SUMMARY
This paper investigates the current situation with respect to WRC-15
agenda item 1.5 the reasons behind the debate and suggest a potential
way forward. If acceptable this would allow a proposal to be made as to
how to progress with the development of CPM text and the associated
ITU-R Report on compatibility between an unmanned aircraft command
and non-payload communication system operating in various frequency
bands allocated to the fixed satellite service and other systems in those
frequency bands.

WRC agenda item 1.5 seeks to address the potential use of frequency bands currently
allocated to the fixed satellite service that are not subject to the provisions of appendix 30, 30A and 30B
for unmanned aircraft command and non-payload communication systems. Resolution 153 then calls for
the ITU-R to study:1
to conduct, in time for WRC-15, the necessary studies leading to technical,
regulatory and operational recommendations to the Conference, enabling that Conference to
decide on the usage of FSS for the CNPC links for the operation of UAS;

to include, in the studies referred to in invites ITU-R 1, sharing and compatibility
studies with services already having allocations in those bands;

This agenda item therefore is intended to resolve the ITU’s responsibility for the Radio
Regulatory issues related to the provision of unmanned aircraft (UA) command and non-payload
communication (CNPC) systems. However it is ICAO’s responsibility through its own regulatory
framework to ensure that any system that provides UA CNPC will operate in a manner that does not
adversely affect the safety of aviation. Should the ITU provisions not meet the requirements of ICAO,
the use of unmanned aircraft in non-segregated airspace will either be impossible or severely limited.

DISCUSSION
2.1
Whilst agenda item 1.5 is due to be debated and hopefully resolved at WRC-15, the
relevant ICAO regulatory requirements that might help define some of the necessary radio regulatory
requirements will not be finalised for WRC-15. However ICAO have provided a list of 7 conditions (See
Annex 1) that will have to be met for ICAO to be in a position to progress the use of frequency bands
allocated to the fixed satellite service for UA CNPC.

From a purely radio regulatory perspective the ICAO conditions under clause (2) would
imply, as a minimum, that any UA CNPC link would have to operate under an aeronautical mobile
satellite (R) service allocation; under clause (4) that any such assignment would have to have completed
co-ordination with no outstanding observations and under clauses (3) & (6) that any system operating
under any such allocation would be provided the relevant protection normally afforded to a safety service
under article 4.10 of the Radio Regulations.

The fixed satellite service providers who would wish to provide the service are concerned
that the introduction of an aeronautical mobile satellite (R) service allocation in the various frequency
bands allocated to the fixed satellite service would place unreasonable constraints on their operations.
Additionally, they have yet to be convinced that there is a need for UA CNPC to operate under an
aeronautical mobile satellite allocation, but believe that with relevant provisions within a WRC
Resolution they could operate under a fixed satellite service allocation.

Given that the UA when considering a satellite CNPC link is defined as an aircraft earth
station, then in accordance with Article 1.851 of the Radio Regulations it must operate in the aeronautical
mobile-satellite service. Taking into account the safety element the implication is that an allocation to the
aeronautical mobile-satellite (R) service would be more appropriate. Therefore from a radio regulatory
perspective, if a UA CNPC system were to operate under a fixed satellite service allocation even with an

associated WRC Resolution, it would be operating under Article 4.4 because the aeronautical mobile
satellite service is not a sub-set of the fixed satellite service which would not be acceptable to ICAO.
2.5
If this issue is to be resolved then there needs to be an agreed method that would meet the
ICAO requirements, whilst ensuring that in addressing those requirements, undue constraints are not
placed on the fixed satellite service and the providers of the systems operating under that allocation. It is
therefore proposed that a solution might be to make any allocation to the aeronautical mobile satellite (R)
service but then ensure that any such allocation does not place any undue constraints on systems in the
fixed satellite service that would not have otherwise been introduced in order for those systems to offer an
UA CNPC service.

PROPOSED SOLUTION
Taking into account the above discussion, as well as the aviation requirement for
a global service, the following solution is proposed:3.1

That an allocation to the aeronautical mobile satellite (R) service is introduced
into any global frequency band that is currently allocated to the fixed satellite
service that are not subject to the provisions of Article 30, 30A or 30B. This
could either be achieved through table allocations (see annex 2) or the use of a
footnote (see annex 3). The proposal in annex 2 is preferable as footnoted
allocations are normally used where the allocation is to individual administrations
rather than regions or global however there are examples of a footnoted global
allocation.

