Procedure: Granting work permits to foreigners working in
industrial zones, economic zone.
-The sequence of execution:
Step 1: Full file prepared in accordance with the law.
Step 2: Filing in Phu Yen Economic Zone Authority.
The civil servants receiving files, check the validity and content of
files:
+ The case of valid files, write a receipt and an appointment to receive
results.
+ The case of files are incomplete, the civil servants receiving files
explain, guide for the filing of additional file in accordance with the
regulation.
Time receiving files during working hours from Monday to Friday,
except holidays.
Step 3: Pay results in Phu Yen Economic Zone Authority.
Time to pay results in hours of work from Monday to Friday, except
holidays.
- How to: Directly in Phu Yen Economic Zone Authority.
- The composition, number of files:
a) File components include:
1) For a foreigner is granted a work permit first, the profile includes:
- A written permit to work of the employers, partners from Vietnam or
representatives of non-governmental organizations (form).
- The foreign papers and related documents:
* For foreigners who are employed in the form of labor contract must
contain the following documents:
a. Registration form for recruitment of foreigners (form);
b. Record form issued by the judicial authorities of the state where
foreigners residing overseas without coming to Vietnam. Case the overseas
has been residing in Vietnam for full 06 (six) months or more would be just
issued by the Judicial Department of Justice where the foreigner is residing;
Record form judicial agencies competent authority to issue within 180 (one
hundred eighty) days, as of date of the application for issuance of work
permit.
c. Health certificate issued overseas or health certificate issued in
accordance with Vietnam's Ministry of Health, health certificate issued by
competent agencies within 180 (one hundred eighty ) days, as of date of the
application for issuance of work permits.
d. Certificate of professional qualification, high technology of
foreigners.For some occupations, jobs, the certification of professional
qualification, high technology of foreigners can be replaced by the following
papers:
+ Paper recognized craftsmen of traditional crafts by the competent
authorities of the foreign country for foreigners who are craftsmen of
traditional crafts.
+ A certificate or work permit or other contract workers have
identified at least 05 (years) experience in the profession, production
administration, management and consistent with the position that foreign
countries are expected to undertake. The certificate of at least 05 (five)
above experience by businesses, agencies and foreign organizations that
have made the certification.
đ. 03 (three) color photos (3cm x 4cm size, bare head, taken frontally,
clear face, ears, without glasses, white background) taken within 06 (six)
months from the date the alien applicant.
e. Documents to prove that the employer has notified the employee
needs to recruit Vietnam in the position expected to recruit foreigners.
* For foreigners moving the enterprise: the licensing dossier must
contain the papers prescribed at Point b, c, d and đ, and accompanied by
documents of foreign companies to appoint a foreign to work in the
commercial presence of foreign enterprises on the territory of Vietnam.
* For foreigners who perform the contract on economic, trade,
finance, banking, insurance, science and technology, culture, sports,
education, medical service providers contract: the dossier must contain the
license papers prescribed at Points b, c, d and đ, and together with the
contracts signed between partners from Vietnam and foreign partners.
* For foreigners who represent non-governmental organizations are
permitted to operate under the provisions of law Vietnam: In applying for
the permit records must contain the papers prescribed at Point b, c, d and đ,
and a certificate of non-governmental organizations are permitted to operate
in accordance with the laws of Vietnam.
* Foreigners entering Vietnam to perform or package of projects to
foreign contractors in Vietnam won the bid to have the papers prescribed at
Point b, c, d and đ, for foreigners contractor selection after winning the card
of registration for recruitment as stipulated in point a and the written
approval of the Chairman of provincial People's Committee.
2) For foreigners were granted work permit, records include:
- A written permit to work of the employers, partners from Vietnam or
the representatives non-governmental organizations (form);
- The foreign papers and related documents:
+ For the foreigners were granted work permit and are still valid but
needs to work for other enterprises along the position stated in the permit
must be 03 (three) color photos according to and work permit have been
issued or a copy of a work permit was granted.
+ For the foreigners were granted work permit are still valid and that
there needs to another job position stated in the permit must contain the
papers prescribed at Point c, d and đ, Clause 1 of this and work permit have
been issued or a copy of a work permit was granted.
+ For the foreigners were granted work permit but have become
invalid or void but needs to work for other enterprises along the position
stated in the permit must contain the papers prescribed at Point c and đ,
Clause 1 of this and work permit has been issued or a copy of a work permit
was granted.
