MINOR RELEASE AND WAIVER OF LIABILITY FORM
IN CONSIDERATION of allowing the below MINOR to participate in the Bridges Across Borders Southeast Asia (BABSEA) First
Annual Trio for Justice Southeast Asia bicycling and/or running Event in Chiang Mai, Thailand, EACH OF THE UNDERSIGNEDS,
for himself/herself, his/her personal representatives, heirs and next of kin acknowledges and agrees to the following conditions:
Although BABSEA and/or the sponsor of the Event have taken reasonable steps to provide resources and guidance, THE MINOR
AND PARENT OR GUARDIAN understand that THE MINOR’S participation in the Event may expose HIM/HER to significant
risks, including, but not limited to, crime, terrorism, war, exposure to communicable diseases, the hazards of travel by airplane,
vehicle and foot, serious bodily injury or death, property damage and other risks that may not be foreseeable. THE MINOR AND
PARENT OR GUARDIAN recognize that BABSEA can not guarantee THE MINOR’S safety and understand that THE MINOR
AND PARENT OR GUARDIAN are solely responsible for THE MINOR’S safety and assume responsibility for all the risks
associated with THE MINOR’S participation in the Event.
THE MINOR AND PARENT OR GUARDIAN release, waive, discharge and covenant not to sue the BABSEA organization or its
members, promoters, participants, associations, sanctioning organizations, (or any affiliates thereof), Event route operators, owners of
Event route property, any participants in the Trio for Justice Event, sponsors, advertisers, owners, lessees and lessors of the premises,
used to conduct the Event and their officers, agents, and employees (all for the purpose herein referred to as (“Releasees”), from all
liability to ourselves, the undersigneds, our personal representatives, assigns, executors, heirs, and next of kin for any and all claims,
demands, losses or damages of THE MINOR AND/OR PARENT OR GUARDIAN on account of any injury, including, but not
limited to the death or injury of THE MINOR AND/OR PARENT OR GUARDIAN or damage to property, all of which is caused or
alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including but not limited to negligent rescue
operations.
THE MINOR AND PARENT OR GUARDIAN know that THE MINOR is not required to participate in this Event and that THE
MINOR’S participation in the Event is completely voluntary. Furthermore, THE MINOR AND PARENT OR GUARDIAN recognize
that if THE MINOR is required to leave the Event before its conclusion or THE MINOR decides not to participate in the Event prior
to its commencement, there is no guarantee that THE MINOR AND/OR PARENT OR GUARDIAN will receive a refund of any
payment made in connection with the Event.
THE MINOR AND PARENT OR GUARDIAN understand and accept that, as a participant in the program, THE MINOR is required
to observe the laws of Thailand and any disciplinary regulations in effect at BABSEA while THE MINOR resides in Thailand in
connection with the Event.
THE MINOR AND PARENT OR GUARDIAN are informed that BABSEA strongly recommends that THE MINOR obtain insurance
coverage valid overseas to protect against the costs of hospitalization and medical care in the Event of sickness, accident, disability, or
death, and to offset expenses of unexpected emergency evacuation and repatriation, trip cancellation, or loss of property, THE
MINOR AND PARENT OR GUARDIAN understand that THEY are solely responsible for obtaining Travel and Health Insurance for
THE MINOR.
THE MINOR AND PARENT OR GUARDIAN understand that BABSEA accepts no responsibility for any delay, loss, damage or
injury to person or property caused to others or THE MINOR whether prior to departure or during traveling. Furthermore, BABSEA
shall not be responsible to any person for any of THE MINOR’S acts or omission, except to the extent that THE MINOR’S activities
are within the scope of approved activities covered under the organization general liability insurance.
Except as required by law, THE MINOR AND PARENT OR GUARDIAN agree to hold harmless, release and forever discharge the
organization BABSEA and its trustees, officers, employees and agents from any and all claims, demands and causes of action of
whatever kind that THE MINOR may have including, but no limited to, illness, bodily injury, imprisonment, death and loss or damage
to property, or the consequences thereof, resulting from or in any way connected with my participation in the Event.

This Release and Waiver shall be construed broadly to provide a release, waiver and indemnification to the maximum amount
permitted by law. If any part of this Release and Waiver is held to be invalid, the remainder of the Release and Waiver shall continue
in full force and effect. This Release and Waiver shall be governed by and construed in accordance with the laws of Thailand and the
parties submit to the exclusive jurisdiction of the Thai courts in respect of any matter or dispute arising in relation to this Release and
Waiver.
THE MINOR AND PARENT OR GUARDIAN HAVE READ AND VOLUNTARILY SIGNED THE WAIVER AND
RELEASE OF LIABILITY AND INDEMNITY AGREEMENT AND DO SO VOLUNTARILY AND WITH THE
UNDERSTANDING THAT SUBSTANTIAL RIGHTS ARE BEING GIVEN UP. WE FURTHER ACKNOWLEDGE THAT
FAILURE TO WITNESS OR NOTARIZE THIS AGREEMENT SHALL NOT AFFECT ITS VALIDITY.
