Scholarly Digital Editions: Terms and Conditions for
Institutional Internet License Access
The publication
This licence covers the electronic version of the Leiden Armenian Lexical Textbase,
edited by Jos Weitenberg, and published by Scholarly Digital Editions, 12/54a Spencer
St, Jewellery Quarter, West Midlands B18 6JT, UK. The ISBN for this publication, in
internet access form, is 0-9539610-7-9. The publication includes all XML files prepared
by the editor and software interface developed by Scholarly Digital Editions.
The publication includes no materials for which the copyright is held by individuals and
institutions other than Scholarly Digital Editions and the editor.
Outline license
The entire contents of the publication are copyrighted materials which are licensed to
your institution for use subject to the terms of the accompanying license agreement. This
is a limited license; you have only the specified use rights and all other rights are retained
by Scholarly Digital Editions and by other holders of copyright in the publication.
You must treat this publication as you do any other copyrighted material, such as a book
or musical recording. Any other use, duplication, or distribution of this product or its
contents in any medium and by any means violates applicable U.K. or international
copyright laws, and may subject you to prosecution under penalty of law.
The following are prohibited by law: any reproduction in any media except as licensed;
any theatrical, televised, or public display or performance, including unlicensed
transmission of any material over a computer network; the preparation of any derivative
work, including the extraction in whole or in part of any material without the permission
of the copyright holder or as provided for by these terms and conditions.
The purchase form for this access provided on the Scholarly Digital Editions website
(www.sd-editions.com) refers explicitly to these terms and conditions. By returning this
purchase form to Scholarly Digital Editions, authorised by a competent person in your
institution, you indicate that you accept these terms and conditions.
Disclaimer of Warranties/Limitation of Liability.
1. Scholarly Digital Editions has made and will make good faith efforts to ensure that
the publication is complete and accurate. However, Scholarly Digital Editions does
not warrant completeness or accuracy, and does not warrant that your use of the
publication will be uninterrupted or error-free, or that the results obtained will be
useful or will satisfy your requirements.
2. Scholarly Digital Editions warrants that it is entitled to grant the licenses outlined in
this Agreement, but makes no other warranties or representations of any kind,
expressed or implied, including but not limited to warranties of merchantability or
fitness for a particular purpose.
3. You will be permitted to access the publication at any time. Scholarly Digital Editions
will not be liable for any delay, down time, or other failure of performance, but will
use reasonable efforts to correct any performance problem brought to its attention.

4. Scholarly Digital Editions will not be responsible for incidental, consequential, or any
other damages arising out of or in connection with the service or materials provided
hereunder.
5. The publication is provided on an "as is" basis. You agree that all use of the
publication is at your sole risk and that Scholarly Digital Editions will have no
liability to any person for any loss or damage arising out of use of, or inability to use,
the publication.
Forms and scope of license
You have purchased EITHER
-- an annual subscription to the publication (the "annual license"). In this case, access
will be for a period of twelve months from the date of subscription, renewable annually
OR
-- a license in perpetuity (the "perpetual license"). In this case, you must pay an annual
maintenance fee which will grant all authorised users in your institution internet access to
the publication held on a Scholarly Digital Editions webserver. Access to the
publication on Scholarly Digital Editions webserver by the maintenance fee will be for
twelve months from the date of purchase, renewable annually.
Access Terms
This license grants access to the complete contents of the publication.
This license grants access to authorized members of your institution over the Internet to
the publication. You may restrict access to authorized members either by Internet
domain (range, or ranges, of IP addresses) or by user and password mechanism. There are
no limits on the number of users from the Institution that may use the publication at any
one time. This license grants access solely to:
1. faculty (permanent or visiting)
2. students and staff of the Institution
3. on-site users of the Institution's library and campus computer networks.
The institution is responsible for undertaking reasonable measures to prevent access by
unauthorized persons, either through IP address restriction or through the password
mechanism.
Multi-Campus or Consortium Access
Scholarly Digital Editions may negotiate agreements with groups of institutions acting as
a consortium, or with institutions operating on multiple sites. In such cases, each
institution and site is bound by the terms of this document.
Use of the publication
Any authorized user may search, download, and save material included in the
publication. Single printed copies of bibliographical text or individual letters may be
made for private use or research. Multiple copies may be made for classroom use,
provided:
1. that no charge is made for such copies, other than a nominal charge to cover the
cost of reprography
2. that such copies are not made or distributed for commercial advantage.
3. that all copies carry appropriate information as to the source, title and author of
the work, and the publisher
A user may transmit hard copies or electronic copies of the materials to anyone who is
not a user authorized under this license provided such transmissions are not on a
systematic basis and that they bear the Scholarly Digital Editions copyright notice, and
that they carry appropriate information as to the source, title and author of the work, and
the publisher.
Materials from the publication may not be recompiled, manipulated, used to prepare
derivative works, or published in another format without written permission from
Scholarly Digital Editions.
The Institution will not be held responsible for unauthorized use of the publication
provided: such use is without the express or implied consent of the Institution; the
Institution promptly notifies Scholalry Digital Editions of any such use of which it
becomes aware; and the Institution takes all reasonable steps to cause cessation of such
activity. The Institution agrees to cooperate with Scholarly Ditital Editions in any
investigation of such infringements or unauthorized uses. Scholarly Digital Editions shall
have the sole right, at its expense, to bring any action on account of such infringements or
unauthorized uses, provided that it will not bring an action against any unauthorized user
without first consulting the Institution.
Inter-library Loan
Institutions may use hard or electronic copies derived directly or indirectly from the
electronic edition of the publication for the purpose of inter-library loan with the same
limitations that apply to paper copies for that purpose made from a print edition of the
materials. Specifically, copies must be made in compliance with Section 108 of the
Copyright Act of the U.S. and with guidelines developed by the National Commission on
New Technological Uses of Copyrighted Works (CONTU Guidelines), the text of which
is available as part of U.S. Copyright Office Circular 21.
Privacy
Scholarly Digital Editions will gather and retain information on all access to the
publication on its servers as necessary for efficient maintenance and in compliance with
legal requirements and professional standards. Statistical reports or data that reveal
personal information about individual or institutional users will not be sold to third
parties or otherwise shared, unless required by law.
Usage information
Once access is granted to the materials, each subscribing institution will receive
instructions on how to view usage information for that institution. This information is
viewable by each publication and by month or by the entire subscription period
Agreement government
This agreement, represented by your acceptance of these terms and conditions on your
purchase of a license, will be governed by the laws of the United Kingdom. You may not
assign or transfer your rights under this agreement.
