Back to Table of Contents 3|Page Dennis E. Haggerty papers Biography/History Dennis E. Haggerty (1927- ) was a prominent figure in the disability rights’ movement from the 1960s through the 1980s. As an attorney in Philadelphia, Pennsylvania, Haggerty helped secure individuals’ rights in education, protection, and advocacy through litigation, education, and involvement with numerous local and national advocacy organizations. He worked alongside and in organizations such as the Pennsylvania Association for Retarded Children (PARC and now the ARC of Pennsylvania), the National Center for Law and the Handicapped, and the American Bar Association to accomplish these achievements. Haggerty participated in landmark cases such as the Right to Education Case and Halderman et. al. v. Pennhurst State School and Hospital. He also provided his knowledge of the law and intellectual disabilities to numerous organizations such as Research for Better Schools, the President's Committee on Mental Retardation, and the National Advisory Council on the Definition of Developmental Disabilities. The outcomes of Haggerty’s achievements gave people with disabilities freedom from institutions, equal access to education, and equal rights in the community. Dennis Haggerty was born in Philadelphia, Pennsylvania on November 16, 1927. He served two terms in the United States Navy and graduated from Temple Law School in 1955. He began his law career at Novaritis and Haggerty and later at Brisco and Haggerty. Haggerty’s early law career consisted of standard repayment work. Haggerty married his wife Eileen in 1951 and they had one son and three daughters. It was when Haggerty's son, Dennis (Boomer), became extremely ill at a young age and the illness resulted in an intellectual disability that Haggerty's direction changed. This event made Haggerty realize the vast changes that needed to occur in the rights of the disabled for individuals and their families. It is here Haggerty began to be involved in the Disability Rights’ Movement. His initial involvement began with the Delaware County Association for Retarded Children (DELARC and now the ARC of Delaware County), which he joined and eventually became the representative to the state of Pennsylvania. Dennis Haggerty later began as the chair on the Residential Care Committee of the PARC. While on this committee, he investigated Pennhurst State School and Hospital. Prompted by the death of patient John Stark Williams, Haggerty began posing as a doctor and going to Pennhurst to examine the facilities. The investigations helped Haggerty expose the deplorable conditions of the institutions and convinced Haggerty that the only alternative was to close the institution. Haggerty and PARC president Jim Wilson contacted Thomas Gilhool, a respected civil rights attorney who would later work for the Public Interest Law Center of Philadelphia. Under the advice of Gilhool, the first battle in the disability rights’ movement would be to improve the conditions for individuals in education because if the institutions closed, children with disabilities would need the schools to be accessible and open to their entry. This became the Right to Education Case, or the PARC v. The Commonwealth of Pennsylvania. The resulting consent decree, also known as the PARC Consent Decree, opened Pennsylvania’s Schools to children with disabilities. The State was given one year to identify children were not being served or were being underserved. It was this suit where Haggerty acted as a court appointed Master for the State of Pennsylvania. This case was later followed by the Halderman et. al. v. Pennhurst State School and Hospital, where Thomas Gilhool, as lead attorney for the Public 4|Page Dennis E. Haggerty papers Interest Law Center of Philadelphia, represented PARC as a co-plaintiff. The case eventually closed Pennhurst but took over 14 years to complete. In Pennsylvania, Haggerty was actively involved in numerous organization including: a board member at Elwyn Institute; a consultant for Research for Better Schools; a board member Developmental Disability Advocacy Network (DDAN and now the Disability Rights Network of Pennsylvania); a board member of the Education Law Center; an advisory board member of the Delaware County Mental Health and Mental Retardation Board (Delaware Country Mental Health/Intellectual Disability Board); and a board member for the Public Interest Law Center of Philadelphia. In collaboration with these advocacy organizations, Haggerty helped advance the rights of the disabled. For instance, as part of the Delaware County Mental Health and Mental Retardation Board, Haggerty aided in the creation of the Mental Health and Mental Retardation Act of 1966, which initiated drug, alcohol, mental illness, and intellectual disability programs. Involvement in Pennsylvania Disability Rights Movement was only the beginning for Haggerty, who began to work on national and international issues through involvement in numerous organizations including: a board member for the National Center for Law and the Handicapped; a member and chair of various committees for the National Association for Retarded Children (NARC or now The ARC); a member of the National Advisory Council on Developmental Disabilities; and a member of the United States Task Force on the Definition of Development Disabilities. He was a consultant for the President’s Committee on Mental Retardation beginning with President Lyndon B. Johnson to President William J. Clinton. Haggerty was also a member of the American Bar Association, where he began the first committee dealing with intellectual disabilities and the law in the Family Law Section. With this committee, Haggerty conducted workshops at the American Bar Association’s annual conventions. It was here that he also got his start with the National Center for Law and the Handicapped. In addition to