Clause 6 – Coverage of Award
6.1
The scope of the Clay and Ceramics Industry - Brick and Terra Cotta Tile Manufacture - Victoria - Award 2000
is limited to the employment within the State of Victoria of any person or persons or classes of persons
employed in the maintenance and/or production processes in the business of:

brickmaking (including clay digging);

fire brick and refractory making;

sand and lime brickmaking; and

terra cotta tile making

terra cotta pipe making.
Clause 7 – Parties Bound
7.1
This award will be binding upon:
7.1.1
The Construction, Forestry, Mining and Energy Union (the union), its officers and members; and
7.1.2
The employers listed in Schedule A in respect to all their employees employed within the scope of this
award as varied from time to time, whether members of the union or not.
Common Rule Declaration - Victoria
Further to the decision issued by the Commission on 16 December 2004 [AW772585 PR953511] and pursuant to ss.
141 and 493A of the Workplace Relations Act 1996 (the Act), the Commission makes the following declaration for a
common rule award:
1.
In this Declaration:
1.1
the award means the Clay and Ceramics Industry - Brick and Terra Cotta Tile Manufacture - Victoria - Award
2000, as varied from time to time;
1.2
employees means employees in the industry who perform work of a kind that is covered by the award;
1.3
employers means employers who employ employees;
1.4
the industry means all persons and classes of persons employed in the maintenance and/or production processes
in the business of:
 brickmaking (including clay digging);
 fire brick and refractory making;
 sand and lime brickmaking;
 terra cotta tile making; and
 terra cotta pipe making.

2.
That save for and subject to the matters referred to in clauses 4 to 7 below, the whole of the terms of the award,
as varied from time to time, except those specified in clause 3 below, shall be:
2.1
a common rule for the industry in Victoria and known as the Clay and Ceramics Industry - Brick and Terra Cotta
Tile Manufacture Victorian Common Rule Declaration 2005;
2.2
binding on all employers in respect of the employment by them of employees;
2.3
binding on all employees; and
2.4
binding on the Construction, Forestry, Mining and Energy Union and the registered organisations respondent to
the award.
3.
The following clauses of the award are not included in the Clay and Ceramics Industry - Brick and Terra Cotta
Tile Manufacture Victorian Common Rule Declaration 2005:
3.1
Clause 5 - Commencement date of award and period of operation;
3.2
Clause 6 - Coverage of award;
3.3
Clause 7 - Parties bound, insofar as it refers to employers bound by the award.
4.
The Clay and Ceramics Industry - Brick and Terra Cotta Tile Manufacture Victorian Common Rule Declaration
2005 shall not apply to:
4.1
Work covered by the Clay and Ceramics Industry - Pottery Manufacture - Victoria - Award 2001 [AW807649].
5.
Subject to 5.1 to 5.4 below, all provisions in the Clay and Ceramics Industry - Brick and Terra Cotta Tile
Manufacture Victorian Common Rule Declaration 2005 are to operate from 1 January 2005.
5.1
With respect to annual leave, only periods of annual leave commencing on or after 31 January 2005 attract leave
loading.
5.2
With respect to redundancy payments for employees of employers who have less than 15 employees, only
service on or after 1 January 2005 is to be taken into account for the purpose of calculating ‘service’.
5.3
With respect to redundancy payments for employees of employers who have 15 employees or more, only service
on or after 1 January 2004 is to be taken into account for the purpose of calculating ‘service’. [Note: the
agreement in respect of this issue is without prejudice to the position a party may put in roping-in proceedings.]
5.4
The wages clauses (including all allowances and penalty payments) are to commence operation from the first
pay period on or after Monday, 3 January 2005 provided that in all cases the wages clauses commence operation
no later than 5 January 2005.
6.
The Clay and Ceramics Industry - Brick and Terra Cotta Tile Manufacture Victorian Common Rule Declaration
2005 shall not apply to employers respondent by any means to any other award of the Commission in respect of the
employment by them of employees covered by that award.
7.
This declaration shall not apply to a person with a disability who is eligible for a Disability Support Pension and
who is employed by a supported employment service that receives funding under the Disability Services Act 1986 (Cth)
to provide support for that person. [See Note 1 below.]
8.
In the event of a dispute about the entitlement of an employer to set-off entitlements and benefits provided under
a contract of employment made prior to the date of this declaration against entitlements and benefits required to be
provided under the Clay and Ceramics Industry - Brick and Terra Cotta Tile Manufacture Victorian Common Rule
Declaration 2005, the matter may be referred to a Board of Reference consisting of a Member of the Commission which
shall determine whether or not such a set-off should be permitted having regard to what is fair and equitable in all the
circumstances of the case, without regard to technicalities and legal forms.
8.1
An appeal lies from a decision of a Board of Reference to a Full Bench of the Commission.

