On joint motion of all Councilmembers present, the following resolution was offered: RESOLUTION NO. A resolution authorizing the execution of Amendment No. 2 to the Engineering Agreement between the Parish of Jefferson and Shaw Environmental, Inc., contract number 55-10183, for (1) additional professional services associated with program management and project development for coastal initiatives related to the Gulf of Mexico Energy Security Act of 2006 (GOMESA), the Resources and Ecosystems Sustainability, Tourist Opportunities and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE Act), Natural Resources Damage Assessment (NRDA), the State Comprehensive Plan for a Sustainable Coast, and other funding programs, in the amount of $500,000.00, an increase of 25% above the previous contract amount of $1,968,466.72, for a total contract amount of $2,468,466.72, pending available funding; (2) to establish a new contract termination date of December 31, 2017; and (3) approving two subcontractors to this contract. (Parishwide) WHEREAS, Resolution No. 112180, adopted by the Parish Council on April 15, 2009, ratified a Professional Services Agreement with Shaw Environmental, Inc. to provide engineering services to assist with overall program management and oversight for the Coastal Impact Assistance Program (CIAP) projects at a cost not to exceed $1,668,466.72; and WHEREAS, Resolution No. 118008, adopted by the Parish Council on December 7, 2011 authorized Amendment 1 for additional services related to the development of a Coastal Protection and Restoration Master Plan in the amount of $300,000.00 for a total contract amount of $1,968,466.72; and WHEREAS, the Gulf of Mexico Energy Security Act of 2006 (GOMESA), the Resources and Ecosystems Sustainability, Tourist Opportunities and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE Act), Natural Resources Damage Assessment (NRDA), the State Comprehensive Plan for a Sustainable Coast, and other funding programs, will provide significant funding to Gulf States, coastal political subdivisions and the Gulf Coast Ecosystem Restoration Council for coastal restoration projects; and WHEREAS, Jefferson Parish desires to stay actively engaged in the planning process for these initiatives and the 2012 State Comprehensive Plan for a Sustainable Coast, and updates thereto as well as associated annual plans, to identify and develop projects within the Parish that meet the funding criteria; and WHEREAS, Shaw Environmental, Inc. prepared the Parish’s 1993 Coastal Wetland Conservation and Restoration Plan as well as an updated Plan in 2003, and is currently drafting the 2014 updated Plan, and it is desirable to have that Plan be developed in coordination with the State Comprehensive Master Plan for a Sustainable Coast, GOMESA, RESTORE Act and NRDA funding criteria; and WHEREAS, due to these planning efforts, the Parish has been successful in securing CIAP and Coastal Wetland Planning, Protection and Restoration Act (CWPPRA) funding for projects identified in both the 1993 and 2003 Coastal Wetland Conservation and Restoration Plans; and WHEREAS, due to the ENGINEER’s familiarity with local coastal restoration needs and their expertise in coastal program management, the Parish desires to continue to use the services of Shaw Environmental, Inc., for professional technical assistance with coastal initiatives; and WHEREAS, the level of effort anticipated for the additional coastal program initiatives will exceed the available contract amounts; and WHEREAS, $1,668,466.72 of the previously authorized cumulative fee of $1,968,466.72 is wholly funded by CIAP grants for design, engineering and construction oversight of CIAP projects; and WHEREAS, the Parish desires to increase the maximum cumulative fee to $2,468,466.72, which will provide for engineering services in the amount of $500,000, an increase of 25% above the previous contract amount, for additional professional services related to the GOMESA, the RESTORE Act, NRDA, the State Comprehensive Plan for a Sustainable Coast, and other funding programs; and WHEREAS, the Parish desires to extend the term of the agreement from May 22, 2014 through December 31, 2017, to allow for continued assistance with on-going coastal initiatives; and WHEREAS, coastal restoration projects within the Barataria Basin can be highly dependent upon hydrodynamic forces, particularly fresh water and sediment inputs from the Mississippi River; and development and permitting of coastal restoration projects often requires the identification, evaluation, and resolution of potential resource, plan, or execution conflicts (e.g. borrow source redundancy/sediment availability) and integration with other projects authorized in the State of Louisiana’s Master Plan for a Sustainable Coast, or other State and Federal projects/programs; and WHEREAS, AIMS Group, Inc., a Louisiana Certified Small and Emerging Business (#8432), is a professional engineering and environmental consulting firm with extensive experience in planning and implementing water resource projects in the Barataria Basin, including conducting hydrodynamic modeling for fresh water and sediment diversion projects and evaluating sediment budgets; and WHEREAS, Shaw Environmental, Inc. wishes to add AIMS Group, Inc., a Louisiana corporation located in Jefferson Parish, as a subcontractor to provide professional services such as hydrodynamic modeling and to assist with other related work; and WHEREAS, project development and permitting often requires identification of property ownership and other real estate related legal services; and WHEREAS, Shaw Environmental, Inc. wishes to add Crescent City Title W.B., LLC as a subcontractor to provide legal services as needed. NOW THEREFORE BE IT RESOLVED by the Parish Council of Jefferson Parish, Louisiana, acting as governing authority of said Parish SECTION 1. That the Council Chairman or, in his absence, the Vice Chairman of the Jefferson Parish Council is hereby authorized to execute Amendment No. 2 to the Engineering Agreement between the Parish of Jefferson and Shaw Environmental, Inc., contract number 55-10183, for (1) additional professional services associated with program management and project development for coastal initiatives related to the Gulf of Mexico Energy Security Act of 2006 (GOMESA), the Resources and Ecosystems Sustainability, Tourist Opportunities and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE Act), Natural Resources Damage Assessment (NRDA), the State Comprehensive Plan for a Sustainable Coast, and other funding programs, in the amount of $500,000.00, an increase of 25% above the previous contract amount of $1,968,466.72, for a total contract amount of $2,468,466.72, pending available funding; (2) to establish a new contract termination date of December 31, 2017; and (3) approving AIMS Group, Inc. and Crescent City Title W.B., LLC as subcontractors to this contract. SECTION 2. That all services authorized by this amendment shall be charged to Account No. 63860-3958-7331, the Department of Environmental Affairs Professional Services, pending available funding or to an account identified when a work order is written. SECTION 3. That the term of the Agreement is extended from May 22, 2014 through December 31, 2017 to allow for continued assistance with on-going coastal initiatives. SECTION 4. That all other terms, provisions, and conditions of the Agreement dated May 22, 2009, as amended by Amendment No. 1 dated December 14, 2011, except as specifically modified by this Amendment No. 2, shall remain unchanged. SECTION 5. That the Chairman or, in his absence, the Vice-Chairman is hereby authorized to execute any and all documents necessary to give full force and effect to this resolution.
