Special Conditions of Contract.

Special condition of Contract for the work of : - Disposal of

Garbage, Supply of Garbage bins and Grass / jungle cutting works at NRL Township .

Scope of work :- Scope of work for this contract shall include but shall not be limited to the following : It includes daily collection of garbage from garbage bins placed at residential quarter and public places ( Two bins shall be placed at each residential unit in which Biodegradable and non-biodegradable garbage shall be stored. Vendor has to collect them separately), its loading, transportation, unloading in the garbage pit at the designated area, segregation of biodegradable garbage from plastics and other nonbiodegradable garbage (if carried over) , mixing cow-dung and urea with it and then leveling biodegradable garbage in proper layer . It also includes sweeping the roads, walk ways, plantation strips and keeping roads in clean condition. Under the vendor's scope of work they have to collect garbage bins of approved quality and place them at designated locations.

All garbage bins should also be flushed and cleaned at certain interval. Further contractor has to do grass cutting along the roads and in the areas advised by Engineer-In-charge.

Technical Aspect for scope of work.

i. The garbage produced in NRL can be classified as followed:- a. House use / Canteen Garbage:- Vegetable waste matters, rubbish, debris from cleaning and demolishing of structures, Plastic and polythene bags etc.

b. Street garbage:- street refuse. Street sweeping, dirty materials dropped from Vehicles, free leaves, empty match and cigarettes, toys, fruit peels, empty packets, plastic/polythene bags etc.

ii. Types of garbage:- The Garbage can be broadly classified in to three categories:a. Solid garbage which cannot be processed such as plastics, bottles, polythene bags etc.

Page 2 b. Biodegradable garbage : ( which can be processed and utilized as manure Producing gases ) Vegetable & food

waste , leaves, fruit peels etc. are example of such garbage. c. Scraps : Bottles etc iii. Storage:-

The biodegradable and non-biodegradable garbage shall be segregated at source by storing them in two separate bins placed at each residential units. In public places/ streets, bins are provided at suitable interval and the garbage obtained by cleaning / sweeping the roads are stored in the bins at suitable places.

iv. Collection of Garbage:-

The collection of biodegradable and non-biodegradable garbage shall be done separately in closed Trucks/Tractor

(sides and bottom of the truck should be leak proof) and taken to the disposal ground. The biodegradable are to be further separated (for any carryover) according to processable (bio-degradable) and non processable (nonbio-degradable) masses.

The garbage will be sorted out manually/ through mechanical means in to 3 parts. a. Scraps: Bottles etc.

b. Solid garbage which can not be processed viz plastic bottles / polythene bags, building demolition materials etc.

c. Biodegradable garbage which can be processed viz, vegetable & food waste matters, leaves, fruit peels etc v. From the garbage once the plastics and non - biodegradable garbage are segregated, the biodegradable mass should be mixed with cow dung and urea and spread and leveled in the pit. Biodegradable garbage are filled in the thickness of 0.3 mtr.

vi. All non-biodegradable garbage (scrap and solid garbage) shall be stored properly in a separate pit .

vii. Flushing / cleaning of garbage bins shall be done at a central location near STP as and when advised by EIC.

Consolidated Maintenance Services:

1. Garbage disposal and road cleanliness services shall be provided by the vendor to NRL Township on daily basis.

Grass cutting shall be done as and when advised by the

EIC.

2. They shall maintain register for the job done and record activities done on day to day basis, get it signed by the genuine user / resident and get it approved from T&I office. They shall submit job done/ materials status report in the format as sought by EIC on daily / monthly basis to T&I office for MIS.

3. Purchase and supply of new items: The contractor shall be responsible for purchase and supply of all consumables.

It should be of standard quality. Receipt of materials shall be duly recorded and get countersigned by NRL T&I officials.

Criteria for selection /consideration of tender:

1. The contractor shall submit the bid in two parts i.e. technical and price bid. In part one i.e. technical bid he will submit the detail scheme for handling of the contract with manpower and machinery deployment at the site if he gets the contract including list of transportation facility/ tools and tackles and safety equipment.

2. The organogram with qualification and experience of the personnel, proposed to be deployed for the job should be specified. The minimum eligibility criteria for the level of skilled personnel shall be :

Supervisor : Matriculate with minimum 5 years of supervisory experience.

The minimum no. of personnel to be deployed is as below :

Supervisor : 1 no.

Sweeper / Cleaner : 15 nos.

The above nos. of manpower deployment is the minimum requirement and have to be augmented as per periodic assessment of job. The decision of E-I-C shall be final and binding on the contractor.

3. The vendor should arrange himself 2 (two) nos. of trucks/ tractors for shifting of the garbage. The trucks/tractors should be in good working condition and not more than 5 years old and it should be leak proof from bottom and sides. Separate trucks/tractors should be deployed for collection of biodegradable and Nonbiodegradable garbage.

4. Vendor should have experience of garbage handling or housekeeping or waste management services.

5. Vendor will be considered only when NRL is satisfied with his experience and capability to take up this work.

Special Condition of Contract:-

1. Compliance of all statutory requirements pertaining to engagement of contractual labours shall be sole responsibility of the contractor. And contractor shall furnish required documents as and when asked for.

