PROGRAM AND SERVICES INFORMATION
A. Early Childhood Programs
The Interlocal:
1. provides special education for all students with disabilities upon the attainment of the
child's third birthday;
2. provides students with disabilities the length and frequency of the instructional day that is
based on the students’ developmental and educational needs, as determined by the case
conference committee;
3. requires that each early special education class meet statutory guidelines.
B. Elementary Programs
The Interlocal provides the same length of the instructional day for elementary level school
special education students as the instructional day for elementary general education students in
the school building where the program is located.
C. Secondary Programs
The Interlocal:
1. provides the same length of the instructional day for secondary level special education
students with disabilities as the instructional day for secondary level general education
students with disabilities in the school building where the program is located;
2. requires that the case conference committee determine the following when developing a
transition IEP that will be in effect when the student enters grade 9 or becomes 14 years
of age, whichever occurs first:
a. Whether the student with disabilities will pursue high school graduation and a
diploma by earning credits for academic, special education, or vocational courses.
b. Whether the student would benefit from an educational, vocational, and employment
training program which is noncredit in nature;
3. awards a diploma, which is not differentiated from the diploma received by nondisabled
students with disabilities, to students with disabilities enrolled in special education
provided the minimum credit requirements are met;
4. awards a certificate of completion upon completion of the public school educational
program to students with disabilities enrolled in special education who are unable to earn
credits for a high school diploma;
5. requires that students with disabilities participate in the same graduation ceremony or
service that is provided for nondisabled students with disabilities, unless otherwise
indicated by the student's case conference committee.
D. Transition and On-Going Adult Services

1. Upon obtaining written consent from parents or students of legal age, the public agency
and the vocational rehabilitation counselor must confer at least one time per year to
review transition age students.
2. For potentially eligible students, and with written consent, the public agency should
invite the vocational rehabilitation counselor to the case conference that will occur one
year prior to the student’s projected final year of school, or earlier if appropriate.
3. The case conference committee must develop a transition IEP that will be in effect when
the student enters into grade 9 or becomes fourteen years of age (which ever comes first),
or earlier if determined appropriate by the case conference committee.
4. The members of the case conference committee who must participate include
a. the student
b. with the consent of the parent, a representative of any participating agency likely to
be responsible for providing or paying for transitions services.
5. A transition IEP must contain
a. a statement of the student’s present levels of academic and functional performance;
b. appropriate measurable postsecondary goals based on appropriate transition
assessments;
c. whether the student will be pursuing a diploma or certificate of completion;
d. the transition services needed to assist the student in reaching the postsecondary
goals;
e. if appropriate, documentation that the public agency presented written information
regarding available adult services;
f. measurable goals, or for students who participate in alternative assessments, a
description of benchmarks or short-term objectives;
g. how and when progress on goals will be measured;
h. a statement of special education and related services;
i. the extent to which the student will not participate in the general education
environment and extracurricular/nonacademic activities;
j. the student’s participation in state and local assessments;
k. the date of the initiation of services as well as the length, frequency, location and
duration of services;
l. information regarding the transfer of rights at age 18;
m. written notes of the case conference committee meeting.
6. If a participating agency, other than the public agency, fails to provide the transition
services in the IEP, the public agency must reconvene the case conference committee.
E. Transfer of Rights to Student
1. Except where prohibited by statute, when a student becomes a student of legal age, all of
the rights that were formerly provided to the student’s parents transfer to the student of
legal age.

2. If a student who has attained eighteen years of age has a guardian appointed under IC 293, the rights transfer to the guardian or an educational representative as specified in 7-436.
3. At a case conference committee meeting not later than one year before the student
becomes eighteen years of age, the public agency must inform the student and the parent
of the transfer of rights.
4. After rights have been transferred, the public agency must provide any notice required by
statute to both the parent and the student.
F. Related Services
1. Related services means transportation and developmental, corrective, and other
supportive services that are required for a student to benefit from special education. The
public agency must provide related services to a student if the student’s case conference
committee determines that related services are necessary for the student to benefit from
special education.
2. Related services may be provided as direct services by qualified professionals or
integrated services by teachers or paraprofessionals acting in accordance with the
instructions of qualified professionals.
3. Related services include the following and may include other services if the services are
required for a student to benefit from special education:
a. audiological services by a licensed educational or clinical audiologist;
b. counseling services based on the nature of a student’s counseling needs as specified
in the IEP;
c. medical services for the purpose of diagnosis and evaluation;
d. occupational therapy by a certified occupational therapist or a certified occupational
therapy; assistant under the supervision of a therapist;
e. parent counseling and training as specified in the student’s IEP;
f. physical therapy by a licensed physical therapist, or a certified physical therapist
assistant under the direct supervision of a licensed therapist;
g. recreation based on the student’s need and specified in the IEP;
h. rehabilitation counseling based on a student’s need as specified in the IEP;
i. psychological services by a school psychologist, a clinical or child psychiatrist or a
psychiatrist;
j. school health services provided or coordinated by a licensed school nurse;
k. social work services provided by a licensed school social worker;
l. transportation, if it is required to enable a student identified as disabled, to receive
special education and related services;
m. other supportive services based on a student’s need as specified in the IEP.
4. Provides related services for students with disabilities with hearing impairments that may
include, but are not limited to, manual or oral educational interpreters, personal FM

auditory trainers, note-takers and note-taking paper, and assistive devices such as closed
caption machines.
