Republic Services of Michigan IV, LLC, Whitefeather Landfill (Bay County)
Republic Services of Michigan IV, LLC (Republic) owns and operates the Whitefeather
Landfill located at 2401 East Whitefeather Road, Pinconning Township, Bay County.
Inspections of the Whitefeather Landfill revealed that Top Rank Disposal disposed of
solid waste generated in Charlevoix County at the Landfill in violation of the Charlevoix
and Bay County Solid Waste Management Plans (SWMPs). The currently approved
Bay County SWMP does not explicitly authorize the importation of solid waste from
Charlevoix County into Bay County for disposal. Also, the currently approved Charlevoix
County SWMP does not explicitly authorize the exportation of solid waste from
Charlevoix County to Bay County for disposal. On September 29, 2000, a Consent
Order was entered between Republic and the DEQ. The Consent Order requires
Republic to: comply with all SWMPs; submit reports of compliance to the DEQ; ensure
all landfill gate staff are properly trained on waste acceptance procedures; construct a
sign at the landfill gate requiring customers to identify the county of waste origin to the
gate attendant; post an updated list of approved counties for importation of waste into
Bay County in the gate attendant’s work area; and pay $16,000.00 in settlement of the
DEQ’s claim for a civil fine. A Consent Order was previously entered with Top Rank
Disposal on September 11, 2000, to address Top Rank Disposal’s violations of Part 115,
Solid Waste Management, of the Natural Resources and Environmental Protection Act,
1994 PA 451, as amended.
