Garbage and Trash 16-1-8 CHAPTER 16 GARBAGE AND TRASH 16-1-1 DEFINITIONS. The following words and phrases for the purpose of this Chapter shall have the meanings respectively ascribed to them in this Section: (A) “Garbage” is hereby defined to include all organic household or kitchen wastes, such as rejected or unused food and food residue and paper necessarily used for wrapping. (B) “Ashes” is hereby defined to include the residue from the combustion of fuel used for heating. (C) “Household Rubbish” is hereby defined to include inorganic incombustible household waste such as tin cans, metal ware, bottles, broken glass, crockery, stoneware and similar refuse resulting from the regular operation of a household, not classed as garbage or miscellaneous rubbish. (D) “Miscellaneous Rubbish” is hereby defined to include combustible rubbish such as papers, boxes, brush and leaves and any other rubbish or waste resulting from the operation of a domestic or business establishment, such as grass cuttings, tree trimmings, debris from building construction, repair or remodeling, discarded equipment and similar waste. (E) “Recyclables” is hereby defined as all newspaper, aluminum, clear glass, chipboard and plastic materials left by residents in the manner prescribed by the Village so as to be picked up by the duly authorized and licensed waste and refuse haulers so authorized by the Village in accordance with the schedule established between the Village and the licensed waste and refuse haulers. (Ord. No. 99-02) 16-1-2 REMOVAL REQUIRED. The owner, occupant or lessee of any premises in the Village shall remove from such premises or otherwise dispose of all garbage, ashes, tin cans, metal ware, broken glass, crockery, stoneware and all refuse and rubbish of every description whatsoever at least once each week and shall keep such premises at all time free and clear of any accumulation of garbage, ashes, tin cans, metal ware, broken glass, crockery, stoneware and all refuse and rubbish of every description whatsoever. 16-1-3 BURNING GARBAGE PROHIBITED. It shall be unlawful for any person, firm, or corporation, to burn, or set fire to, or cause to be burned, or cause to be set fire, any garbage any place within the Village unless so authorized by the Pollution Control Board of the Environmental Protection Agency. (See Chapter 27 – Open Burning) 452 Garbage and Trash 16-1-8 16-1-4 LICENSE FOR PRIVATE REFUSE AND GARBAGE COLLECTION REQUIRED. It shall be unlawful for any person, firm, partnership or corporation to engage in the business of collecting, hauling or transporting through the streets, alleys or public ways of the Village any garbage, ashes, household rubbish or miscellaneous rubbish, as herein defined, without first obtaining a license from the Village to engage in such business. The fee for such license shall be as provided in Section 16-1-11 hereof and shall be payable into the corporate Village fund. The Village Clerk before issuing such a license shall require the owner of such vehicle to obtain the written approval of the Chairman of the Village Health and Safety Committee to the effect that the vehicle to be used for such purpose is satisfactorily constructed to prevent the littering of the street. The Chairman of the Village Health and Safety Committee shall inspect every vehicle licensed under this Section not less than once each year during the term of the license. It shall be required as a condition of receiving a license of operate a waste and refuse hauling operation within the Village that the said duly licensed waste haulers pick up all newspaper, aluminum, clear glass, chipboard and plastic materials left by residents in the manner prescribed by the Village in accordance with a schedule to be established between the Village and the licensed waste and refuse haulers. No licensee granted a license pursuant to this Code shall charge more to Village residents for picking up recycling materials. 16-1-5 LICENSE PREREQUISITES. No applicant shall be granted a license unless he shall have provided himself with the proper and necessary machinery and other appliances for properly taking care of and disposing of said garbage in conformity with ordinance and the health regulations of the State of Illinois, the County of Sangamon, the Township of Cartwright and the Village of Pleasant Plains. No license shall be granted to any applicant who has been convicted of a felony or been guilty of any willful violation of any health or sanitary provisions of the Village, or of this Code, or is in default on any contract with the Village. 16-1-6 ONE CLASS OF LICENSE; TERM. There shall be one (1) class of license issued which license shall entitle the licensee to collect garbage, ashes and rubbish, both household and miscellaneous, as those terms have been previously defined herein. All licenses granted pursuant to this Chapter shall be reviewed annually in April of each year and shall not be renewed if the Village Board determines that the performance of the waste and refuse haulers is not meeting standards established by the Village Board. 16-1-7 COLLECTION. For all customers within the Village corporate limits who have contracted for pick-up service not more often than one (1) time per week each licensee shall provide service to all of said customers on the same one (1) day of each week to the end that except for those customers contracting for pick-up service more often than one (1) time per week all garbage and refuse pick-up by a particular licensee within the Village will be accomplished on one (1) day of each week. 452 Garbage and Trash 16-1-8 16-1-8 BOND. Before a license hereunder shall be issued, each applicant shall execute and deliver to the Village, a surety bond in the penal sum of a minimum of One Thousand Dollars ($1,000.00), running to the Village, such bond to be conditioned that such applicant shall at all times conduct an orderly business and that he shall at all times observe and comply with the ordinances of the Village relative to the license issued hereunder, and that such licensee will pay all fines, penalties and costs which such licensee may incur for any violation of any ordinance of the Village. (Ord. No. 390; 07-02-84) 16-1-9 VEHICLE REQUIREMENTS. All vehicles used in the collection of ashes, household rubbish and miscellaneous rubbish shall have a tight cover over the truck bed. Such cover may be of metal or canvas or similar material, but shall be so designed as to prevent the dropping or falling of any part of the contents therefrom during transportation. All truck bodies used wholly or in part for the collection, transportation and dumping of garbage shall be of all metal construction and shall be of at least nine (9) cubic yards in load capacity. All truck bed covers provided for herein shall be closed at all times while the vehicle is in transit anywhere within the corporate limits of the Village. All vehicles shall be fully insured as to public liability and property damage and employees employed in the operation of said vehicles, whether driver or helper, shall be fully covered by Workmen’s Compensation Insurance. 16-1-10 NO LIMITATION UPON NUMBER OF LICENSES ISSUED. There shall be no limitation upon the number of licenses which may be issued pursuant to this Code. 16-1-11 LICENSE FEE AND TERM. The fee for license provided hereunder shall be Two Hundred Fifty Dollars ($250.00) annually payable in full in advance of issuance of license. No part of said fee may be refunded for any reason unless the license shall not be issued, in which event the entire amount shall be refunded to the applicant.