his long-term involvement with many organizations, Haggerty participated in numerous conferences, symposiums, and events both locally and internationally as a speaker and lecturer for the cause of education the public and promoting disability rights. For instance, he was a guest lecturer at the International Convention for Retarded Citizens in Montreal, Canada and he was the Vice Chair of the Symposium on the Legal Rights for the Mentally Retarded in Columbus, Ohio. He also did local lectures in Delaware County, such as a lecture at the Drexel Hill Junior High School in Drexel Hill, Pennsylvania. Dennis Haggerty’s skills as a lawyer and experience as a parent of a child with an intellectual disability enabled Haggerty to be an asset to the disability rights’ movement in Pennsylvania and throughout the United States. His role as an innovator in disability rights, his drive to educate others, and his vast involvement in organizations working for the movement made him a key player. His participation in the Disability Rights’ Movement helped initiate deinstitutionalization, created equal access to education, and eventually gave people with intellectual disabilities equal opportunities in the community. Conferences, presentations, and events, 1968-1980, undated This series demonstrates Dennis Haggerty’s involvement in numerous conferences, meetings, presentations, workshops, and symposiums. The materials include agendas, attendee packets, correspondence, handwritten notes, informational brochures, meeting minutes, newsletters, newspaper clippings, programs, and travel literature. This series does not have materials for organizations represented in the collection elsewhere unless the event was a gathering of multiple organizations such as the “Southwest and Regional Associations for Retarded Children, Pennsylvania Association for Retarded Children, and President’s Committee on Mental Retardation Conference.” On some files, Haggerty noted whether he attended the event and this information is preserved on a photocopy of the original folder. Folders are arranged in alphabetical and then chronological order according to the folder title. The series contains events as local to Haggerty as the Drexel Hill Junior High School and events as far as the International Symposium on Collaboration between Parents, Staff, and Clients in Copenhagen, Denmark. Delaware County Association for Retarded Children, 1966-1994, undated This subseries details Haggerty’s involvement as a board member, president, and council member of the Delaware County Association for Retarded Children (DELARC), known as the ARC of Delaware County (DelARC) in 2012. Established in 1967, DELARC worked to provide support for individuals with intellectual disabilities and their families. DELARC was a contributor in the Right to Education Suit and the Mental Health/Mental Retardation Act of 1966. The subseries contains administrative records, bylaws, booklets, brochures, correspondence, memorandums, newsletters, newspaper clippings, plans, programs, and proposals. Of note in this subseries are the materials related to zoning and DELARC’s move to establish group homes in Delaware County. Delaware Country Mental Health/Mental Retardation Board, 1967-1974, undated This subseries documents Haggerty’s participation on the Delaware County Mental Health/Mental Retardation Board, which as of 2012 was called the Delaware County Mental Health/Intellectual Disability Board. The Board’s responsibility was to establish programs for drugs, mental illness, alcohol, and intellectual disabilities. These responsibilities are documented through agendas, correspondence, minutes, plans, proposals, and reports. The bulk of the subseries is meeting files, which typically contain updates and reports on various services offered for mental health and to intellectual disabilities in Delaware County, Pennsylvania. Developmental Disabilities Advocacy Network, 1977-1979, undated This subseries contains correspondence, minutes, agendas, and research associated with Dennis Haggerty’s involvement as a board member on the Developmental Disabilities Advocacy Network in Pennsylvania (DDAN). Formed to aid in the execution of the Developmental Disabilities Assistance and Bill of Rights Act in the State of Pennsylvania, Developmental Disabilities Advocacy Network’s goals were to determine the extent of discrimination in Pennsylvania and to be a protection and advocacy agency. As of 2012, Developmental Disabilities Advocacy Network was known as the Disability Rights Network of Pennsylvania. The records in this subseries consist of Developmental Disabilities Advocacy Network’s early years, where the goal was to analyze the extent of discrimination in Pennsylvania. Elwyn Institute, 1965-1979, undated This series documents Dennis Haggerty’s involvement as a board member at the Elwyn Institute for the years 1965 to 1979. The Elwyn Institute began as a live-in residential facility for children and young adults with disabilities in Philadelphia. As of 2012, the Elwyn Institute no longer offered residential services, but it offered program and training services. Haggerty’s interest in the Elwyn Institute was on not only a professional level, but also a personal level because his son Dennis (Boomer) resided at the Elwyn Institute for a period. The series contains administrative records, brochures, correspondence, financial records, meeting minutes, memorandum, and reports. These files contain agendas, articles, brochures, employment information, facilities information, minutes, memorandum, and published materials for Elwyn Institute. Through reports, the records also document the activities several committees at Elwyn Institute. Of interest in this subseries is papers relating to the establishment of the Elwyn-Nevil Center for the Deaf and Hearing Impaired and the conflicting opinions of individuals regarding its