BCB agrees to offer you opportunities, at your request, to work as a temporary sales consultant where there is a suitable assignment with a Hirer (hereinafter called the Client). The suitability of the work will be determined by BCB. BCB will incur no liability for failing to offer you any assignments. As the nature of this work is temporary there may be periods when no suitable work is available. However, no contract shall exist with BCB and yourself between assignments. There is no obligation by BCB to provide, or for you to serve, any normal number of days in a week. In the event that you do not attend an assignment you agreed to commence, the assignment shall terminate unless you can show that exceptional circumstances prevented you from attending your assignment. Where an assignment may be suitable for any number of temporary sales consultants, BCB reserves the right to decide who to offer the assignment to. PAY: BCB shall pay you remuneration calculated on the basis of a daily rate to be paid weekly through BACS directly into a bank or building society account. Your pay is subject to deductions for the purpose of National Insurance, PAYE, or for any other purpose for which BCB is required by law to make deductions. BCB will notify you of commission or bonus that may be applicable for each assignment. Any payments of commission and/or bonus are subject to the normal deductions of Tax and NI deductions. BCB will inform you of any changes to your pay and terms and conditions where you meet the criteria for completing 12 weeks continuous service (or the 12 qualifying period as this is often referred to) with the client by the start or during the relevant assignment. BCB undertakes to pay your wages in respect of work successfully completed, whether BCB is paid or not in respect of that work However, should you work on the wrong assignment without doing your utmost to ascertain the correct booking details, then BCB will only pay you if they are able to secure a payment from the client for whom you worked. OVERTIME must be previously authorised and is paid at: Cover: £9.00 per hour. Promotion: £10.00 per hour. BANK HOLIDAYS You will receive payment for working a bank holiday according to the client’s policy. For further details, please speak to your Account Manager at BCB. If assignments accepted by you either side of the Bank Holiday are not completed satisfactorily, then single time will be paid for the Bank Holiday. SUNDAYS Hours worked are paid at your normal rate of pay plus a Sunday supplement of £10.00, which is paid at the client’s discretion. HOLIDAYS – you are entitled to paid annual leave according to the statutory holiday entitlement which is 5.6 weeks per annum. The annual leave year starts from 1 April until 31 March. Your holiday entitlement is accrued in proportion to the amount of time worked by you on assignments during the leave year. You will accrue holiday entitlement at 12.07% of hours worked throughout the year. Due to Christmas trading and the sale period, you may not take holiday during November, December and January. You must apply for your holiday in writing giving notice of at least 2 times the period of the required holiday. All paid annual leave must be requested via email to your account manager at BCB and taken within the leave year. Holiday may not be carried forward into the following leave year. Holidays not taken by the end of the annual leave period, 31 March will therefore be lost. . ASSIGNMENT REPORTS - You are required to submit a fully completed report sheet signed by your Department or Account Manager. Failure to submit a report promptly by Tuesday evening will result in delays to payment of your hours worked. Our clients operate to strict budgets. Prolonged delays to the submission of your report may cause problems to our clients. Your pay may be forfeited after 5 weeks, from the weekending date of the assignment, where your report has still not been received without reasonable justification. 1 YOUR OBLIGATIONS You are not obliged to accept any assignment offered by BCB, however if you do accept an assignment you must: Be present during the times agreed day and/or days assigned. Take all reasonable steps to safeguard your own safety and the safety of any other person who may be affected by your actions at work and comply with the Clients’ Health & Safety policy. 1. Comply with any rules or obligations in force at the premises where services are performed. 2. Co-operate with the Client’s staff and accept the direction, supervision and control of any responsible person in the Client’s organisation. 3. Arrive for your assignment in good time to be ready for work at the given start time. 4. Notify BCB of expected lateness. Deductions will be made from your payment for lateness. 5. Notify BCB immediately if you become aware of any reason why you may not be able to attend an assignment. If you are unable to attend your assignment for whatever reason, notify BCB at least 2 hours prior to the commencement of the assignment. If you do not comply with this procedure without reasonable justification, your assignment will be terminated and you may not be offered any further assignments 6. You must adhere strictly to the guidelines for dress code, appearance and grooming, as outlined in the handbook. Overall your appearance and grooming must be of the highest standards. 7. If the Client wishes to employ you directly or through another employment agency, before or during an assignment, or up to 3 months after the end of an assignment with BCB, you accept that BCB is entitled to an introduction fee, which will be wholly payable by the Client, or to extend the hiring period to the Client, after which there will be no further fee to the Client. In addition BCB will be entitled to charge a transfer fee to the client if the client introduces you to a third party (other than another employment business) who subsequently engages you before or during an assignment. 8. Not engage in any conduct detrimental to the interests of BCB or the Client and/or which results in the loss of custom or business by either BCB or the client. 9. During an assignment and after an assignment you must respect the confidentiality of the client and BCB, and not divulge any information relating to the Client’s or BCB’s business affairs, transactions or finances. DETAILS OF OTHER ASSIGNMENTS When you accept an assignment you must as soon as possible before the start of each assignment and at any time requested, notify BCB of all details relating to any work completed for the client or a member of the same client’s group, between 1 October 2011 and before the date of commencement of the assignment and/or during the assignment. You must supply details of the work completed for the client or the client’s group, via any third party, including when, where and the duration. This applies to if the previous work was the same, similar or different to the current assignment; and if there was more than one assignment. SICKNESS ABSENCE: You may be entitled to statutory sick pay, provided that you meet certain criteria. If you are sick you should supply BCB with a self-certificate for the first 7 days of sickness and a doctor’s certificate/fit note from the 7th day of sickness. After reviewing the fit note or other medical information, BCB will in its absolute discretion determine whether you will be placed in a new assignment or permitted to continue in an ongoing assignment. In order to make this assessment BCB may need to consult with you and/or the client. TERMINATION: BCB may instruct you to end an assignment with a Client at any time without notice or liability. This is a reciprocal arrangement. If you do not work for BCB for a period of 10 weeks, your P45 will be forwarded to your last known address. Where this Contract for Services is terminated by either party, you may be entitled to payment for any holiday leave accrued but not taken at the date of termination. Please remember to notify your Account Manager, BCB via email if you have decided not to work on any future assignments. We will then arrange for you to receive your P45 and any outstanding holiday pay due. On completion of the assignment or at any time requested by BCB or the client you must return to the client, or where appropriate to BCB, any property provided to you during the assignment. This includes items such as swipe cards, uniforms, name badges and documents. CONCERNS If you believe you may not have received equal treatment under the Agency worker regulations please raise your concerns in writing to the General Manager, setting out the basis for your concerns. DATA PROTECTION By signing this agreement you consent to BCB processing your personal data for reasons relating to the performance of the assignment. You agree to comply with the Data Protection Laws and will not act in such a way that may cause BCB or the client to breach the Data Protection Laws. WORKING TIME REGULATIONS 10. Not behave in such a way to constitute unlawful harassment to any member of BCB or the client’s staff. 11. If you breach any of your obligations as set out in this Contract For Services and as a result BCB suffers loss. BCB reserves the right to recover such losses from you. There is a limit of an average 48 hours a week to the hours a worker can be required to work, though individuals may choose to work longer by "opting out".
