Republic of Latvia PUBLIC UTILIITIES COMMISSION Decision No. 23 26 January 2005 On Regulations “List of Electronic Communications Networks and Electronic Communications Services” In accordance with the coming into force of Section 17, Paragraph one of the Administrative Procedure Law and on the basis of Section 9, Paragraph two of the Law “On Regulators of Public Utilities” and Section 8, Paragraph two and Section 32, Paragraph one of the Electronic Communications Law, the Commission has decided to: 1. Approve the Regulations “List of Electronic Communications Networks and Electronic Communications Services” (Annex). 2. Prescribe that the Regulations provided for in Paragraph one of this decision shall come into force on the day following its publication in the newspaper “Latvijas Vēstnesis” [the official Gazette of the government of Latvia]. Šteinbuka Translation © 2007 Tulkošanas un terminoloģijas centrs (Translation and Terminology Centre) Regulations “List of Electronic Communications Networks and Electronic Communications Services” Issued pursuant to Section 32, Paragraph one of the Electronic Communications Law Terms used in these Regulations: 1. The following terms shall be used in these Regulations: 1.1. leased line services – publicly accessible electronic communications services, which ensure an allocated or established permanent communications channel in the public electronic communications network; 1.2. public data and electronic messages services – publicly accessible electronic communications services, which ensure signal transmission or routing in public electronic communications networks, except for public Internet access, voice telephony and the distribution services of radio or television programmes in public electronic communications networks; 1.3. public Internet access services – publicly accessible electronic communications services, which ensure signal transmission or routing between the terminal equipment and the equipment belonging to the Internet service provider (server, router, etc.) for downloading or uploading data in the Internet data transmission network; 1.4. public payphone services – publicly accessible electronic communications services, which for a charge (with coins, a prepaid card or a credit card) ensure electronic communication in the electronic communications terminal equipment installed in public places by a merchant; 1.5. public fixed electronic communications networks – publicly accessible electronic communications networks, which provide for the provision of electronic communications services where the end user mostly uses fixed terminal equipment; 1.6. public mobile electronic communications networks – publicly accessible electronic communications networks, which provide for the provision of electronic communications services where the end user mostly uses mobile terminal equipment; 1.7. public electronic communications network services – the ensuring of access to electronic communications networks to other electronic communications merchants who are not end users; 1.8. distribution services of radio or television programmes in public electronic communications networks – publicly accessible electronic communications services, which ensure service users with the option of access to radio or television programmes; and 1.9. interconnection services – the ensuring of interconnections for other electronic communications merchants. II. Electronic Communications Networks 2. An electronic communications merchant shall send a registration notification to the Commission before ensuring the following electronic communications networks: 2.1. public fixed electronic communications networks; or, 2.2. public mobile electronic communications networks. An electronic communications merchant shall send a registration notification to the Commission before the commencement of provision of the following electronic communications services: 3.1. voice telephony services; 3.2. public payphone services; 3.3. public data and electronic messages services; 3.4. leased line services; 3.5. public Internet access services; 3.6. distribution services of radio or television programmes in public electronic communications networks; 3.7. public electronic communications networks services; or, 3.8. interconnection services.
