CPA Australia – New Members Semester 2, 2015 WIN A MIRCOSOFT SURFACE PRO 3” (“Competition”) Terms and Conditions dated 3 August 2015 A) The Competition 1. Information on how to enter and prize details forms part of the terms of entry for the Competition. By submitting your Entry to this Competition you acknowledge that you have read, understand and accept these Terms and Conditions (including the Privacy Statement in section G). Entries not in accordance with these Terms and Conditions are deemed ineligible. If you do not agree to any of the Terms and Conditions, you may withdraw your Entry prior to the Prize Draw by providing such notice in writing to the attention of the ‘Privacy Officer’, CPA Australia Ltd at Level 20, 28 Freshwater Place, Southbank 3006, Australia. 2. The Promoter of the Competition is CPA Australia Ltd (ABN 64 008 392 452) of Level 20, 28 Freshwater Place Southbank VIC 3006 (Promoter). 3. The Competition commences on 14 August 2015 at 00:01 (AEST) and concludes on 30 October 2015 at 23:59 (AEST) (Promotional Period). B) Entry Criteria 4. Entry in this Competition is open to Certified Practicing Accountant (CPA) and Associate (ASA) members of CPA Australia Ltd that: a) are aged 18 years or older; b) reside in Australia; and c) have completed the “Member Benefits new member mini survey” prior to the end of the Promotional Period, (“Entry” or “Entrant”). 5. The Promoter’s: (a) employees, directors and their immediate family members; and (b) agents, agencies and sponsors, are ineligible to enter this Competition. Corporate entities (as described in the Corporations Act 2001 (Cth)) are also excluded from entering this Competition. 6. The Promoter reserves the right to verify the validity of Entries and to disqualify: (a) any Entry which in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements; (b) any Entrant who tampers with the entry process (referred to in Clauses 4 and 5 above); (c) any Entrant who, in the opinion of the Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or the Promoter; or (d) any Entry that is not in accordance with any of these Terms & Conditions. 7. Entries for this Competition must be received by the Promoter during the Promotional Period. 8. Should an Entrant’s contact details change during the Promotional Period, it is the Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an Entry should be directed to Promoter in writing to the attention of the ‘Privacy Officer’, CPA Australia Ltd at Level 20, 28 Freshwater Place, Southbank 3006, Australia. C) Selection of the Winner(s) 9. The Competition will be a random draw competition from valid Entries received during the Promotional Period. An individual is limited to one (1) Entry. One Entry will equal one entry into the Competition. 10. The prize draw will take place at the Promoter’s head office at Level 20, 28 Freshwater Place, Southbank Melbourne 3006, at 16:00 (AEST) on Monday 12 November 2015 (Prize Draw). One (1) Entrant will be drawn at random as the winner of the Competition (individually referred to as the “Winner”). 11. The Winner will be notified in writing and on CPA Australia’s website within ten (10) business days of the Prize Draw. 12. The Promoter reserves the right to request the Winner provide proof of identity, proof of residency at their nominated Prize delivery address and/or proof of Entry in order to claim a prize. In the event that an Entrant cannot provide suitable proof, the Winner will forfeit the Prize in whole and no substitute will be offered. 1 of 3 13. The Promoter reserves the right to disqualify a Winner retrospectively if the Promoter becomes aware that the Winner or the Winner’s Entry is of a type described in clause 6 above or if the Winner does not comply with clause 12 of these Terms and Conditions. 14. If there are no valid Entries during the Promotional Period then no Prize(s) will be awarded. 15. Subject to any direction given under relevant State legislation, if a Winner is unable to be reached (following reasonable attempts by CPA Australia) and such Winner does not claim the Prize within a reasonable period of time (as deemed reasonable by CPA Australia), a Competition re-draw will be undertaken by the Promoter on Wednesday 10 March 2016, and another winner of the Prize will be selected (Second Chance Winner). If a Second Chance Winner is selected, any clause of these Terms and Conditions which apply to a Winner will, where appropriate, apply to the Second Chance Winner. 16. The Second Chance Winner will be notified in writing, and on CPA Australia’s website within 10 business days of the relevant Competition re-draw. The Second Chance Winner may have their first initial, last name and State of residence published on CPA Australia’s website, its publications (hardcopy or online), on its partners’ websites or publications (hardcopy or online) and (at CPA Australia’s discretion) in the Public Notices section of “The Australian” newspaper within 10 business days of the Competition re-draw. 17. Subject to any non-excludable statutory obligations, the Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result. D) The Prize 18. The “Prize” is a one (1) Microsoft Surface Pro 3 Tablet (128GB) (Model: MQ2-00007 SKU: 546940) valued at approximately $1,398 (inc GST). 19. There is a total of one (1) Prize. The Winner will be entitled to redeem one (1) Prize. 20. To redeem the Prize, the Winner may be required to pick-up the Prize from a location advised by CPA Australia. Prizes cannot be transferred and cannot be redeemed for cash. 21. Except for the Prize, the Winner will be liable to pay for all other fees and expenses (including, but not limited to, fuel, insurances, excess and any other fees and expenses whatsoever) associated with the Prize or generally the Competition. 