This STALLION BREEDING CONTRACT FOR LIVE COVER BREEDING for the breeding season of ______ made and
entered into on this ________ day of ______________, 20____. This certifies _____________________________________,
herein referred to as MARE OWNER, has engaged one service to COLOR TO IMPRESS # 176,588, for the mare
_____________________________________ - registration # ______________, APHA [ ] – AQHA [ ] – PtHA [ ] – IAHA [ ] –
TB [ ] (check one), for the Stud Fee of $500.00, to be bred to COLOR TO IMPRESS, APHA Reg.# 176,588/COLOR TO
IMPRESS YOU, AQHA Reg# 4953186. Bentley Paints & Quarter Horses, Lori Bentley, will herein be referred to as STALLION
OWNER.
NOW THEREFORE IT IS AGREED AS FOLLOWS:
1.
Upon payment of a non-refundable $200.00 booking fee to the STALLION OWNER, the STALLION OWNER does hereby
reserve for MARE OWNER one season’s booking for the year _2008_ to COLOR TO IMPRESS for the service of the
aforementioned mare only. A copy of aforementioned mare’s registration certificate must accompany booking fee.
2.
The balance of the breeding fee in the amount of $300.00 must be paid in full to the STALLION OWNER prior to the release of
the mare. The MARE OWNER agrees that the mare shall be in sound breeding condition and free from infection or disease. A
written statement from a qualified Veterinarian that a uterine culture was performed and that mare is in good breeding condition
must be received prior to mare being bred.
3.
In addition to breeding fee, MARE OWNER agrees to pay daily mare care to be charged at the rate of $10.00 per day dry and
$12.00 per day wet. Any veterinarian fees, mare care, farrier service, etc. must be paid in full before release of the mare. If mare
does not become in foal, live covers can continue until the end of Bentley Paints & Quarter Horses breeding season, when breeder
will no longer breed the stallion for that year. If mare is still not in foal, the MARE OWNER is entitled to rebreed to Color To
Impress for the following year’s breeding season only. While no new breeding fee will apply, MARE OWNER, must pay daily
mare care expenses along with any other veterinary, farrier, etc. expenses. Return breeding must be preceded by a veterinarian
statement attesting the aforementioned mare has no tract infections. If a foal is born dead the STALLION OWNER must be
notified within 24 hours of the birth and receive a Veterinarian’s statement confirming death. Breeding season runs February 1st
through May 31st. If mare arrives for breeding before April 1st, it is recommended that mare be under light therapy for 60 days or
we cannot guarantee conception. Mares don’t generally start ovulating until we have sufficient light (longer days).
4.
STALLION OWNER guarantees a live foal (defined as a foal that stands and nurses within 48 hours of birth, without assistance).
This is to be evidenced by a written statement from a qualified veterinarian.
5.
This contract shall not be assigned or transferred by either party without the written consent of the other party.
6.
A breeder’s Certificate will be issued only when the stallion breeding fees and other related fees are paid in full and upon
notification of birth of foal. It is up to the MARE OWNER to notify STALLION OWNER of foals arrival and viability. MARE
OWNER agrees to send photo of foal via mail or email to STALLION OWNER.
7.
Should stallion die or become unfit for service before any necessary rebreeding, then this contract is null and void and the
breeding fee will be refunded, less any outstanding amount due. A replacement stallion may be used if agreed upon by both
parties.
8.
The parties entering this agreement agree to negotiate in good faith to resolve and dispute related to this contract. If the dispute
cannot be resolved by negotiations, the dispute will be submitted to mediation before resulting in litigation. A mutually accepted
mediator will be chosen by both parties, who will share the costs of mediation equally. The laws in the State Of Washington and
the county of Snohomish govern this contract and any litigation arising from this contract must take place in Snohomish County of
Washington State.
9.
Implies, guarantees and warranties, including those for fitness for a particular purpose and merchantability are specifically limited,
excepted as expressly set forth in this contract.
10. MARE OWNER must register resulting foal from this breeding within 6 months of birth.
11. Color To Impress is an American Paint Horse with an Overo coat pattern. There is a 1 in 4 chance that breeding an Overo to
another Overo, or any other horse with a lethal white gene (OLWS), will result in a lethal white foal. If there is any question in
your mind about your mare carrying this gene, PLEASE have her tested prior to breeding.
12. Waiver of Liability. It is understood that Bentley Paints & Quarter Horses, its owners, employees, managers, veterinarians, and
guests shall not be liable for any injury, illness, or death of any horse involved in this breeding process.
