Permits are nontransferable between different households. Permits may be transferred between vehicles
owned or leased by the same household.

household. Permits are automatically revoked during any snow event or snow
emergency.

00117-14. CONSIDERATIONS
A. Before issuing a special on-street parking permit the Parking Permits Review
Committee shall determine that:
(1) The owner or lessee of the subject motor vehicle has demonstrated a
hardship:
and
(2) The issuance of the permit would be feasible given the circumstances.
B. Hardship shall not be demonstrated unless the applicant is able to prove an inability
to reasonably provide or to reasonably create suitable off-street parking to suit his and
his household’s needs. In addition to the general rule for hardship provided in this
section, the Parking Permits Review Committee shall apply the following principles to
the subject address or property:
(1) If there would not be a hardship but for the existence of a motor vehicle or
motor vehicles in excess of the number of licensed drivers at the address, then
there is not a hardship.
(2) If there would not be a hardship but for the existence of a boat, recreational
vehicle or all-terrain vehicle at the address, then there is no hardship.
(3) If there would be no hardship if a garage not available for parking at the
address was available for the parking of an automobile or automobiles, then
there is no hardship.
(4) If there would be no hardship but for the existence of any broken-down or
otherwise nonfunctional vehicle at the address, then there is no hardship.
(5) It there would be no hardship but for the existence of a basketball hoop or
basketball court or other outdoor recreational facility at the address, then there
is no hardship.
C. In determining whether an off-street parking permit would be feasible given the
circumstances, the Committee shall consider any factor affecting the health, safety and
welfare of the borough.
117-15. Multiple special on-street parking permits.
The Parking Permits Review Committee shall have the power to grant no more
than one parking permit per household. Permits in excess of one per household must
be approved by both the Parking Permits Review Committee and Council. The
requirements of hardship and feasibility as provided for in the preceding section shall
be applied by both the Parking Permits Review Committee and Council in cases of
multiple permits.
117-18 Restrictions on issuance and use of permits
The following restrictions on the issuance and use of special on-street parking
permits shall in all cases apply:
A. During a snow or other emergency or during a snow removal operation, all
permits shall become temporarily invalid. The borough is authorized to tow
any car parked in violation of this rule. The violator shall be responsible for all
towing, storage and service charges.
B. No commercial vehicles shall be eligible for a permit.
C. No motor homes or all-terrain vehicles shall be eligible for a permit.
D. No motorcycles or motorbikes shall be eligible for a permit.
E. Since landlords are to be responsible for providing adequate parking space for their
tenants, no permit shall be issued for any tenant of any dwelling or apartment in the
borough.
117-19 Revocation of permits
Upon a violation of the rules of this chapter or upon a showing of changed
circumstances going to issues of hardship or feasibility, the Parking Permits Review
Committee may, after a hearing, revoke such permit or permits as is necessary and
proper. After such a hearing and in the case of a rules violation, Council may direct
the commencement of legal action against the permit holder.
117-20 Violation and penalties
In addition to any other penalties or legal actions provided by this chapter,
violators of this chapter shall be subject to a fine of not less than $10 to not more than
$1,000.00. Each day that a violation continues shall constitute a separate offense.
117.21 Enforcement
Enforcement of this chapter shall be by the Police Department in the Borough
and the Code Enforcement Officer.