creation. There is a material tipped in the folders that appears unrelated to the Elwyn Institute. According to Haggerty’s resume, he was involved at Elwyn Institute until at least 1994, but the records only document his involvement from 1965 to 1979. PARC, known in 2012 as the Arc of Pennsylvania, was an advocacy network for individuals with intellectual disabilities and their families. It was instrumental in the investigation and eventual suit against Pennhurst State School and Hospital (Halderman et. al v. Pennhurst State School and Hospital) and the Right to Education Suit (PARC v. Commonwealth of Pennsylvania or the resulting PARC Consent Decree). Dennis Haggerty was involved in the Right to Education Suit through PARC and in his role as a court appointed Master. The Pennsylvania Association for Retarded Children subseries is organized into three sub-subseries in the following order: General files, Pennhurst State School and Hospital, and Right to Education Case. General File, 1962-1980, 1987, 1999, undated This sub-subseries documents PARC activities not directly related to the Right to Education Case or Pennhurst, although information on these topics may be included in some of the folders. The sub-subseries contains brochures, case files, correspondence, docket sheets, ephemera, fliers, minutes, newsletters, newspaper clippings, and planning files. Folders are arranged alphabetically by title and then chronologically. The majority of this sub-subseries is represented by convention files, correspondence, and general files. The convention materials include agendas, convention publications and brochures, correspondence, minutes, travel brochures, and travel information. The general files are typically a collection of materials printed and distributed by PARC. Some materials were mailed directly to Haggerty in packages and never separated. They include updates, newsletters, fliers, calendars, and correspondence. The case files are of interest because they include Haggerty’s personal investigations and research into various state schools and hospitals. They contain correspondence, handwritten notes, memorandum, and newspaper clippings regarding investigations of facilities such as Polk State School and Hospital and the Mitchell Home. Although there are significant gaps in the dates, various meeting files for committees such as the Residential Care Committee, Governmental Affairs Committee, Legal Advisory Committee, and the Task Force on Commitment Procedures are represented in this subseries. Pennhurst State School and Hospital, 1960, 1967-1980, 1985, 1999, 2000, undated This sub-subseries documents the Pennhurst State School and Hospital’s investigation and the resulting court case, Halderman et. al. v. Pennhurst State School and Hospital. Pennhurst State School and Hospital was located in Spring City, Pennsylvania. It was a self-providing, live-in facility with 50 buildings and approximately 2800 residents. Dennis Haggerty investigated the facility while he was Committee Chair of the Residential Care Committee in 1968 and 1969. The sub-subseries contains correspondence, court cases, handwritten notes, newspaper clippings, publications, and reports. Folders are arranged alphabetically and then chronologically. Although it is incomplete, of special interest is Haggerty’s story of his personal investigation into Pennhurst State School and Hospital. Haggerty’s story combined with the evaluation of the facilities by the American Association on Mental Disorders and the hearing report of the Special Committee to Investigate State Inspection Institutions under Jurisdiction of the Department of Welfare, offer a glimpse into the Pennhurst State School and Hospital. Also of interest are the conflicting views of parents regarding the closing of Pennhurst reflected in letters and newspaper clippings. Right to Education (Pennsylvania Association for Retarded Children Consent Decree), 1969-1979, undated This sub-subseries documents Dennis Haggerty’s involvement as a member of Pennsylvania Association for Retarded Children in the Right to Education Case, which resulted in the Pennsylvania Association for Retarded Children Consent Decree in 1971. PARC won the Right to Education Case against the Commonwealth of Pennsylvania, the Secretary of the Department of Education, the State Board of Education, and the Secretary of the Department of Public Welfare. The resulting agreement allowed access all school-aged children, previously denied public education, to attend public schools. The agreement also ordered the development of two programs: the Commonwealth Plan for the Identification, Location and Evaluation of Mentally Retarded Children (COMPILE) and Commonwealth Plan for the Education and Training of Mentally Retarded Children (COMPET). COMPILE provided for the creation of 29 local task forces and a state task force to ensure that the Right to Education agreement persevered. PARC and the Pennsylvania Department of Education and Public Welfare jointly organized COMPILE and COMPETE. This subseries includes correspondence, court cases, fliers, memorandum, newsletters, reference materials, and reports. Of interest in the sub-subseries are promotional materials by PARC, including “Childhunt” materials, which document PARC’s effort to find children with disabilities and place them in the public education system. Also of interest in the sub-subseries is Testimony before U.S. Senate Subcommittee on the Handicapped on Senate Bill 6, Education for all Handicapped Children Act, which gives information on some of the outcomes of the Right to Education Case and areas that needed improvement. Commission on the Mentally Disabled, 1975-1979, undated As of 2012, the Commission on the Mentally Disabled was called the Commission on Mental and Physical Disability Law. In the records, the Commission on the Mentally Disabled is largely represented