverse effects do arise, then the Council can impose additional requirements or conditions to avoid, remedy or mitigate those adverse effects. NOTES: 1) The above permitted activity standards solely permit breach of the Banks Peninsula District Plan by temporary accommodation as defined in the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011. All other statutory requirements and regulations applying to the activity or site (e.g. building consent, animal control, resource consent from Environment Canterbury, Ministry of Education standards, liquor licensing, health licensing) must also be complied with. 2) The Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011 expires on 18 April 2016. Any temporary accommodation established under this legislation can therefore only remain on site until that date. 3) All terms used in the above requirements and standards are defined in either: 1.