22. If the Prize is unavailable, for any reason whatsoever, the Promoter reserves the right to substitute the Prize for a prize of equal or greater value, subject to State Regulation. 23. If a Winner does not accept a the Prize or an element of the Prize at the time stipulated by the Promoter, then that Prize or the element of that Prize will be forfeited by the Winner and the Winner will not be entitled and will not receive another prize or incentive (including cash) in lieu. 24. Prize values are based upon the used recommended retail prices as at the date of the Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for change in Prize value between the date of these Terms and Conditions (3 August 2015) and the ultimate Prize redemption date. E) Use of Winners’ Image/Video 25. The Winner(s) hereby permits the Promoter, its employees, agents or contractors to film, photograph, video/audio record the Winner(s) and use such video, image and/or voice for marketing, promotion or advertising purposes in connection with CPA Australia (at its discretion), in any media and medium whatsoever throughout the World (Use Rights) and the Winner will not be entitled to and will not claim any fees or royalties for such Use Rights. 26. The Winner(s) agrees to participate in and co-operate with all reasonable media editorial requests by the Promoter relating to the Prize and the Competition, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the Prize. 27. The Winner provides its express Moral Rights consent with respect to any Use Rights upon its Entry into this Competition. The Winner will not bring a claim in respect of any of its Moral Rights in respect of the Use Rights exercised by the Promoter. 28. It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. F) General Terms 29. The Promoter and each of its related bodies corporate, officers, employees and agents accept no responsibility for any late, lost or misdirected Entries due to technical disruptions, network congestion or for any other reason whatsoever. 2 of 3 30. The Promoter and each of its related bodies corporate, officers, employees, agents and licensees are not liable to the Winner(s) for any tax implications arising out of the Prize or the Competition (including any Fringe Benefits or Personal Income Tax). Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize. 31. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation. 32. Subject to any liability which cannot be excluded at law, the Promoter and each of its related bodies corporate, officers, employees, agents and contractors will not be liable for any loss or damage (including but not limited to indirect or consequential loss) whatsoever which is suffered by any Entrant, Winner(s) (including any Second Chance Winner) or any other person associated with this Competition, that arises out of or is connected with this Competition including, but not limited to; (a) any personal injury or death arising from the Prize or the Competition generally; (b) any incorrect or inaccurate information associated with this Competition; or (c) any technical error that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of Entries. 33. All Entries become the property of The Promoter. Subject to the Privacy Statement below, the Promoter may use the Entrant’s names, addresse(s) and telephone number(s) for future marketing and publicity purposes in any media worldwide without notice and without any fee being paid. G) Privacy Statement 34. Your personal information collected by the Promoter for this Competition (“Personal Information”) is collected and used to: (a) conduct the Competition; (b) process your entry into the Competition; (c) award you any Prizes; (d) identify you as a Competition Winner or Second Chance Winner as appropriate; (e) facilitate future Competition marketing campaigns; (f) conduct analysis or market research; (g) provide you with information on the Promoter’s partner/affiliation products and services; and (h) generally provide you with information on the Promoter’s products, services, events or Competitions. If you are not willing for this to occur you cannot participate in the Competition. 35. The Promoter may disclose your Personal Information to external service providers to which the Promoter has contracted out functions such as printers, mailing houses, IT companies and media and advertising companies, but only for the purpose set out above in Clause 34 of this Privacy Statement. Your Personal Information may be transferred or stored outside the country where the information was collected for the purposes stated above. 36. The Promoter may contact you through e-mail, SMS, telephone or post for the purpose(s) set out above in Clause 34 of this Privacy Statement. 37. You have the right to access or correct any Personal Information we hold about you (subject to any applicable legal exceptions) and can do this via the “Update my profile” service on our website at www.cpaaustralia.com.au. The Promoter will generally provide you with access to your Personal Information. 38. If you do not provide the Promoter with the Personal Information requested, or if you provide the Promoter with inaccurate Personal Information, the Promoter will not be able to process your Entry into the Competition. 39. Entrants’ Personal Information may be disclosed to State and Territory lottery departments and Winners’ names published as required under the relevant legislation/regulations. 3 of 3
