Affinity Water Registered Office: Tamblin Way, Hatfield, Hertfordshire AL10 9EZ Tel: 01707 268111 (main switchboard) Email: hydrant.licensing@affinitywater.co.uk Registered in England No. 254695 TERMS AND CONDITIONS OF HYDRANTS/STANDPIPES USE Affinity Water Ltd (“the Company”), under Section 59 of the Water Industry Act 1991, has a duty to supply water, following requests from certain organisations for public purposes upon such terms and conditions as may be reasonable. - The term 'public purposes' in this context refers mainly to the cleaning and maintenance of the highway and to drainage systems. 1. The conditions are as follows: Each standpipe or other fitting or appliance used to draw water from an identified hydrant (any change of location to be notified as provided by clause 8 below) must be approved by and registered with the Company, and a licence fee and deposit must be paid in advance. * 2. A copy of the licence must accompany each appliance and be produced at the request of a Company representative. The licence cannot be transferred to third parties including sub-contractors who must apply for a licence in their own right. 3. Each standpipe or other fitting used to draw water from a hydrant must be fitted with a suitable device to prevent backflow, such as an approved double check valve assembly. Standpipes not fitted with such a device will not be permitted to be used. 4. The Company, can provide standpipes (20mm or 63mm diameter) for hire or sale. The standpipe, key and bar will, at all times, remain the property of the Company and must be returned to the Company promptly at the end of the term of hire or on termination of the agreement by the Company as provided by these conditions. 5. All persons using the Company hydrants must prove their competence to use them. The Company provides a Hydrant Use Training Course. 6. Water drawn from a hydrant must only be used for the purpose specified in the application and under no circumstances should be allowed for domestic purposes. Hydrants must not be kept open allowing water to run to waste. 7. All standpipes, hoses and associated attachments must be disinfected with ‘Milton’ prior to use. They must be kept clean at all times, and not be allowed to come into contact with other equipment or materials likely to contaminate them. Where a hose is used, care shall be taken to ensure that its outlet is always kept visible to the operator. Under no circumstances shall a hose outlet be placed into a gully, drain, manhole, culvert or ditch. 8. All standpipes, hoses and associated attachments must be maintained properly in order to minimise the risk of contamination, backflow and waste. Damaged and worn apparatus must not be used. 9. An Affinity Water tag is to be attached to a private standpipe for the period of hire only. After this period, or if the hire agreement is terminated, the tag is invalidated and must be returned to allow a full refund of the deposit. 10. The User shall pay the cost of any damage caused to the property and apparatus of the Company whilst carrying out operations under this consent. All damage howsoever caused to Company property must be immediately reported to the company. It is therefore important that the Company be informed, if the user wishes to transfer use from other than agreed locations. 11. The Company will not under any circumstances accept liability in respect of any loss or damage caused to the property of any person or persons wherever situated by reason of the position, use or operation of the hydrant, standpipe or hoses. Further, the Company will not be held liable in respect of any injury suffered by any person or persons by reason of the position, use or operation of the hydrant, standpipe, or associated hoses. The user, by signing or submitting the Application for Hydrant Use/Standpipe Hire agrees to indemnify Affinity Water against all actions, claims, damages or demands, which may result in respect of any such loss, damage, or injury. Further, the user confirms that a full public liability insurance policy is in force to cover the acts, omissions or otherwise of the employees or contractors of the user. 12. The Company and any Fire Authority retain the right to remove any apparatus from the water network at any time and for any purpose. Affinity Water will not be liable for compensation claims in relation to a loss of use of supply following the removal of the apparatus. 13. The Company will: a. (Subject to the general right above for the Company and the Fire Authority of removing any apparatus from the water network). Endeavour to give 7 (SEVEN) days reasonable notice in writing to the contact address of the user by ordinary 1st Class Post, to terminate this agreement for the user to thereafter return the property immediately after expiry of the said notice, b. Terminate any consent to use a hydrant at any time should the user be in breach of any of these terms and conditions; c. Instigate prosecution proceedings in respect of: i. water taken in contravention of these terms and conditions ii. any contravention of Affinity Water Ltd regulations or other statutory provisions made for preventing waste, undue consumption, misuse or contamination of water; iii. any contravention of any Drought Order that may be imposed and at the time in force. * Details of costs are shown in our charges leaflet