by two large projects, the Developmental Disabilities State Legislative Project and the Bar Funding Program. The Bar Funding Program was a grant-funded program that provided legal services to the developmentally disabled through state and local bar associations. The Developmental Disabilities State Legislative Project was a grant-funded project that created legislative models for states regarding the rights and protection of the developmentally disabled. This sub-subseries contains materials collected by Dennis Haggerty during his time with the Commission on the Mentally Disabled. The National Association for Retarded Children, called The Arc in 2012, was a national advocacy organization for individuals with intellectual disabilities and their families. It provided services and support for individuals and advocated for legislation to aid individuals and their families. The majority of the records deal with the National Association of Retarded Children annual conventions. National Center for Law and the Handicapped, 1972-1980, undated Founded in 1971 at the University of Notre Dame in South Bend Indiana, The National Center for Law and the Handicapped (NCLH) was a legal advocacy center for individuals with disabilities NCLH sought protection for individuals with disabilities in the areas of medical care, education, and employment and was funded by the Bureau of Education for the Handicapped, Office of Education, the Developmental Disabilities Office, and the United States Department of Health, Education, and Welfare. Dennis Haggerty, with the American Bar Association, was an original supporter and board member for the center. The task force’s responsibility was to define developmental disabilities in order to create more clarity in the Developmental Disabilities Act, but also so that states and organizations had a synonymous meaning of developmental disabilities. This subseries consists primarily of correspondence from numerous organizations and state programs associated with intellectual disabilities. There are also a number of meeting files including agendas, minutes, and reports. Of interest in this subseries are the correspondence various organizations and states regarding the definition of developmental disabilities. President’s Committee on Mental Retardation, 1962, 1967-1980, 1986, undated (Bulk 1967-1977) The President’s Committee on Mental Retardation, called the President’s Committee for People with Intellectual Disabilities in 2012, began with President Lyndon B. Johnson, who formally established the committee in 1966. The goals of the President’s Committee on Mental Retardation were to inform the Secretary of Health and Human Services and the President about topics affecting individuals with intellectual disabilities and the intellectual disability field. Dennis Haggerty served as a consultant for the President’s Committee on Mental Retardation and was active with presidential committees dealing with intellectual disabilities beginning with Lyndon B. Johnson to William J. Clinton. This subseries documents Dennis Haggerty’s involvement as a consultant with the President’s Committee on Mental Retardation. This subseries contains agendas, brochures, conference materials, correspondence, memorandum, minutes, newspaper clippings, newsletters, publications, travel materials, and reports. The newspaper clippings are from Haggerty, but there are also a number of packets of newspaper clippings created by a newsclipping service for the President’s Committee on Mental Retardation. The publications cover a variety of topics including the history of the Disability Rights’ Movement, the advances in the Disabilities Rights’ Movement, advocacy, transportation, and residential services. There are a number of reports in 50 | P a g e Dennis E. Haggerty papers the subseries, for instance "MR 72: Island of Excellence." These reports are to the president and discuss various advancements in the disability rights and the areas that need improvement. Folders are arranged alphabetically by title and then chronologically by date. The bulk of the materials date from 1967 to 1980. Haggerty’s resume states that he was involved with the President’s Committee on Mental Retardation until approximately 1994, but these materials are unaccounted for in these records. Right to Education Case, Masters (Pennsylvania Association for Retarded Children Consent Decree), 1969-1974, undated This subseries documents Haggerty’s involvement as a Master in the Right to Education Case and the resulting Pennsylvania Association for Retarded Children Consent Decree. Haggerty’s involvement in the Right to Education Suite was with PARC, but he also served as a court appointed Master. In 1972, PARC won the Right to Education Case against the Commonwealth of Pennsylvania, the Secretary of the Department of Education, the State Board of Education, and the Secretary of the Department of Public Welfare. The resulting agreement allowed access all school-aged children denied public education to attend public schools. The agreement also ordered the development of two programs: the Commonwealth Plan for the Identification, Location and Evaluation of Mentally Retarded Children (COMPILE) and Commonwealth Plan for the Education and Training of Mentally Retarded Children (COMPET). COMPILE provided for the creation of 29 local task forces and a state task force to ensure that the Right to Education agreement persevered. PARC and the Pennsylvania Department of Education and Public Welfare jointly organized COMPILE and COMPETE. The series contains agendas, articles, correspondence, court cases, meeting minutes, plans, reference materials, and reports. Of interest in this series are materials documenting the outcomes of the Right to Education Case, including the programs COMPILE and COMPET and the reports of the task forces assisting with carrying out the agreement.