8.2
This clause shall apply for a period of twelve months from the commencement date of the Clay and Ceramics
Industry - Brick and Terra Cotta Tile Manufacture Victorian Common Rule Declaration 2005.
8.3
Any registered organisation bound by the terms of the Clay and Ceramics Industry - Brick and Terra Cotta Tile
Manufacture Victorian Common Rule Declaration 2005 shall be notified of the time and date of hearing in
relation to any application made pursuant to this provision.
9.
Nothing in this declaration reduces or in any way detracts from any accrued rights to any forms of leave
including sick leave, annual leave, long service leave or parental leave to which employees or any of them have become
entitled by accrual or otherwise prior to the commencement date in clause 10 below.
10.
This declaration shall be an award of the Commission, shall come into force on [insert date] and shall remain in
force for a period of three months and thereafter in accordance with the Act. [See Note 2 below.]

Clause 6 – Coverage of Award
6.1
The scope of the Clay and Ceramics Industry - Pottery Manufacture - Victoria -Award 1996 is limited to the
employment within the State of Victoria of any person or persons or classes of persons employed in the business
of:

making pottery including tableware, terra cotta flower pots and saucers, tiles, pipes, terra cotta products,
including architectural features, terra cotta, ceramic articles and clay articles, however described;
6.3
making insulators of refractory or semi-refractory materials for use in goods or appliances operated by gas, oil or
electricity;
6.4
the digging, making or processing of raw materials for the purposes of 6.2 and 6.3.
6.5
This award does not apply to any company respondent to the Clay and Ceramics Industry - Brick and Terra Cotta
Tile Manufacture - Victoria - Award 2000.
Clause 7 - Parties Bound
7.1
This award will be binding upon:
7.1.1

4.

5.

5.1

Pottery Industry (State) Award [AN120425 – NSW]
Clause 1.4 - Area, Incidence and Duration
This award rescinds and replaces the Pottery, Tiles (Other than Roofing Tiles), Chinaware and Bristolware Makers
(State) Award published 24 February 1995 (284 IG 1) and all variations thereof and shall take effect on and from 19
February 2001.
It shall apply to all persons in or in connection with the manufacture of pottery, tiles (other than roofing tiles),
chinaware and bristolware in the State, excluding the County of Yancowinna, within the jurisdiction of the
Brickmakers, &c. (State) Industrial Committee (section 3).
The changes made to the award pursuant to the Award Review under Section 19(6) of the Industrial Relations Act 1996
and Principles for Review of Awards made by the Industrial Relations Commission of NSW on 18 December 1998 (85
IR 38) take effect on and from 1 July 2004.
The award remains in force until varied or rescinded the period for which it was made having already expired.
1.4.1 Brickmakers, &c. (State) Industrial Committee Industries And Callings.
Section 3. Tile, other than roofing tile, pottery and chinaware makers and their assistants in the State, excluding the
County of Yancowinna; except, in all sections, employees engaged in or about coal mines north of Sydney, in or about
coal mines in the South Coast district and at South Maitland Railways Limited; and employees of the Broken Hill
Proprietary Company Limited at Newcastle, Australian Wire Industries Pty Ltd at its Newcastle Wiremill and the
Council of the City of Sydney.