That an associated Resolution (see annex 4) be developed that places the relevant
limitations on the use of an allocation to the aeronautical mobile satellite (R)
service in order to ensure that any such allocation does cannot pre-empt or gain
priority over fixed satellite systems. It is also proposed that the Resolution further
restrict any allocation to the aeronautical mobile satellite (R) service to systems
that have already been co-ordinated as fixed satellite.

That the technical and regulatory actions should be limited to the case of UAS using
satellites, as studied, and not set a precedent that puts other aeronautical safety
services at risk.
That all frequency bands which carry aeronautical safety communications need to be
clearly identified in the Radio Regulations.
That the assignments and use of the relevant frequency bands have to be consistent
with article 4.10 of the Radio Regulations which recognizes that safety services
require special measures to ensure their freedom from harmful interference.
Knowledge that any assignment operating in those frequency bands:
–
is in conformity with technical criteria of the Radio Regulations,
–
has been successfully co-ordinated, including cases where co-ordination was
not completed but the ITU examination of probability of harmful interference
resulted in a favourable finding, or any caveats placed on that assignment
have been addressed and resolved such that the assignment is able to satisfy
the requirements to provide BLOS communications for UAS; and
–
has been recorded in the International Master Frequency Register.
That interference to systems is reported in a transparent manner and addressed in the
appropriate timescale.
That realistic worst case conditions, including an appropriate safety margin, can be
applied during compatibility studies.
That any operational considerations for UAS will be handled in ICAO and not in the
ITU.

The use of the frequency ranges 10.7-11.7 GHz, 12.7-12.75 GHz, 14-14.8 GHz, 17.3-17.7 GHz, 18.119.3 GHz, 19.7-20.2 GHz and 27.5-30 GHz by the aeronautical mobile-satellite (R) service is subject to

Provision related to use of the aeronautical mobile satellite (R) service in the
frequency range 10-30 GHz
The World Radiocommunication Conference (Geneva, 2015),
considering,
a)

that unmanned aircraft (UA) need to operate seamlessly with manned aircraft in the nonsegregated airspace and, to the extent practicable, use globally harmonized spectrum;
that the operation of UAS in non-segregated airspace requires, given the safety
implications, reliable communication links especially between the remote pilot and the
UA;
that there is a requirement, whilst operating in non-segregated airspace, for the provision
of unmanned aircraft command and non-payload communication (CNPC) beyond radio
line of sight of the associated ground station;
that satellite communication networks have the capability to provide beyond radio line of
sight communication;
that, as a dedicated satellite system for UAS is not likely, it is necessary to take into
account the existing and future satellite systems to accommodate the growth of the use of
UAS;
that satellite systems operating in the fixed satellite service (FSS) have the capability to
provide the communication links mentioned in considering b and c);
that the provision of UA CNPC links in frequency bands also allocated to FSS should not
impose any additional constraints on the capacity of those systems while maintaining
protection for safety services.

that No. 1.59 provides the definition of a safety service as any radiocommunication
service used permanently or temporarily for the safeguarding of human life and property;
that International Civil Aviation Organisation has yet to complete the development of
UAS CNPC standards and recommended practices (SARPs);
noting

that, in accordance with the Convention on International Civil Aviation, all aeronautical
systems must meet the relevant SARPs requirements;
that Annex 10 of the Convention on International Civil Aviation contains SARPs for
aeronautical radionavigation and radiocommunication systems used by international civil
aviation,
resolves

that the use of the frequency ranges 10.7-11.7 GHz, 12.7-12.75 GHz, 14-14.8 GHz, 17.317.7 GHz, 18.1-19.3 GHz, 19.7-20.2 GHz and 27.5-30 GHz by systems operating in the
aeronautical mobile satellite (R) service is limited to UA CNPC operating in accordance
with recognized international aeronautical standards;
that any satellite system being used for the provision of an aeronautical mobile satellite
(R) service must have already completed fixed satellite service co-ordination in
accordance with the relevant provisions of the Radio Regulations with no outstanding
observations;
that before a satellite network can be recorded in the master frequency register as
providing an aeronautical mobile satellite (R) service it must first have been standardised
within ICAO
the provision of an aeronautical mobile satellite (R) service shall neither constitute
priority nor precedence over duly coordinated fixed satellite service assignments in the
frequency bands relevant to this resolution;
the provision of an aeronautical mobile satellite (R) service shall be subject to the
conditions provided in appendix 1

to review at a future WRC the provision of UA CNPC via satellite once ICAO have
completed the development of SARPs for UA CNPC
instructs the Secretary-General