2. Supervisors engaged by the contractor must be aware of industrial safety norms and should have attended safety awareness program with NRL's F&S Deptt. Supervisor's who have not attended safety awareness program with NRL's F&S deptt. may also be considered based on their previous experience but have to undertake the training at the earliest.

3. Supervisors / Contractor need to report to Site Engineer/

EIC every day as per instruction and shall strictly execute the job under his supervision in compliance with all the safety and operational requirement. By the end of the day/ shift the supervisor shall seek advice from Site

Engineer / In -charge regarding mobilization required for the subsequent job requirement. No mobilization shall be undertaken without prior consent of the Site Engineer/Incharge.

4. Supervisor shall be conversant with work permit system in addition to required job specific technical competence to execute the job.

5. Contractor shall issue, to each employee, following personnel protective equipment as a minimum but not restricted to: a) One pair of Boiler suit (every year) b) One pair of safety shoe (every year)

Page 5 c) One pair of safety Gum boots (it should be always available to the workers those are engaged in garbage collection / segregation / mixing.) d) Leather/ rubber gloves. e) 1 nos. safety Helmet. f) Rubber gloves for handling chemicals (To those engaged in garbage collection / segregation/ bin cleaning)

All protective equipment for the employee is to be submitted with the Engineer-In charge at the time of taking over the site. The amount of Rs. 10000/ (approximately equal to provision for safety purposes) shall not be released from the first month's bill till the contractor provides genuine personnel protective equipment and dress to the workers.

Necessary deduction shall be made from contractor as per subsequent penalty clauses if his employee fails to posses any of the above.

6. Contract is organized on item rate basis for 24 months but mid term review of the contract shall be made after

Three months and depending upon performance of contractor job may be terminated if performance is found unsatisfactory.

7. Payment shall be made on the basis of actual executed quantity considered on monthly basis for RA bill.

Contractor must submit their monthly bill regularly in time. But wage payment of the workers can not be linked with the payment of monthly bill by the NRL.

8. Item wise estimated quantity is tentative only and no guarantee can be given for assured quantity offered for execution. It shall be at discretion of the EIC to offer items quantity for execution or non-execution depending upon the site condition. No compensation can be claimed for variation in the items quantity.

9. All contract related documents like job cards / complain register / material registers etc shall be maintained at site and should be produced as desired by EIC as and when required.

10. For the lifting of garbage bins from public places following equivalent nos of residential units shall be given as measurement to the contractor :

Equivalent Residential Unit for any new area decision of EIC shall be final.

11. Job should not be subletted to other party.

Penalty clauses:-

1. Contractor has to deploy adequate manpower,

Transportation facility and other infrastructure so that he can collect, transport, segregate, mix, level and dispose off garbage from minimum of 50 % of the total nos of residential units at township every day

(excluding Sundays)

2. He should deploy separate vehicle and manpower for biodegradable and Non-biodegradable garbage collection and segregation purposes.

3. Penalty may be imposed by Engineer In charge under following conditions @ Rs 500 per occasion.

a. If during inspection found that segregation of biodegradable and non-bio-degradable garbage (plastic, bottles etc) is not done properly.

b. Cow-dung and urea is not supplied within specified interval or when asked by E-I-C.

c. Garbage are disposed off on the ground instead of inside the garbage pit.

d. Garbage pits are not cleaned after EIC instructions. e. If foul smell is reported due to leakage of stale juice from the vehicle f. If on verification of any residential units of the area for which contractor has claimed to clear the garbage, and it is found that garbage bins has not been cleaned in those Qtrs.

4. Garbage bins of the whole Township should be cleaned off within two consecutive working days. If per day collection, transportation, segregation and disposing of garbage bins are less than 50% (continuously for two working days) then deduction (condition applies) shall be made from the total bill at the rate of Rs.2 per deficient nos. of residential units per day.

5. Cleanliness of the road shall be the responsibility of the contractor which includes sweeping leaves, dust, dirt from footpath, plantation strip and roads.

(Condition Applies : If the job is hampered due to justified reasons such as interference like rain / Bandh etc the above deduction can be waived at the discretion of EIC.

6. Contractor has to submit nos of residential units cleaned off and area of road cleaned everyday for measurement purpose which shall be checked on random basis by NRL T&I office personnel.

7. An amount of Rs 10,000 nearly equivalent to safety PPEs purpose shall be kept under hold from the payment of first bill till the contractor provides complete safety

Personal protective equipment including Safety shoe and boiler suit / dress to the workers. Further an amount of

Rs 800 shall be deducted per month from the bill of contractor for each month of delay (or proportionately for mid period) in providing complete PPE.

8. Contractor shall ensure that Minimum wages and Provident fund payment are made in time on monthly basis. Wages to it's employees is paid by 5th of every subsequent month and in no case shall be delayed beyond 10th of every month. In case of failure to do so and on the complain of bonafide worker NRL reserves the right to disburse the minimum wages amount among contractor employees from the bill of the contractor with a proper notice.

9. All penalties can be imposed concurrently and the amount shall be deducted from the total bill value of the current/ final bill under the processing at the time.

Decision of the Engineer In-charge shall be final in all above cases of penalty imposition and it will be at his sole discretion to decide, impose, implement or waive penalty clauses.

Other Terms and conditions:

1. The special condition of contracts and penalty clauses supercedes all condition put forward by contractor.

2. Conditions not covered above shall be governed by the GCC of NRL.