Clause 1.4 – Award Coverage
1.4.1
This Award applies to all employees engaged in or in connection with the making of clay products including
the manufacture of pipes, tiles, bricks, blocks, pottery, and to their employers.
1.4.2
As to the employers named in Schedule 1 and Schedule 2 to this Award the provisions of the Award are
modified in accordance with the requirements of the individual orders listed in such Schedules.
Clause 1.5 – Definitions

1.5.3
"Union" means The Australian Workers' Union of Employees, Queensland.
Clause 1.7 – Parties Bound
This Award is legally binding upon the employees and employers as prescribed by clause 1.4, the Union and its
members.
Clause 1.6 - Area of Operation
This Award shall operate throughout the State of Queensland. For the purposes of this Award, Divisions and Districts
shall be as follows:
1.6.1
Divisions
Northern Division - That portion of the State along or north of a line commencing at the junction of the sea coast with
the 21st parallel of south latitude; from that latitude due west to 147 degrees of east longitude; from that longitude due
south to 22 degrees 30 minutes of south latitude; from that latitude due west to the western border of the State.
Mackay Division - That portion of the State within the following boundaries:- Commencing at the junction of the seacoast with the 21st parallel of south latitude; from that latitude due west to 147 degrees of east longitude; from that
longitude due south to 22 degrees of south latitude; from that latitude due east to the sea coast; from the sea-coast
northerly to the point of commencement.
Southern Division - That portion of the State not included in the Northern or Mackay Divisions.
1.6.2
Districts
(a)
Northern Division -
Eastern District - That portion of the Northern Division along or east of 144 degrees 30 minutes of east longitude.
Western District - The remainder of the Northern Division.
(b)
Southern Division
Eastern District - That portion of the Southern Division along or east of a line commencing at the junction of the
southern border of the State with 150 degrees of east longitude; from that longitude due north to 25 degrees of south
latitude; from that latitude due west to 147 degrees of east longitude; from that longitude due north to the southern
boundary of the Mackay Division.
Western District - The remainder of the Southern Division.

Clause 1.3 – Scope and Persons Bound
1.3.1
1.3.2
Except as provided in clause 1.3.2 this award shall be binding on the industry of the occupations of all persons
(expect as to Clerks) engaged in or in connection with the preparation, manufacturing, processing and/or
storage on site of the following products:

clay and/or shale bricks, (including glazed and/or texture-facing bricks), pavers, tiles (including roofing
tiles), and clay blocks for use in the construction of walls or building;

earthenware pottery, chinaware, porcelain, and terracotta in whatever form;

but not fibre bricks and/or acid resisting bricks.
This award shall not be binding on those persons who at the time of making this award were subject to an
industrial agreement within the meaning of Schedule 1 Transitional Provisions of the Act or an Enterprise
Agreement under the said Act.
Clause 1.4 – Locality
This Award shall have effect throughout the State of South Australia.

Clause 2 – Scope
This award is established in respect of the industry of manufacturing and or selling of articles made of clay or mud.
Clause 6 – Parties and Persons Bound
Unless otherwise specified, this award shall have application to and be binding upon:
(a)
all employers (whether members of a Registered Organisation or not) who are engaged in the industry specified
in Clause 2 - Scope;
(b)
all employees (whether members of a Registered Organisation or not) for whom classifications appear in this
award and who are engaged in the industry specified in Clause 2 - Scope;
(c)
the following organisations of employees in respect of whom award interest has been determined:

The Australian Workers' Union, Tasmania Branch, and the officers of that organisation and their
members who are employed in the industry specified in Clause 2 - Scope;

