1.0
Background
1.1
The existing urban schemes are the Town Planning Schemes of Hilton and
Howick, and the Pietermaritzburg Scheme which covers Worlds View.
1.2
Draft Schemes were prepared for Nottingham Road Village and Lidgetton
West. These were never formally adopted in terms of the Town Planning
Ordinance, but were work-shopped with the communities and have therefore
been used as a guide in the amalgamation process.
2.0
Methodology
2.1
The zoning controls relating to each existing zone were compared, and a
proposed rationalization of these is included in the attached set of Tables.
2.2
This proposal was discussed with the staff who deal with day to day planning
during 2006.
2.3
The following areas are recommended for densification:
2.3.1 In light of the existing lot size of 1500m² in the Worlds View Special
Residential area, the findings of geotechnical investigations undertaken
in 2000 by the Council for Geoscience, and an analysis of the prevailing
erf sizes in the Special Residential areas of Hilton, the existing Special
Residential 1 zone in Hilton will be incorporated into a zone with a
minimum erf size of 1500m². This will also be applied in Nottingham
Road Village. The 10% dispensation in erf sizes is proposed to fall
away. Any subdivision proposal shall be accompanied by percolation
tests to demonstrate that subdivisions can be served by Septic
tank/French drain systems and a plan showing proposed access points,
the potential platform for a house, and the position of the Septic Tank /
French drain systems
2.3.2 All other residential erven in Winterskloof are proposed to have a
minimum erf size of 4000m2. The 8000m2 lot size will fall away.
2.3.3 The minimum erf size for Agriculture in the Hilton area is to be reduced
to from 20 to 5ha.
2.4
Zonings for areas that are within the identified urban nodes but that lie outside
of the existing schemes have been devised. Existing land use was taken into
account, as well as development approvals. The majority have been zoned
for Agricultural purposes, with a minimum lot size of 5 Hectares. This will

mean that as development is proposed, rezoning proposals and applications
in terms of the National Environmental Management Act will be required. The
aspects of servicing and access will need to be addressed for each proposal.
Future zoning is to take into account the uMngeni Spatial Development
Framework.
2.5
The Resolution of Council to prepare the Urban Scheme was only approved
by the KwaZulu-Natal Planning and Development Commission in March 2009.
Work on the Urban Scheme recommenced in April 2009. This Resolution falls
away in terms of the transitional arrangements in the Planning and
Development Act (PDA).
2.6
All 2006 mapping work had been undertaken in CAD format. As from May
2009 updated cadastral information was captured in GIS format, and existing
mapping for the urban areas was converted to GIS. Information on approved
DFA applications and adopted rezoning applications were also considered.
Listings in these regards are included as Annexures A and B to this report.
The Mpophomeni Nodal Development Plan was a further informant used to
update zonings.
2.7
Ngonyama Trust Board land which is managed by the responsible Traditional
Authorities in Nxamalala and Inadi has been included into the urban scheme.
Controls proposed for the existing settlement areas envisage the continued
allocation of land uses in terms of the existing procedures as applied by the
Traditional Authority, but additional consent will be required by the uMngeni
Municipality for uses other than those of a residential or agricultural nature,
such as schools, community facilities and shops. This means the level of
control remains the same as at present in terms of the Planning and
Development Act for these areas. There is no cadastral base to assist in
identifying individual homestead areas, but the position of the primary access
roads, as previously discussed with the relevant authorities, have been
indicated as reservations. As more detailed planning for these areas is
completed, it will be possible to improve the level of mapping and zoning.
Areas that are not yet developed are zoned as Urban Agriculture.
2.8
Amalgamated Scheme Clauses were originally drafted during 2009, but were
reviewed to align with the Planning and Development Act (PDA).
2.9
The Urban Scheme Rationalisation has been further adjusted to take into
account updated 2011 Provincial Guidelines for the Preparation of Schemes,
and the relevant provisions of the Spatial Planning and Land Use
Management Act (SPLUMA)
2.10
The 2013/14 update has included additional zones created through the
zonings adopted for the Hilton Mondi Development, the Hilton College Estate
and other recent approvals.
2.11