Clause 7 – Definitions

'Clay and Mud Products Worker Grade 1' (Percent wage relativity after completion of minimum rates adjustment
process - 100 percent) means an employee who is competent to perform the functions of plant/vehicle/building repairs
and/or alteration and/or installation and/or fabrication and/or maintenance at the qualified tradesman level and who is
appointed as such and may include an employee who does not hold formal trades qualifications but is deemed by the
employer to be equally competent.
An employee classified in this Grade will be expected to become competent in a range of the functions embraced within
this definition and reasonably within his competence and attain an overall working knowledge of the production
process.
A Clay and Mud Products Worker Grade 1 shall be responsible for the quality of the work they perform including its
effect on the overall quality of the product and will be required to identify and rectify problems or potential problems
within the production process.
A Clay and Mud Products Worker Grade 1 may be required to perform the functions of Clay and Mud Products Worker
Grades 2 and/or 3.
'Clay and Mud Products Worker Grade 2' (Percent wage relativity to Clay and Mud Products Worker Grade 1 as
defined - 93 percent) means an employee who is competent and is engaged to operate plant and equipment with little or
no supervision which shall include kiln operator, extruder operator, setting machine operator, mechanical equipment
operator engaged and responsible for clay extraction and/or preparation, fork lift truck driver (as defined), truck driver
and dispatch clerk.
An employee classified in this Grade will be expected to become competent in a range of functions embraced by this
definition and attain a basic knowledge of the overall production process and a thorough knowledge of the equipment
within his field of competence.
Clay and Mud Products Award [AN170016 – Tas]

A Clay and Mud Products Worker Grade 2 shall be responsible for the quality of the work they perform including its
effect on the overall quality of the product and will be required to identify and rectify or cause to be rectified problems
or potential problems within their area of responsibility.
A Clay and Mud Products Worker Grade 2 may be required to perform routine maintenance and/or repair work on the
machinery they are operating and may be required to assist a Clay and Mud Products Worker Grade 1 to perform their
function.
A fork lift driver for the purposes of this definition shall be limited to an employee who is capable to perform that
function as well as other functions within the Clay and Mud Products Worker Grade 2 range of functions.
Clay and Mud Products Worker Grade 2 may be required to perform the functions of a Clay Products Worker Grade 3.
'Clay and Mud Products Worker Grade 3' (Percent wage relativity to Clay and Mud Products Worker Grade 1 as
defined - 85 percent) means an employee who is deemed by the employer to be competent and is engaged to perform
functions not included in Clay and Mud Products Worker 1 and 2 and shall include labouring duties, machine attendant,
mechanical equipment operator (other than as defined in Clay and Mud Products Worker Grade 2) or fork lift truck
driver (other than as defined in Clay and Mud Products Worker Grade 2) and dehackers.
An employee classified as a Clay and Mud Products Worker Grade 3 will be expected to become competent in a range
of duties embraced within the Grade and to obtain a basic working knowledge of the production process.
A Clay and Mud Products Worker Grade 3 shall be responsible for the quality of the work they perform including its
effect on the overall quality of the product and will be required to identify problems or potential problems within the
production process.
'Machine Attendant' for the purposes of this definition means an employee who works on a machine or piece of
equipment in the production process and who exercises discretion as to the operation of that machine or piece of
equipment including the routine starting and/or stopping of that machine or piece of equipment and other elementary
and/or repetitive duties associated with a machine.
'Clay and Mud Products Worker Grade 4' (Percent wage relativity to Clay and Mud Products Workers Grade 1 as
defined - 76 percent) means a trainee who is engaged without previous experience in the industry and shall be so
classified for a period of no more than twelve months.
A Clay and Mud Products Worker Grade 4 will be required to attain a basic working knowledge of the whole
production process and to this end they should be rotated on a range of functions described in Clay and Mud Products
Worker Grade 3.
A Clay and Mud Products Worker Grade 4 shall perform largely under the direction of a leading hand and/or supervisor
and/or a higher graded employee.
